  1. Not on here much, sorry. Job, life, y'know... Have asked for written confirmation of account balance / payments mde etc but no response as yet, as there never has been in past.mhowever amount of texts and calls has fallen significantly so they obviously read my letter.
  2. I think different agencies calculate holiday pay in different ways. As it happens I've just received my payslip for last week, and I appear to have been paid a much lower hourly rate for the 1.5 days of leave I took last week than I did for the hours I worked. I assume (and will be checking with the agency) that this is because I had a pay rise about 10 weeks ago, but because the average has been taken from the last 12 weeks it is bringing the rate down). My agency calculates leave at 2.33 days per month = 28 days per year. I have to take Bank Holidays from this allowance also, giving me 20 days 'free choice' holiday per year (although only 19 free days this year as an extra bank holiday!)

I have been harangued by Carter Forbes sending me texts and calling me for several weeks now, threatening doorstep visits etc. I sent the doorstep letter three weeks ago; it was ignored and I received more threats. I have since reported them to the OFT etc., and on Friday last week sent a VERY strongly worded letter to this effect, reiterating my 'in writing only' stance. Today I have had a text asking me to 'close my overdue account by paying only the capital plus one months (sic) interest' Since this all, I assume, refers to a Capital Finance One payday loan for which I have already paid back the capital plus several month's interest, I intend to pay no more. Should I now SAR Capital Finance One and get this sorted once and for all, or should I ignore?
  4. She's not a 'girl'. She's a 21 year old woman. Which makes the Credit Union's behaviour in speaking to her family about personal business matters even more shocking. It sounds like they've treated her like a silly child who can't deal with her own financial matters, instead of an adult.   5. Hi All I have been getting several texts and phone calls per day to my home, work and mobile phones from Gothia / Red Castle - they call from 01903 222405 and never leave a voicemail message. They're calling at all hours, including 8am on Saturday morning and as late as 8.50pm at night. I don't answer the phone, although my husband has answered the home phone a couple of times when I've been out, and they have left a message with him saying they are Red Castle wishing to speak to me about a personal matter. I have sent the telephone harrassement letter but they are still calling. How long should I leave it before I complain about them disregarding it? Thanks

  7. Yup. I've had two like that - one says 'CALL your WORK' and one says CALL AT your WORK'. I know very little about the law but even I know that's somewhat naughty!

  10. Today's version of MT Collect's threat-o-text has just arrived from 'Collector' stating: (NAME) I Am Due To Call At Your Work NOW! Please call Nick Richards on 0161 738 1204 to make a payment today (Case ID no xxxx) Another complaint going from me to the OFT etc. Obviously I shall ignore but this really is approaching criminal levels of harassement to threaten people with workplace visits.
  11. So, three phone calls this morning from 0203 195 1181 (no message left) and a text from REMOVAL just now in which an Ian Davies tells me he's due to call at my address today, and asking me to call an 0161 738 1203 to make a token payment. Keen, aren't they?

  13. Hmmm... have just double checked the letter and that's definitely it - E11 9EG. Wikipedia tells me E11 is Leytonstone district: Leytonstone, Wanstead, Aldersbrook (part), Snaresbrook, Cann Hall but I don't know anywhere to look up the second half of the postcode apart from Google maps etc and I can't find it either. So yeah, it's a fake postcode.
  14. No. Under their logo it says 'Collection, investigation, mititgation, trace, bailiff recovery, asset recovery. (surely they shouldn't be claiming to be bailiffs?)

So, after several weeks of increasingly threatening texts from MT Collect (similar to those received by many people on this site) I have today had a letter from MT Collect telling me they 'have no choice but to commence court action' for a sum alledgely owed of just over £200. The original loan (Cap Fin One) was just £150 about three years ago, and until I saw sense and stopped paying them, I had paid back around £400, so they're not getting another £200. Do I CCA MT Collect? Or send them a SAR for details of the principal and all sums paid? Or should I just ignore them and add this letter to my already-open complaint about MT with the OFT?
  17. Although you should absolutely carry on pursuing them for the P45, your temp agency should be able to provide you with a P46 in the interim.

Spots1 the letter I sent was the standard one from here which I adapted slightly and yes, does mention the tort of trespass: I note from the card left through my door today that you have visited with the aim of speaking to me urgently about the above account number. Please be advised that I do not hold an account with you, and I have no wish to speak with anyone from your company or any company you claim to represent either in person or by telephone. Correspondence will be entered into IN WRITING ONLY. Furthermore, should it be your intention to arrange any further visits to my address, please be advised that under OFT rules, you can ONLY visit me at my home if you make an appointment and I have no wish to make such an appointment with you. There is only an implied license under English Common Law for people to be able to visit me on my property without express permission; the postman and people asking for directions etc (Armstrong v Sheppard & Short Ltd [1959] 2 QB 384. per Lord Evershed M.R.). Therefore take note that I revoke license under Common Law for you, or your representatives to visit me at my property and, if you do so, you will be liable to damages for a tort of trespass and action will be taken. To be clear, ANY action by a representative of Resolvecall to approach my home, to ring the doorbell or knock the door, to attempt to gain access or sight into my home though windows, to loiter outside or near to my home or sit in a vehicle outside or near my home, or to attempt to speak to me or to those with whom I share my home in my home or in the street WILL RESULT IN POLICE BEING CALLED AND A REPORT OF HARASSMENT MADE AGAINST YOU. This letter is sent by Recorded Delivery.

  21. I've just arrived home and there is another card in an envelope with my name on - obviously hand-delivered - stating this is the 2nd!!! (sic) time they have called. Clearly they have ignored my letter as above. What on earth do I do now? I CANNOT carry on ignoring these people as advised above if they are going to keep calling at my house and leaving cards which anyone in the household could see, but clearly they are going to disregard the doorstep letter if I send it again. Help!

  23. Yes, I'm certain they visited because the card was delivered in an envelope with only my name written on it, i.e. someone had turned up and pushed it through the letterbox. No address, so cannot have come by post. I have reported them to both my local branch and their local branch of TS today.
