  2. Ok latest update... Sent off n244 requesting instalment order; Letter from court Your application has been referred to the district Judge who directs that you need to make an application to vary using the enclosed form (n245) and pay the relevant fee of £40.. I can fill out most of form but the first part " I cannot pay the amount ordered and I wish to apply for suspension of the warrant and/or a reduction in the instalment order " What one do i choose here ?   4. What order are you asking for; Redetermination to an instalment order. The defendant asks the court to order monthly payments of 1 pound per month as shown in attached I&E sheet showing disposable income. The Defendant feels it would be unfair to other creditors who have agreed to 1 pound per month to pay the claimant more. The Defendant is willing to update his I&E on a 6 monthly basis and any extra disposable income be spread equally to all creditors. No reply was given after sending I&E to Claimant This is the best I can come up with... But im with no knowledge ! Eggy
  5. have you attached a draft of the order you are applying for ? How do you want to have this application dealt with... At a hearing ? how long... 20 mins ? level of judge ? who should be served.. The claimant what information will you be relying on.. witness statement, statement of case , or evidence set out in box below ?

Ive found a web page with the N244 form on it found here http://www.hmcourts-service.gov.uk/courtfinder/forms/n244_e.pdf but im unsure how to word a judgement to be made to make monthly payments in the box asking "What order are you asking the court to make and why" Would it be that simple just to put in the box "The defendant offers the claimant £1 per month as per attached Income and Expenditure sheet showing disposable income" ?? Any advice or pointers inn the right direction most appreciated eggy

  8. Thnx A .. Your input is always appreciated.. Does this cost a penny or two ? Will have a closer look 2morrow night... Order was made yesterday so have a few days ! I best pop in to court and get form, unfortunately my local is only open twice a week now so gotta get the timing right Best regards Eggy extra Does a forthwith judgement mean they can over ride a judgement even if i do keep up with said payments and get a charging order
  9. Advice needed as to how best proceed OK As ive withdrawn my defence the court has ordered Forthwith for the total amount.. Ive offered A/Global £1 per month in writing and sent of my I&E but have heard nothing. It i s ordered that 1 There be Judgement for the claimant for the sum claimed and fixed costs as on a default judgement 2 Because this order has been made by the court without considering representations from both parties, the parties have the right to apply to have the order set aside, varied or stayed. Any party wishing to make an application must within 7 days of receipt of this order, send or deliver the application to the court (together with any appropriate forms). Any help getting a court order for the £1 per month would be extremely helpful as i not sure where to get this from Regards eggy
  10. not gone through the court yet, ive admitted the debt, they wont take £1 a month so it will go court for the judge to decide. I changed my plea and have yet to here some thing. Will update as and when Eggy

