  1. Thanks for the response, I have just got a copy of my credit file, I can see that all the loans that I am dealing with currently have a status of default on them. Is there anything else you want me to provide ? Also when you say deal with the banks directly, which address should I write to ?
  2. Hello everyone I have been able to gather some more money from friends and family, it's now at around 11k, total debts equates to about £36k. 3k is for HSBC credit card which isn't enforceable. I have some questions, I wild love to sort out as much as possible in terms of the debt but not quite sure of how to proceed 1) most of the debts are with DCA and I have lost track of who is managing what, is it sensible to write to them all and make full and final settlements. 2) is it sensible to write to the actual banks 3) I have not used debt management companies like cccs or so, will the banks listen to me if i turn to these debt charities and will the bank take them more seriously if I go through them Thanks

I even took the inconvinience of the van on the chin, I was late, we had to empty the Van and then fill it up again, well I took it like a man and said s*it happens atimes, but the charges thing was that one that hit me hard and I find hard to take ? Should I ring up the CC company and say, well I have not got my money back and they should take the hit as I feel hrd done by taking the hit for something thats clearly not my fault.
  4. Hello All, I took out a Van rental about 2 months ago, In order to avoid disputes etc, I decided to pay with my credit card both the Van fees and also the deposit as well. I was told that the refund takes about 10 days or so to get back to me, almost 2 months after I have not got my money back. when I was paying my credit card bill, I decided not to pay the deposit portion as i thought I would get it back in time, now I opened my statement 2 weeks later and to my horror, I see interest charges and also late payment fees. I was livid and then decided to call them, they just said sorry it was a mistake, but I'm afraid sorry alone isnt good enough as it has cost me money in interest charges and late payment fees. After taking the Van, the dashboard lights were not working and I had to go through the hassle of emptying the van out to get a new one and of course missed appointment too. As I thought driving at night and having to shine a torch at the dashboard to know what speed you are travelling at is too dangerous. Now after calling them, the receptionist said she had just issued refund today and i then said what about my charges as I dont see why I should have to pay that afterall if they had returned my money within the 10 days stipulated, we wouldnt be having such a conversation. I worked it out that if the money was retuned on time, there shouldnt be any interest due from the credit card company etc. Now I was spoken to in such a rude way, and even though I was the victim I was spoken to like as if I was a fraudster, after I said late payment fees cost 7 quid or so and the interest a tiny bit more than that. They insisted that they wouldnt be paying it, and now I wonder whether I ought to report to the credit card company as fraud as in the end the manager said he would only be paying interest portion and not late payment, I said I can show them the statement to prove it, he made it like i was lying and that I was desperate for the money. I dont like the way i was spoken to, and I want to know if I can report to the CC company, and claim off them and they can then sort it out with the Van hire company as clearly I dont deserve such a mess, especially if its not my mistake and no written apology etc. Any advice welcome.

Just a quick question everyone, I got a letter from Nelson offering me 50% off a Lloyds loan, the problem is that I want to sort out all the debt, as I have secured some money from family however, I noticed that the loan balance has increased by £1k since about a year ago, I dont know where the £1k came from but they have added it to the loan. I'm looking for a letter template to say I dont know if they got thier sums right, but I need to understand how they arrived at thier figure which is abount £1k over. My calculations in terms of an offer equates to 25% of the loan, which is a take it or leave it offer. Thanks.
  6. Hi Guys I have visited the website, and as I suspected I'm not really entitled to any benefits being that I have a property which is being let out. This will obviously count as income. On the other hand, I just received a letter from JB solicitors or so, they have included a I&E form which I will not fill in, instead I will write to them that my offer is all I have and if they are in doubt, they can take me to court and I can prove to a judge if it comes to that. Does anyone have a template of a letter that I can easily use ? Thanks in advance.

Well the thing is that I dont think that I'm entitled to any benefits, the nature of the work I do is such that its not fixed, and its also temporary job as well, so there isnt any guarantee on income etc. The P60 mentioned is the one that I have received, and there may be another one for similar amount, but again not much. I dont have the P60 yet though. So should I wait for it or just send them this one ?

