  1. Just as a matter of interest. I obtained a copy of my CRA from Equifax and note that Egg marked my account as 'S' meaning 'settled' on the 30/9/2004. I also note that dear old Cabot have registered a D for default on August 2004. Interesting given that they claim in one of their letters to me that they have 'recently' bought my account. Any comments anyone????
  2. Thanks Jogs. Will do. I'm so glad I kept those statements.
  3. Sorry! Human error, I got the figures reversed. In fact, reading the initial letter from Cabot, they claimed I owed them £4629 and in the most recent letter they now state I owe them £4688. The debt to Egg was £4549 back in Sept 04 and I did make some repayments to Egg and Moorcroft via DMP. So charges have been added by goodness knows who along the way. Egg never informed me that they were selling the debt and Cabot have never informed me of what they are basing their charges on. Can they add charges to an account in dispute?
  4. Hi Cabot wrote to me out of the blue claiming I was in arrears on an account, they gave no details of what the account was and asked me to contact them.... I didn't. I came to this forum instead! The second letter arrived soon after. They claimed to have bought a debt from Egg for a credit card I took out in 2001. To cut a long story short. I went onto a Debt Management Plan with CCCS in Sept 2004 and made payments to Egg. Egg then passed on the debt to Moorcroft, who took a couple of payments and then I noted on my CCCS statement that the balance for the Egg account was nil and that no payments were being made. I did not question this. I was never contacted again by either Egg or Moorcroft. Then, four years later, Cabot appear out of nowhere. I have asked them for a copy of the original agreement on the 2nd of February 09 and to date it has not been forthcoming. Cabot have written to me this morning stating that they have been unable to get my requested information within the 'relevant time period' but that they will keep trying. They even suggested I could ask Egg for it myself! I think not. To get to the point, I have noticed that they are applying charges to this old debt. My balance has gone up from £4646 to £4288 in the space of four weeks. Can they do this on an account that is in dispute and that they kindly claim they will 'put on hold' until they have the documentation? What should be my next move. Any advice would be gratefully received. Many thanks Annakin
  5. Brief update and if anyone can help, a few questions. I have received what appears to be the standard reply letter from Crapbot following my request for a copy of the Credit Agreement. Extracts as follows:- 'The Cabot Financial Group is not obliged to provide this information but we are pleased to help' 'Cabot Financial does not accept the statutory fee required under section 77/ and/or 78' 'We anticipate that we will be able to provide this information within 12 days. In the event we are unlikely to obtain this information within those time limits, we will write to you again' In the meantime, I have obtained a copy of my credit report from Equifax and wondered if anyone could help me make sense of things. Cabot claim in their letter to have recently bought the Egg debt. However, on my credit report, the credit card that I had with Egg is marked as 'Satisfied' in August 2004. I commenced a Debt Management Plan with CCCS in September of 2004 and made at least 5 monthly payments in total before Egg stopped accepting payments. Somewhere in the middle of this time period the debt was passed onto Moorcroft Debt recovery (I was never contacted by Egg or Moorcroft to inform me as to who was managing the debt or required payment). I remained on the DMP until late 2008, thus, either Egg or Moorcroft could have received monthly payments. I paid without fail as I was terrified of defaulting. The balance outstanding with Egg at the time of commencing the DMP was £4590. Whilst on the DMP I repaid £202 (balance £4388). The balance that Cabot are claiming that I owe them is £4645. So who has added the charges/received payment? I note that on my credit report that Cabot have made an entry on the 3/2/09 stating that the current balance is £4600 and that their terms are 0 @ £0 monthly. What does this mean? My main question is, why did Egg mark the account as 'Satisfied' in August 2004? (This was when I informed Egg that I was commencing a DMP). Was it perhaps because they sold the debt to Moorcroft? Does this mean that Cabot have purchased the debt from Moorcroft? Why would Moorcroft never pursue repayment and then sell to Cabot after four years of no communication? It is all very confusing. I will request statements if Cabot produce an enforceable agreement, but in the meantime would like to figure out as much as I can. Knowledge is power. Thanks to anyone who can offer any morsels.
