Now received court date for early March and allocated to small claims her SOLS say they will disclose when theyre ready. any letter I can send to hurry them up?I still have no idea what they are going to try and come up with. I need to know so i have time to put in my amended defence. any help guys?
  2. she hasnt produced any evidence at all yet not even including herself to give evidence! according to her AQ.so ive had a AQ! dont know if they have *restated* case as I dont know what it means.you never answered this Question--all theyve sent is POC as post #8 back in august,and copy of their AQ sent on 16/11/10 one week after 9/11/10 deadline their AQ was hand written with no solicitors name or address! It was attached to a letter from her solicitor saying the AQ was his(my sons) copy.sent under court protocoll .All very strange?? id be gratefull if you could answer any questions i
  3. my AQ was handed in before deadline no problems with that. its theirs that was late, they dont include what evidence they are relying on, arent they supposed to under court protocol?

  5. thanks IMO i think her sols are just trying to get him around a mediation table he has a lot to lose she has everything to gain even 50% would be a good result for her, considering she hasnt produced any evidence at all yet not even including herself to give evidence! according to her AQ.waiting to see what she does next after DJ allocates if she discontinues can we claim our costs? her sols have now asked for small claims court.:-)bk

Hi fossn you really need to post the reply card up as there are several different versions, as its a reply card it comes under *distance selling regulations*and as such it MUST have the creditors name AND address on it. if its Capital One it wont have it so its unenforceble hope thats of some help :roll:bk
