  1. Thats my concern. But i am juts curious as to how many companies have started offering this. Surely they must think there is some kind of basis for this...
  2. I completely understand that a tick box shall suffice, but my concern is there is no tick or tick box on the t&C's...only a Y on that seperate sheet...which is clearly a seperate document.
  3. Hi, I am currently exploring the enforceability of my credit card agreements based on the CCA 1974. However I was wondering if i called the cc companies and explained that i was struggling to make the repayments, and managed to negotiate a reduced monthly repayment, could this affect my pursuit of unenforceability in the future if the agreement wasnt executed correctly? The reason i ask this is because I am struggling to make repayments. Advice would be appreciated. Thanks, DK

Hi, I have come across companies recently that claim that they will 'buy' your credit card debt from you (the person who has the debt pays a few hundred pounds) so that they can pursue unenforcability of the cards based on the CCA 74. They are claiming that once they take this debt off you it is transferred to them and as far as you are concerned the debt is no longer your responsibility. I wanted to know how legitimate this practice is and whether you are actually allowed to transfer your debt. The reason I ask this is if I sold my CC debt to a solicitors firm that did this, if

  6. Hi, I requested my credit card agreement from barclaycard on 10th November 08 and didnt receive a reply from them until 30th December (considerably more than than the 12 days requested. In this response they did apologise for the delay and enclosed 'a copy of your original barlcaycard credit agreement at the time you opened your account'. They also stated my balance etc. In addition they said that my current credit agreement would be sent in a seperate letter.   7. Hi, I have a credit card with Skycard and wanted some advice on the enforceability of the credit agreement based on the CCA 74. I wrote to SC in November 08 requesting my credit agreement and they have sent me a standard printed sky card conditions which says credit regulated by the cca 1974. It has my address and their address on it. This 2 page printed document does not have my signature or any kind of date on it. Hi, I requested my cca from barclaycard towards the end of last year and i feel they have not fulfilled their obligations under the cca and i wanted to know if anyone had any advice they could kindly offer me. I dont have the exact dates on hand, but i intially requested the signed agreement (and sent the nominal payment) within 12 days, which they didnt reply to until about 2 months later.   9. Exactly. Its only t+c's and one sheet of paper. There is no tick on the agreement however there is a Y on the application form next to Esignature. As per advice I think ill SAR this aswell as this is also underwritten by barclaycard. Thanks again.
  10. Thanks for taking a look. This was done over the internet and I have heard that an electronic signature is a valid as a usual one. However my issue with this is that my signature (electronic) is not on the agreement and the sheet that it is actually on seems to be a completely seperate document.

I would be extremely grateful if anybody could offer any advice on their enforceability by looking over the agreements I have received or by offering any other advice. I wrote to Barclaycard visa card on 11/11/08 and they sent me the following agreement on 2/1/09, cleary more than the 14 day period. In addition the agreement is not signed by me. With regards to barclaycard I request a signed copy of my agreemnet and they have replied however have sent me unsigned copies. I have written to them again and have been advised to give them 30 working days. I think i will deal with each one individually as advised. Hi, I am really struggling financially and would be incredibly grateful if anyone could advice me on how is the best way to challenge credit card CCA agreements to determine their enforceability. I know there are some companies out there that are charging large amounts of money to help you do this, however at this stage I feel having to pay 30% of my debt plus an upfront fee is not the smartest thing for me to do.