Arrow Global v Eggy12 To the Court Manager Having on the 23rd July 2011 received the documents regarding my CPR 31.14 request sent to the claimant 13th May 2011, I would now ask the court that I withdraw my defence and admit to the claim of £5942.11 as stated in the claimants allocation questionnaire to the Court dated 27th June 2011. Although I admit to this claim I must state a settlement has not been reached between us regarding repayment of the debt after my offer of £1 per month . Latest update (in short) On or before late July the following steps must be taken Standard Order for Stay for settlement with consent of all the parties Claim stayed till early August to enable the parties to attempt settlement. either the claimant notify court that the whole of the claim has been settled or claimant and defendant write to court requesting an extension of stay explaining why or all parties must file a completed AQ at the court where a settlement of some of the issues in dispute has been reached.. A list of issues must be attached. The list must be agreed with the other parties and must indicate it has been agreed Still should be in my favour as nothing yet regards any agreement and the likes Eggy
  16. Im not sure where you can go with this now Vans.. As it stands you admitted the debt and the rest is as it is... Regards the request im sure they are legally obliged to supply it but as said in an earlier post they wont feel the need to supply it as you have already admitted there claim ! Im no expert and i may be totally wrong, it was to late for me as this happened when NR took me too court but i then found this place and have fought all other claims thrown at me...   17. ok update time, Ive spent in total 2 and a half days going over things and re electric this is what has happened. in Feb 09 Eon came round and fitted an upgraded meter. over the next 10 months when a bill arrived it was still being estimated on my old meter, finally an eon chap came round and took readings for Npower. In Feb 10 they finally switched meter readings to new one. When they took out old meter the readings were 45900, when they changed readings a year later it stopped at 48760, the new meter showed 660. they just started off at 660 rate and stopped at old estimated rate. They then started demanding £55 a month. now because the new meter was fitted at 00000 it was easy for me to find an average of what ive been using and that turns out to be £19 a month over the 28 month period !!! Was on the phone to them yesterday for 1 hour and 20 minutes and they finally admitted its there mistake and will re calculate and that after money i have already paid should clear the bill easily and maybe be in credit !! Regarding the gas bill i owe them £1200, Whilst on the phone the chap told me Warrant for entry is now cancelled for electric but they are coming to fit payment meter for gas on 15th August. i said ive heard NOTHING about gas account, he said the woman in warrant team had told him its already been to court and they have acquired warrant but I WOULD NOT NO ABOUT IT as nothing was sent to me about it !!!!!! Shocking Eggy12 Ant thoughts on what to do about gas , as mentioned above they took the matter to court and did not notify me Eggy
  18. did not get round to ringing them.... Had to sort out warrant of entry regarding energy suppliers today, got that withdrawn.. Will post in my other thread what happened 2morrow as a whole lotta sh**t went on.. Regards Eggy well its all happening today... First letter opened is from court ordering that claimant does not fill in AQ buy 14th July the claim is struck out. Second letter opened is from Arrow with a copy of there AQ dated 4/7/11 First thing ive noticed is that including there costs on claim form it totals 6700 so that is what i disputed..on this AQ from them they dispute 5900 !! They have asked for it to go small track as its only a moderate amount over the £5000 limit Thats it really no directions, they expect it to last an hour and a half Regards Eggy

  20. Im not here to cause problems and i believe i have not started one.. I clearly stated that if Sicks case is the same as mine (AQ N150) then he should take a look at my thread... It turns out its not a N150...Im here to ask for help then exchange experience if helpful... I would hope more direction can be focused on Sicks case Oh God im starting to sound like i know what im talking about Eggy N149 for claims below £5000, Mine is £6.5k hence upped a level There are 2 types of Allocation Questionnaires, form N149 and N150. Form N149 should be issued for claims that are considered likely to be handled by the Small Claims Track. See N149 Guide below, and form N150 for more complex or higher value claims. See N150 Guide below The N149 is very straight forward - in fact the AQ itself, being a 'multi-purpose' document, is not really tailored to the needs of a small claims case. Since the N150 is usually distributed for claims which are likely to fall outside of the scope of Small Claims Track, it is slightly more in-depth and has a few more sections. However, do not be worried if you receive one and your claim is under £5,000 - it could just be a mistake.   23. Ok rang them(metreplus) a few hours ago, told the chap about if i stumped up £600 NP said they would put me on arrangement @ £175 a month. Told him i may be able to pay on the 8th July the final £250 that makes it up to £600, he says that shouild be ok as the date for applying is the 6th so if i can get the payment in they should accept although i will have to pay the 50 odd pounds court charge ! OK fair do's on that.. What i did not ask was is it just electric metre they want to fit or gas as well. I wanted to get some advice here first. I cannot understand why they are, as it seems just going for entry to home for Electric only as the letters say.. Surly they would also need the same warrant for gas even though its on the outside of my house ? Eggy Prepayment meter If appropriate we can install a prepayment meter and set it to cover the energy you use and to pay back the money you owe based on what you can afford. What they did tell me some time ago is that if a meter is fitted i will have to pay 50/50 on what ever i pay into it regard usage and debt ! Also, could i ring the court and ask what specifically they are going for, elec or both.. Confusing me as the Gas is the higher bill !
