I asked what would be listed on the CRB, because I actually thought that it was commonly known as Benefit Fraud but would be listed down as a failure to notify as that was what was stated in court. So therefore that must be the legal term used for this particular offence. The summons I received stated this: Alleged Offence: That on or about 19 September 2006 you, BritishGirl, with a view to obtaining benefit or other payment or advantage under the relevant social security legislation for yourself, namely Housing Benefit and Council Tax Benefit, failed to promptly notify the London Borough of _________ of a change in your circumstances which you knew affected your entitlement to the said benefits, namely that you received student loan payment of £_____ CONTRARY TO: Section 112(1A) Social Security Administration Act 1992.
  2. Thanks for all the responses, I was not aware that I could get some assistance from the DWP so I will look into that. I wasn't arrested, I was interviewed under caution & then sent a letter stating that they planned on taking me to court. I just appeared in court & plead guilty & was sentenced. I'm guessing each case is dealt with differently. I thought it would appear as fraud & not the Social Security Act that was stated in court. I plan & hope to work in the community with young people &/or people with mental health problems, that is why I know that all the jobs that I am now interested in require that I declare my convictions & complete a CRB application. I'm trying to apply for positions at the moment. I would love to do some voluntary work but can't afford to do so, I'm just so desperate to right my wrongs & contribute positively to society but I'm so worried that I will not be given the opportunity because of my past transgressions.
  3. Hello, Thank you for taking the time to read this post. Last year I plead guilty for failure to declare a change of circumstances with regards to housing benefit & council tax benefit. I was claiming Incapacity benefit & I was also a student but didn't declare that I was a student. The overpayment was £3500 & I was ordered to complete 100 hours community service. The overpayment took place 2006/2007 & at the time I had just moved from a hostel to my own apartment & was suffering with mental health problems & was struggling with managing my finances. I am in no way excusing my actions but just trying to give some background regarding the circumstances as to why this took place. When I eventually went to court March 2008, I had been working for 6 months at the time & did not declare to my employer that I had just been convicted. I now no longer work there & I did not tell my employer of what took place. I do regret that now as I feel that would of been the best thing to do. I felt so ashamed at the time & was struggling to come to terms with it all myself. >>>I would like to know if there is a lawful requirement to inform your employer if any convictions you gain whilst employed? >>>Does anybody know how a housing benefit conviction appears on a CRB? >>>I would love to work in the community & does this conviction now mean that this will no longer be a reality? >>>What can I now do to increase my opportunities & to show a potential employer that this is a mistake I would like to put behind me & that I have changed? >>>How should I list the conviction on an application?