Just a new development guys, within my last efforts to pay off the debts that I own, i.e ones with good CCA, I wrote to creditors who chased the debt offering a compromise in form of a F&F offer, now one of them has written back saying they are willing to consider, but they would want to see proof of my situation P60, wage slips etc. Now I am a little worried, although I have nothing to hide in showing them the P60 as the income is only about £7k for a year. what i fear is that they start calling my place of work, or have a earning attachment order against me, as they can use the info given to them against me. How can I play the game with these people, I do want to sort out my debt problems, but the lenders are not helpful, my situation is, pay nothing or accept reduced F&F as I cannot maintain any regular monthly payments right now. Any ideas

I just got a letter today from Horwich Farrelly today which was relating to a letter that I sent to them with a full and final offer, now they have asked me for the amount that i'm able to raise, where the funds are coming from, a full breakdown of I&E, a breakdown of creditors, when the funds are available. I also got a letter from JB Debt recovery, its regarding the HSBC debt which doesnt have a CCA and I will just fob them off by asking for the CCA. Any advice.

Ahh thats a very good tip that you have provided there, I just read up the meaning of statute barred, so if they dont ask does that count as part of the clock, I admit that making offers on some of these loans may be counter productive. I was just looking for a way out. I will write the remaining of the companies and not post any more offers, I will ask for CCA instead and see what they come back with.
  11. Why is the credit file very important, is this just to check what damage has been done or just to see the history. One other thing is the fact that over the years, I have had to live at different addresses often squatting with family members and these debts often have different address history as they accumulated over time. Is it better to call them up and change is to my current stable address now ? Secondly, you mentioned that you will go straigth to court in your last paragraph, what will you do in court ? Thanks.
  12. Thanks Baz for the post. I really don't know myself, I have not got a recent copy of my credit file so I wouldn't know. When all these problems started in 2009, till date there isn't any one settled account. Some of the lenders i.e Halifax are happy to accept £1 token feel for almost 2 yrs now despite the fact that I have made offers. I wonder if its because of the fact that BM solutions is also my mortgage lender as well, and they know that they can always put a charge on the flat. Although no one has mentioned anything yet about the property. I mean even the bank account with 2k on it, an offer of around £450 to settle, I have not heard anything back. Out of all creditors that I had their CCA checked, only HSBC credit card doesn't have an enforceable CCA, they are the closest that have offered to knock off 50% out of the 3.5k balance or so, which I rejected outright. Not sure where to turn, I feel the chain of these debts is getting to me now, although there hasn't been any court visits/cases till date as I have always written back to the DCA's. None of my debts are with the actual banks anymore at this stage, all with one DCA or some random solicitor..
  13. Hi All, Just a quick update, for the last 11 months or so. I have been getting the odd letters here and there and still keep writing thesame letter to creditors about offers, typically around 25% of the debt shared on a pro-rata basis. Till date, noone has accepted any of the offers, I have had donations from family totalling almost £9k, and instead of paying off 1 or 2 creditors, If they all cannot accept the offer then it doesnt make sense to pay anyone. As I dont want to be in a situation where 3 loans etc are paid off and there are 3 remaining, but all the money in the pot has gone on paying the previous 3. Recently, I had letters from Robinson Way via Horwich Farrelly, about a debt of around £6k, I have sent them an offer and wait on thier reply. I recently got another letter from GBP solicitors on another debt of around £2k. I am going to write another letter to them telling them of the offer on the table and whether they had accept it or not. Any advice here. Thanks in advance.

Hi All, This is becoming quite distressing now, for the last 6 of a repeat offender has been using fictitious names including my surname when giving his/her details to fare inspectors, so we have been receiving letters from TFL/Collectors on the fine etc. Is there anything we can do, as this has happened 4 times now in the last 6 months, even if they can take a picture of the offender that would be really ideal as this is becoming quite ridiculous. Any advice would be appreciated.
  15. I just had some few letters in but dont quite know what to do. Got a letter from SRJ debt with a letter headed paper from TDX group, its titled settlement referral form. it states the total amount owed and also my offer of settlement as well. Who are TDX group and what do they do ? Do I have to fill in the form which looks like an income/expenditure form.
  16. The situation is that they didn't accept that they don't have the right documents, I pointed it out to them over the course of the last 18 months, and out of nowhere 50% discount come in. On this basis I believe they admit to not having the right documents even though it's not in writing. As per lloyds, I'm 61 at the moment and the thought of having a debt hanging over my head is mind blowing, that's the reason for the f&f to try and settle, if I offer monthly it means I am still battling it till over 75. That's the reason why family have agreed to fund f&f but not monthly payments. Thanks
  17. I had a letter from one of HSBC's DCA's, they are now offering 50% discount because they know they don't have a CCA. Can I reduce this to 20% as I think thats what I originally offered. Also the other creditors i.e Lloyds they rejected my f&f offer and saying they would be taking the matter to court.