  6. Thanks Pinky69 for your support. These things are a heavy burden on your own.
  7. Yes, I've got the bags under my eyes to prove it, lol! They have been gripping late night reading.
  8. I'm new to this informative site and have spent the last few days trying to learn as much as I can following three sunny yellow letters from CABOT, the first one claiming that 'We've recently had confirmation of your address' (oh yeah?) and that 'Your Cabot account is overdue'. What account might that be then I asked myself?!!! The second letter soon followed, informing me that 'Cabot Financial Group has recently bought the account you held with Egg'. I only wish that Egg had sold it to me at the knock down price Cabot no doubt paid. I was delighted to read that their friendly team want speak to me and help me pay this debt, but decided to decline their kind offer. Now my side of the story. In September 2004, I commenced a Debt Management Plan (DMP) with CCCS. I did this owing to the fact that I was in a great deal of debt following a divorce (you know, the homeless and broke type) and wanted to get myself straight as I have three young children who I have sole care of. Within the first couple of months on the DMP, Egg passed my account over to Moorcroft Debt recovery (although they never officially told me that) and neither Egg or Moorcroft claimed any payments via the DMP. Looking at my statements, it appears my last payment in relation to this debt was in January 2005 to Moorcroft. Moorcroft never once contacted me for payments directly, I assume now that they must have passed the account back to Egg. Egg never contacted me or asked for any payments. I have always kept CCCS up to date with my address and contact details. I haven't been in hiding, or avoiding my responsibilities, but they in my opinion have failed in theirs. Since then, I have paid off the bulk of my debt by hard slog and negotiating some settlements. I have two debtors I continue to repay monthly. I thought that I had finally got on top of things. Wrong!! Our dear friends Cabot appear from nowhere. What irritates me is, why didn't Egg or Moorcroft ever offer me the chance to pay peanuts to clear this debt? Why did they never contact me? Why sell this debt to a firm that thrives on other people's misery? (Rant over). I have today sent a registered letter stating that I do not acknowledge the debt and asking them for a copy of the agreement etc (based on a template from this site). I have enclosed my statutory £1 and printed my signature. I shall just have to sit and wait to see what rubbish they come up with. At that point I shall be eternally grateful for any input/advice from more experienced CAGers as my legal knowledge is a little lacking. But I'm a quick learner determined not to be conned by Cabot. Thanks for taking the trouble of reading this. Yippee, I'm now an official member of the Cabot Fan Club!!!
  9. [What will Cabot do next? Hi, I'm in the same position. I recently received a letter from cabot (or is it carboot), which read as follows:- 'Your Cabot account is overdue We've recently obtained confirmation that you live athe the above address. Your account is overdue and we need to talk to you as soon as possible. Speak to one of our helpful advisors blah, blah blah!' In view of the fact that I am unaware of owing these people any money, I disregarded the letter (knowing the next one would follow). Sure enough, letter 2 has duly arrived. This time with a little more info:- 'The Cabot Financial Group has recently bought the account you held with Egg and we're now responsible for answering your queries and receiving payments. According to our records you owe us £****. Please contact us asap etc'. My last payment to 'Egg' was I believe November 2004 via CCCS. Following a divorce I ran into financial difficulty and in order to get my finances under control went on a debt management plan with CCCS. Egg passed this debt onto Moorcroft (some debt collection agency) who strangely stopped making claims for payments via CCCS in November 2004. I have had no contact from Egg or Moorcroft since November 04, despite my informing them of contact information. Now this in Jan 09. I have recently come off the DMP with CCCS as I negotiated settlements with most of my creditors. The two creditors that would not agree to a reasonable settleent figure I make repayments to without fail every month. There seems to be a wealth of information on this website and many who have trodden this path before us. I'm not sure where I go from here, but I'm hoping to learn by devouring this website. I plan to ask for a credit report to see if they have issued a default and to speak to CCCS for advice. I'll keep everyone posted with updates. Don't let them intimidate us. Knowledge is power.
