  1. Hi, Thanks for the replies. When we do the probate I think we have to state it he had life insurance. Do you think the creditors will find out about this? Thanks!
  2. Hi, Thanks for your reply. I am planning on paying off the majority of my mortgage with the insurance money. If I do this will they have to accept the 10% or can they demand that I don't pay so much off my mortgage so I can afford to pay them? Also, how will they know I have the life insurance money!? Can j just say I don't have much money to pay the debt? Thanks
  3. Thanks for all the replies If I do have to pay the debt (which I suspect I will) can I try to offer them a lump sum rather than the total outstanding amount?

  5. Hi, We jointly own the house but he did not have a will. All the debt is solely in his name. We did have life insurance so I know I will be responsible for the debt. Thank you for your kind words xx
  6. Hi everyone, Sadly, my dear fiance passed away last week. We shared a house togeter so I know that I will be responsible for paying any outstanding debts. My question is, can I call the CC & loan companies and offer them a settlement or do I have to pay the full outstanding amount? If I can offer them a settlement, what percentage should I offer? Many thanks.

  10. Hi, Just an update: 1st Credit just called me to ask for the 50% payment. I told them that I am requesting teh CCA and I am in the process of contacting my CAB. They told me that the agreement is now viod and it will be passed to the legal team. They said that they can ask me to sell my house if that's what it takes to recover the debt:eek: I will now apparantly be expected to pay the balance in full.
  11. The information there was based on the CCA being unenforceable
  12. It has been passed on to a debt collecter and they have said it will go to court if we don't pay. I am not sure that this qualifies as defualt?
  13. Hi everyone. Ok so my CC debt with Abbey (Santander) has been passed onto 1st Credit debt collectors. The OS balance is £8500 and they have asked me to pay this within 7 days. I of course can not do this and they have agreed to discount the total to £6800. I have to pay this by the end of November. I did offer to pay them half but they said that Santander will accept no less than 80% of the debt. Is this a good deal? Do you think there is anything else I can do about this? They have threatened to send baliffs round and I said I know that I don't have to let them i
