Hi everyone In the last month HMRC have twice sent cheques for income tax repayments through the post to me, both for an identical amount and for the same year that, as it turns out, I have in fact already declared through online self-assessment and already received repayment for direct to my bank account quite a while ago! One of these cheques is already in the mail to the bank before I realised it is a repeat, and upon querying with HMRC they have said yes it is a mistake please destroy it. Since then another has arrived through the post! Does anyone know where I stand on this, as one of the attached letters does say quite clearly that if a person underpays tax through no fault of their own because they did declare their earnings accurately then it is HMRC's problem, not the taxpayer? Thanks for your help!

  3. To avoid months of arguing... But you do have a good point. People seem to be having pretty long struggles with MBNA, wanted to avoid trying to get defaults removed etc. as they pop up over the course of the argument, would be nice to clear it up quickly if possible.

  6. ...In fact that's quite interesting. A long long time ago I reclaimed my charges from First Direct. Out of all the accounts I claimed for, FD were by far the quickest (after one letter) to repay the charges. However, when I complained some months later that they'd charged me again over a small overdraft breach, they closed my account and demanded repayment of my overdraft, as, they reasoned, 2 complaints constitutes a 'break down of trust'!
  7. Hi All Wonder if any of you can speak from experience: I am thinking about claiming my charges back from a Lloyds current account, but currently have a £1500 overdraft. Was wondering if anyone who has challenged Lloyds in the past ended up having their account closed due to break down in trust (or whatever excuse) and ended up with a hefty overdraft to pay off? Was just wondering whether I should wait until my balance is clear before pursuing them. Thanks loads for your help!

  13. Hi All I recently received the same reprinted 'true copy' type agreements from 2 Halifax CCs that everyone seems to be getting back. I am as a result, about to start asking under CPR instead, to ascertain whether they have the originals or not. I was just wondering, seeing as they have technically complied with the CCA, do I need to still be making my minimum payments, or can I argue that they're in default? I'd rather not end up amassing a load of charges and hassle, only to find out at the end of it that they did have an enforceable agreement. Does carrying on making payments affect the case in any way if it was to end up being disputed? Thanks loads for your help!
  14. Hi Everyone Decided not to put this in the student section as you guys seem to have the Natwest knowledge! A few years ago when I was an undergraduate, I had a Natwest student account with a £1500 interest free overdraft. In the middle of my degree I took a year out in which I didn't use my account at all. After about 9 months I received a call asking me why the account wasn't in use and I explained the situation. The lady said no problem, just pay a tenner in and take it out again so that the account registers some activity. Me being a lazy student didn't bother because a) i was lazy, and b) the woman didn't say anything drastic would happen if i ignored it. A month later I received a call from a debt recovery firm (I assume it was an inhouse Natwest branch) asking me how I was paying my overdraft back. It was only a week later they bothered sending me a letter telling me what had happened and that my account had been defaulted. I paid the interest free overdraft back in installments, paying interest and a default charge. This hadn't even crossed my mind until I read some of the stories on here today and realised that maybe Natwest had no right to do this. Has anyone had any similar experiences with student accounts? Would be interesting to find out if they often default accounts over underuse without any warning of the consequences!
