  4. Help needed PLEASE Can a debt collection agency from England enforce an English debt in Scotland. I moved from England to Scotland owing in the region of £40,000 from credit cards and bank loans. theses were all getting paid when I was working but due to ill health they haven't been for two years. I am now in receipt of ESA & DLA I cant work any more now im being slowly been chased for debt which i left behind, maybe it was wrong but I was pestered so much it was making me ill and putting a strain on my marriage. T wrote to all creditors when in England but got no joy from them, did all the CCA letters etc etc. so i left and moved to Scotland where i have been happy and been stress free for two years until now........ 1. What I need to know can they enforce this debt 2. If I was to go down the LILA route would my car be taken from me valued at around £3000, I live in a rural area of Scotland and need my car for hospital appointments I have a limited mobility and not able to walk without severe pain,if this was taken from me I would be virtually tired down to my home. Thanks for all help given
  5. After a couple of years employment, it's a bit weird this has suddenly become an issue. It may be as simple as someone in management at the Nursery has gone on a child protection course and completely misunderstood what they've been told about disclosure.
  6. Hi Lessbos, Criminal Records as far as is I am aware no never heard of that before, what i do know is you have to give the name D.O.B's of your family members you live with if you are wanting to join Her Majesty's Force's or the Police. Hope this is of any help...........
  7. entirely up to you jjp35 what you want to do, from experience this happened to me different circumstance Employment tribunal I accepted the offer just means you can NOT talk to anyone on how much you got and what ever else they give you..... if you did and they found out you would be in-contempt of the Tomlin Order set out by the court.. Don't know what the consequence would be though. A Tomlin order is a court order in the English civil justice system under which a court action is stayed, on terms which have been agreed in advance between the parties and which are included in a schedule to the order. As such, it is a form of consent order. The order permits either party to apply to court to enforce the terms of the order, avoiding the need to start fresh proceedings. The terms of the schedule do not form part of the court order, so may remain confidential, and can include matters outside the jurisdiction of the court or the scope of the case in hand.
  8. What I would be thinking of doing and this is my OP would be contacting the first three in your list and asking them for a F&F Settlement figure, and mention to them that you are struggling with paying you debts and it would be in there best intrest to come up with a relastice figure i.e. half what you owe
  9. This is one for the Site team Guy's or any Legal buffs on CAG, what would be the legal implication be if I were to start a Blog or a Group forum on Yahoo groups Naming and Shaming DCA with other people who have had bad experiences with these companies.

  11. Health and safety executive site all the info is here http://www.hse.gov.uk/gas/domestic/faqlandlord.htm Gas safety - landlords and letting agents As a landlord, you are responsible for the safety of your tenants. The Gas Safety (Installation and Use) Regulations 1998 deal with landlords’ duties to make sure gas appliances, fittings and flues provided for tenants are safe. You are responsible for the maintenance and repair of flues, appliances and pipework which you own and have provided for your tenants use by a Gas Safe registered [3] engineer . Although there is no prescribed timeframe for these duties, good practice would be the demonstration of regular, annual maintenance checks and subsequent repairs. You are also responsible for ensuring an annual gas safety check is carried out within 12 months of the installation of a new appliance or flue which you provide and annually thereafter by a Gas Safe Registered engineer. You must keep a record of the safety check for 2 years and issue a copy to each existing tenant within 28 days of the check being completed and issue a copy to any new tenants before they move in.
