  1. Thanx for all your help slick, Thats good new that i have grounds to challenge the default, I'm just waiting for my Subject access request to be returned at the moment. We'll see what this shows, then will take the next step. Thanx again.
  2. It is true that a default can not be issued fo the same debt twice. I am having this issue resolved at the moment. Had a default on my report for a debt from barclays who later sold the debt on to a debt collector who put another default on for the same debt. Barclays should have removed the origional default when they sold the debt on. My advice is to contact experian (www.experian.co.uk) its free to join for the first month, give them a call and they will do the work for you. They are currently contacting barclays for me to request they move the origional default. Just waiting for the confir

Hey, thought i would bump this thread up a bit because the exact same thing happened to me but unfortunatly I was not aware of the letters I was recieving back home while I was away travelling and when i arrived home my account was closed lots of charges were added to my debt and to debt had been passed onto a debt collecters who have put a default on my credit report. This happened 2 years ago while I was out of the country so still another 4 years to go until the defalt is removed.   6. Just thought I would joing this thread as I'm in a similiar position. I too had an overdraft with barclays. I didn't ignore the letters but was out of the country travelling so never recieved them. I got back to uk my overdraft debt had increased by about £500 the account was closed down, debt passed to a debt collectors and a default placed on my account! I'm trying to claim back charges too, Sent of a subject access request today but I don't know what the next steps are when I get back my statements. So will join this thread and hopefully find out some answers! Looking to get the default rem

  8. I'm wanting to send a S.A.R to barclays concerning a current account and a barclaycard. Would I have to do this in 2 separate letters and pay the £10 twice or will one letter and fee be enough to cove both? Also both accounts are now closed, current account closed in 2007 and barclaycard terminated in 2003 can I still send the request even though the accounts are no longer active? Were can i find a template for this?

When i returned to UK my bank account had been closed and the debt passed onto Lowell Portfolio. The debt was for £1970 so must have had some charges put on this while away. Lowell have put a default on my credit report. I am paying the debt back to Lowells at the moment this is not an issue, All I really want is fo the default to be removed. What can I do?
  10. What determines an "unfair" penalty? I know i would of had penalties when I went over my agreed over draft limit cos the debt went from about £1600 to over £1900 while i was out of the country, are these unfair penalties? I'm sure i have other penalties too for direct debits etc.. If the Subect access request shows that my debt is comprised partly of excessive unfair charges can the default be removed this way? I read somewhere that if this is the case the default could be in breach of the Data Protection Act 1998 and the bank may have breached the Banking Code of Practice.

  13. Sorry i'm really new to all of this, whats a subject access request? If I ask for one what will it show me and how would i go about claiming back charges? Sorry I really don't know much about all this business, would i have to send a postal order of £10 with my letter to the bank? Any one have a template for the letter I would need? Any help would be greatly apreciated.
  14. Was just wondering if anyone has any advice on what I can do as my debt comes fom an agreed overdraft and my student bank account. Which was closed down and passed to a debt collecters while I was out of the country travelling. I don't mind paying the debt back in full but rally would like the default on my credit report removed. Have been told that there usually are no CCA's with overdrafts any other way around this?
  15. Congatulations on your success so far hackers! Done brilliantly to get 8 defaults removed! Would you mind giving me a bit of advice on my situation? I desperate to get a default removed from my File. Its with Lowell. I had an overdraft with barclays and my account was closed down and the overdraft debt passed to lowell while i was out of the country travelling. I have made a couple of payments to lowell for this debt. I don't mind paying it off in full but i want the default removed. I'm not really sure what a CCA is, if i ask lowell to provide this what would they need to send me? Whats an un