I have just received a letter from Metropolitan which is one of the DCA for HSBC, they have offered 50% discount for a credit card debt without proper agreement, I think i offered 20% as full and final. Also, I got a letter from Parkgate investigation bureau saying my case which is with Lloyds will be passed on to them, I offered them a F&F but they insisted that they had only offer 25% discount. Letter from call serve as well advising on same debt. Other creditors have indicated that they will not accept F&F offers, at same time I cannot setup a DCA with them as the funding for the F&F offers is from family members, they will not fund a DCA.

Hi All, I have just received the following letters Debt managers ltd: This is regarding credit card debt owed to lloyds TSB, they do have an enforceable agreement but I cannot afford what they are asking me to pay, they are not accepting FF either. I dont want to be on a DMP for 10 yrs. they are saying settlement is required now, court action may be taken and costs added. Credit security ltd: This is regarding a current account with oustanding balance, again a 25% settlement was rejected. I cannot afford to be on a long DMP as i am approaching retirement. Debt managers: A court action letter stating that they are prepared to pass account to solicitors unless i get in touch within 7 days/pay in full etc.

I just got another letter today from Moorcroft regarding HSBC loan, the title states discount offer and I should call to finalise, obviously I will not call them, I will make everything in writing. I want to know whether its wise to send them a budget sheet for full and final offers, it shows total amount available and how the money has been shared to all creditors on a pro rata basis. Is it also wise to have creditor name on it and amount?

I just found out that the total secured debt on the property is around £128,000 and the property is worth roughly between 150,000 - 160,000, the housing market is a bit sluggish at the moment which everyone knows. The lender would only release extra funds up to 80% LTV max. This means that I cannot raise extra capital from the lender, selling the property is also tricky as I do not know how long its going to take to sell it, there is also a section 20 pending at the moment with roughly around another 5,000 in costs. Any ideas ?
  22. Thanks for the reply, we will like to be given options about what is involved in retaining the property or loosing it, so that we can make an informed decision. if its possible to retain the property then yes but at this stage we don't mind if the property is lost. Thanks.

  24. Thanks all, I will explain the situation in as much detail as possible. This is concerning a family member who cannot use a computer and hence the reason why I am here asking the question. The summary is as follows: Unsecured loans ========== HSBC Credit card: No legitimate CCA provided, offered 30% discount recently.no CCJ, roughly about £3,500 Loan: CCA provided. with DCA at the moment. Default notice served. no CCJ roughly about £5,000 Lloyds Credit card: CCA legitimate, with DCA, defaults served, no CCJ, around £5,200 Loan1: around £2,500 left for this loan, CCA legitimate, with DCA. defaults served Loan2: around £6,500 left for this loan, CCA legitimate, with DCA. defaults served Halifax Loan: legitimate CCA, £1 being paid at the moment for the time being. halifax agreed to this. balance around £5,200 notice and defaults served. no CCJ Credit card: around £3,000 balance Secured debts: =========== I own a flat bought in 2005 for £135,000 where i used to live, but since my financial situation got worse. I had to rent it out. debt on it I reckon would be about £125,000 roughly. I'm not 100% sure but just there about. I then secured another further advance loan of £20,000 3 years ago, which I currently pay on a monthly basis. I think the balance is roughly about £15,000 again I'm not 100% sure. Now the property itself with the current downturn, I reckon would be worth around £150,000 - £160,000, it has a tenant in it leased out on a long term lease. The mortgage right now is on a variable rate, the mortgage and further advance is taking up about £450 a month at the moment, rent is £800 a month. I have service charge arrears and there is a section 20 bill for the roof for around £5,000 which I have not even thought about right now. Situation with debts ============ My family have offered to lend me about £7,000 on the condition that I use the money to clear off all debts, but its becoming so difficult to offer a full an final settlement that is acceptable to all creditors. They just are not having none of it, nobody has accepted any of my offers. I worked out all the debt on a pro rata basis on the calculation that i had £7,000 in the pot, so it worked out that all creditors will receive roughly 20%, typically most creditors are wanting 70-80% of the debt. Other information =========== I currently rent out a room at the moment, all the debts mentioned above have been taken out whilst squatting with various people at different stages. Now, I do not mind if i loose the house, all emotions have now been erased and I feel bankruptcy would be my easiest solution out. I'm 61 at the moment and want to stop working in the next year. Also, my income is not stable, I effectively work for an agency, so its when they have work. I also have a daughter who depends on me. Any help/advice will be greatly appreciate.
