  2. sorry still not great with photobucket ! Anyway for really hoping Post could look at this. This is the personal loan we had with welcome before taking out our secued loan, which in turn paid this above off early. You had previously said to me to check the correct rebates had been applied. It looks like we have been charged to pay this off early in the terms of "settlement penalty interest " I can't find anything in the t&c"s off the loan reagrding this, can they do this ? Just wanted any clarification on this because the end figure has then been transferred onto my secured loan with the cash advance we had, just wanted to make sure all figures we're as they should be !
  3. been looking through the t&c's on the personal loan, no mention of early settlement penalties ! No surprises there then hey ?! anyway as regards my SAR wondering if another letter should be sent in that they have failed to give all info ? The other loans are with the 6 year period so am I right, it is the law they have to provide that ? Also as regards to my secured loan, I have a list of times when welcome have accessed my account for example : 04/04/2008 arrangement made 02/10/2008 check account 05/12/2008 outbound call is this satisfactory info, or should each entry have more details, such as a telephone transcript, or a computer shot ? Wouldn't have a clue what "arrangement made" would mean. Account has never been in arrears. Just wondering if I could get more information, rather than just a list.
  4. i was under the impression that an SAR would also provide screen shots etc, but I don't have anything like that. does any body know what exactly should be in the SAR ?
  5. just received back my sar from welcome. It includes the details from the secured loan, plus one personal loan not the any off the others. There is a letter in it that says that we have the advanced copy of the loan and the charge agreement to look over. There is no copy of the advanced agreement just this letter, but we have never seen it before. But then how would we prove we never got that ? The ppi is on both loans, so we can go after that because on all the loans we were sold we were told that it would have to be taken out in order for us to get the credit. On their loans figures on the personal loan, it does look like they have applied a credit for insurance becuase we have paid it off early, but I can't see a credit for the loan being paid off early. In fact it looks like we have been charged an interest amount for paying it off early. Not sure what else im looking for on this, is there anything else i should be looking for ? Any help would be much appreciated, thanks
  6. your situation sounds a lot like mine. But i've been doing some digging with trading standards, and because we have signed on trade premises you aren't entitiled to the cooling off period, even if its a secured loan. You should however have had the contract to look over 7days prior to with no contact from welcome to influence you. Now i never had that as im sure you haven't. You can take them to court for that, but you have to prove that by having that contract 7days before, it would have changed the outcome of you taking the loan. Trading standards say that is a long shot, and could be very expensive to us if the judge goes welcome's way. Ive been advised to go after the ppi. I too had previous loans with ppi and im looking into if the correct figures were given etc in paying off old loans and ppi's. Im waiting on my SAR from welcome, have you sent for one of those ?
  7. rung rang a few places today, spoke to consumer direct and national debtline. There is no cooling off period if signed on trade premises. However, we should have been given an advanced copy of the agreement 7 days prior, of which time welcome should not have any contact. Unless we request to them, that this period be made shorter. The problem is that this would not definatly make this agreement unenforcable. It would have to go to court and it would be up to the judge on the day. And although the agreement wasn't exceuted properly, if the judge didn't think this would change the outcome; being that even if we had of received the contract 7 days prior we still would have still taken out the loan. Then they will go in welcome's favour an enforce the loan. Meaning that we could then be made liable for all costs including welcomes. They seemed to think that this was a very risky angle to take, and we would just be better to persue missold ppi.
  8. waiting for my SAR but really wanting to get my complaint in with welcome, in case they go under first. but if i complain now and mention this before they have sent out my SAR, will i be giving them a heads up on what im up to ? They might doctor their records ?

  11. by a pre approval agreement, do you mean a copy of the credit agreement or a statement of price ?
  12. the only thing my loan says is that i should have been given a copy of the agreement 7days prior to. I wasn't, but surley that would be hard to prove ?
  13. been reading up o the OFT website, and it doesn't seem to look good for the cooling of period. It does say that if on trade premises then the cooling of period doesn't apply:confused: whether this is different for a secured loan i don't know
  14. if there was any justice, all our agreements would be thrown out, welcome go under and we all live happy on the money welcome have been conning us of for years !

  16. well i have NEVER had a letter of welcome to say we had been accepted for a start. Like I say had not seen this breakdown before till Welcome sent it to me rehgarding another matter and that was January this year. And we certainly did not have 14 days with no contact from them. Im don't even think that there was 14days from start to finish of this whole thing. The dates on all this documents prove that, 1 19th, 1 25th and then loan signed 31st and money issued. Where is the 14 day clear in all that ? What do I do now ? IM still waiting on my SAR
  17. Sorry but another thing i had thought off, I don't ever remember seeing this monthly breakdown of payment sheet. A photocopy of it is all i have and that is when i have complained to welcome previously about something, that they have sent it to me. I was never given it at the time to look over before we took it out. It also says on the credit agreement that we should have been given a copy of it 7days before our signiture, we never were.
  18. on my credit agreement loan was signed by ourselves and wecome on 31/10/06. THey have other documents which have our signiture on, from previous dates. These are a secured loan payment sheet of a breakdown of the monthly payment dated 19/10/06 They have a need and demands statement for insurance dated 19/10/06 They have an insurance suitability form dated 25/10/06 Now i know I didn't go in the office on 3 seperate occasions, so not possible. But they are our signitures, but I don't think we have dated them. But I can't prove that. So would the 14 day cooling off period run from the signiture on the 19th on the monthly breakdown of payment, to when we received the cheque ? Or does it run from the date on the signed credit agreement to when we received the cheque ?

  20. No, my husband rang enquirying they gave us an estimate of what it would cost. We went in a fewdays later to go through our income etc. We then had to go in the following week, cause we were told only issued cheques on the 1st of the month. We signed and got the cheque the same day. But I thought I couldn't claim the no cooling off because cab1ne said the other day, id been on their premises twice so it would be hard to claim that. All this really confuses me, feel I could get them at so many angles but don't know which, which was why I was waiting for my SAR. You said on an earlier thread I could get them if they haven't issued the correct rebates on the old loans and insurances as we had to have them on the other loans. Also missold ppi on this secured loan. But ive got all little bits off info and donm't know how to put it together. Concerned if I leave it and they go bump in the mean time, we have missed the boat on trying to claim.

  22. just commented on another post regarding starting a complaint now before welcome go under, of course if they do ! Thought it would be best to come back to my own thread. Not sure where to start complaint without any infor from SAR. Orginally post you said I would have PPI claim, also that they might not have refunded previous loans correctly or the PPI on them. I queried the 14day cooling off but have since learnt can't do that cause I signed on their premises. So im at a loss as to what to start a complaint with ? any help on the matter ?
  23. Post, Im waiting for my SAR so at the moment, so welcome think all is well with my account, no arrears, no complaints etc. So if they were to go and account got sold on, can I then not dispute my account with new company cause I hadn't already done so with welcome ?
