  3. Hi dx If I understand you correctly you suggest sending a new CCA to Cabot - please can you tell me why? and Send Acknowledgment of Service, Item 1. Defend all but not contest jurisdiction. (BUT if I need to attend court I do not want to go to Northampton is it not better to change?) and CRP letter to Restons. I have seen the draft letter on the site. Will send tomorrow registered post.   5. In September NatWest filed for a hearing for the monies owed by my wife including a joint account, a loan to my wife, and an overdrawn bank account for my wife. Just before the hearing date we agreed a full and final settlement which has been paid and we throught this could be all crossed off the list. Moorcroft the Debt Agency dealing with the, Joint account only, are now demanding their money from me as joint account holder. I sent them copies of the legal papers but it is all in my wife's name. I am fairly new to all of this, but last year NatWest issued legal proceedings against us for non payment of the loan due to our financial circumstances and we are currently only making small affordable repayments to our creditors. We have attempted to defend the proceedings for mis-selling of the insurance and the loan so far but this was prior to finding this excellent forum, and we have issued all credit cards and loans with CCA letters and now just issued a default letter but today we received a reply regarding the loan with NatWest attached.   12. I currently pay Moorcroft £10 per month; instalments against a Joint overdrawn account. I have been able to trackdown the statements and calculated the following: Original debt April 2006 £478 Interest and charges incurred £481.82 ( upto March 2008 ) The CAB helped us in April/May 2006 with making token payments and requesting interest to be frozen, although I cannot find a copy of that letter at the moment. Could some kind person suggest a way of getting the interest and charges reduced to nil. Thanks for your help.

  14. I too have received a very similar letter from Capital 1. I was just about to draft a letter Account in Dispute but wanted to explain why they had not complied with the original request but from my research on this formum Capital 1 are well within their rights to omit personal details. Do we conclude that the agreement is enforceable? I am fairly positive that I did not apply for the Capital 1 card on-line and would have got it around 1998 ish.
