My guess is "Oh Boy" is just a 1st Credit ringer/agent as he/she hasn't replied since posting the original thread. No substantiation of the really nasty letter - a really weak attempt from a company trying to scare CAGers. They're on the run and the more we keep preaching the word and fighting these muppets the less likely people will be threatened by such dross. What makes 1st Credit think that another "solicitor/DCA" can change the CCA laws? Quite ridiculous and shows just how desperate this bunch are. Bring it on I say. Once the account is in default it remains in default. Simple. Let them run up more cost.

I can't believe the nerve of these muppets. This is clearly a mockup and not a particularly good one. I've got an Egg agreement from about this time and have never seen one with two lots of Egg logos athe top and overlaid information at the bottom (not straight either). The prescribed terms are missing and I bet there are no cancellation rights. This is not enforceable but I'd go for them big time for forging documents - might be worth a call to the police along with the OFT and FSA. Please don't let this opportunity pass to bury these clowns.

Hi I've just received a virtually identical MSDW application form from B/C A3 document to ThereIsAnotherWay and section 4 is also blanked out. No prescribed terms and "application form" is referred to several times throughout the document. The "terms attached are also identical and the first document doesn't reference this subset of the T&Cs. Totally unenforceable and makes you wonder what B/C is trying to hide. -

The second A3 page has "Financial & Related Conditions" which are a basically a subset of the terms & conditions which were not sent and not referred to in the application form. They refer to section 16 in the main document but it is nowhere to be found on the second page. At no point does any of the information on the 1st page refer to the conditions on the second page. Totally unenforceable and makes you wonder what B/C is trying to hide. -
Egg/arc Reply To My Cca - Advice Needed

First post - great website and so far has helped save me considerable heartache with the DCAs - particularly 1st Crudite and NCO. One question for the experts - my Egg cards are unenforceable as per the several postings including this one but can you claim back PPI as well as make it unenforceable.
