Thanks UK, was well chuffed Got a letter this morning saying cheque will arrive in approx 14 days, they don't admit liability etc etc they also say that the refunds are made purely as a gesture of goodwill and they will now defend the claim on the basis that they have refunded the full claimed amount. They say i should contact the court and cancel the claim and they have written to the court to say they've settled..........will only cancel court case when chq has cleared lol still can't believe it lol Thanks again everyone, once cheque has cleared will sort out the donation.   2. sorry, missed a bit Forgot to say, i got full interest at 29.9% (that restitution thing, sorry steven, still confused over that bit ) and 8%. Amazing, still smiling, although won't jump around the house until the cheque has cleared! Thanks again Lana

I think I've won guys lol won't shout too loud at the mo but just logged into my CrapOne account and is shows a credit balance of the payment just made, my full credit limit available and a cheque refund issued 10.7.08. Apparently this should arrive within 7 days. I'm so excited, this is class, only filed at court 30th June, didn't think they'd pay pmsl Just want to say thanks again everyone for all your help Really appreciate it Lana :D:D:D:D

Well, knew it was too good to be true, CrapOne filed an acknowledgement of service on 8th July, notice says they have 28 days to file a defence, guessed this would happen after reading all other claims and stuff on here. Knowing my luck this one will probably go all the way to court, have read loads today and not many i've read seem to end up in front of the judge so keeping fingers crossed. Again, will keep you all posted should something happen

  10. sorry guys, don't know what happened to the rest of my message, must be cos it was early Anyway, I've used the standard POC, and wondered how I would word the little bit about the 'restitution interest steven mentioned a few messages ago', do I use some of the wording mentioned in his interest tutorial?   12. little behind schedule.....again lol LBA 14 days were up, have just been filling in N1 ready to post and got a letter from crap one saying 'our final offer is 80, we won't be paying anymore, accept it and go away' No chance. N1 on its way to the court at the weekend unless of course i'm too late .....again catch you later on guys Lana

  14. Well guys, 14 days were up today and finally received a reply from CrapOne, offering me £80, the difference between the 20 and 12 quid charges, sending a complaint settlement form. LBA prepared and will be posted, £80, laughable, haven't stopped laughing since i read their reply. LBA to be posted today
  15. Thanks for that Steven, Have had a read today and make more sense of it. I wasn't going to add any interest on the charges before adding the restitution interest but i'm going to now. Have just typed up the letters after reading your Goldfish thread again and have added one of your paragraphs (hope you don't mind) so hopefully I won't get a letter from them asking me to explain it, otherwise will be shouting for help again lol Hope this works Thanks again

Thanks to you both for that, am so confused when it comes to this interest thing All i've done is used Steven's spreadsheet that works out the interest at 29.9% and then on another sheet added on the 8% for the court cos knowing my luck it will go that far......it looks amazing as one charge back from Nov 2003 is worth just under £87.....that'll do me lol Just might need a little help when they try to confuse me with interest twaddle in their letters rofl Anyway, thanks again Lana:D

  20. Sorry Steven, one more question On your spreadsheet the interest shows at 29.9%APR, the interest rate on my card currently shows 30.34% so should I leave your figure as it is? Thanks again Lana

Thanks for that Steven, I got down to the bottom bit about claiming interest and then my brain turned to mush lol So, If I understand this right, I can submit LBA for charges + huge interest then if I get no response submit claim for charges + huge interest + 8% interest + court costs? If the latter is correct, do I add the 8% on each charge + interest on the spreadsheet so for example my first charge is a late payment fee of 20 in november 03 so would that be: 20.00 + int of 44.10 = 64.10 is this what I add the 8% to, if so, the 8% interest would be 22.89 so that would mean this charge would turn into 86.99? Now see why i'm confused lol Sorry to be a pain
  22. Hi everyone, Its been a while but have finally got round to going after CapOne again with one thing and another it got pushed to the back burner. Have finally received my statements and I was wondering if I go after the interest they've charged me aswell (spreadsheet to calculate from Steven4064's signature), the interest on the charges isn't the 8% court interest. The question is, do I add this interest to the claim (which doubles the whole amount) or do I just leave it and go for the 8% at court stage, am so confused, can someone help please Thanks guys Lana

  25. Hi guys, me again Its been some while since I had any communication from Cabot since my last angry gram. Received the usual, sorry you found the need to complain etc but they did send me the complaints procedure within the specified time. The last letter i had from them is quite confusing and, seeing as i'm out of my depth with CCA and stuff wondered if any of you nice people could help seeing as I requested the CCA back in June 07 and am still waiting. Their reply goes like this...... I refer to your letter which was received in our office on 28 September 2007. I regret that you have felt cause to complain to Cabot Financial (Europe) Limited and apologise for any inconvenience that you may have suffered in relation to this matter. I understand that your complaint relates to a request you have made for a copy of your credit agreement and statements with Creation, the original lender. We have previously supplied you with an interim response dated 28th September, 12 October and 24 October (which basically states they havn't supplied the credit agreement but bear with them) and shall set out our final position in relation to this matter below. The Cabot Financial Group purchased your debt fromCreation on or about 6 August 2004. In your email dated 28 September you make reference to your letter dated 14 June 07 in which you state that you are entitled under sections 77-78 of the Consumer Credit Act 1974 to a copy of the credit agreement that you signed with Creation. Although Cabot does not have an obligation under section 77 and/or 78 of the Consumer Credit Act 1974 to supply this information, Cabot will assist the original leder and customers in providing this information. We have made several urgent requests to Creation to forward any documentation relating to your account to us. Unfortunately, Cabot has not received documentation due to a delay in retrieving this information from their archives. We shall, however, continue to pursue this information and on receipt of the requested documentation, shall forward to you accordingly. Please be advised, that the failure to provide a copy of your agreement in time does not affect the legality of your debt with Cabot Financial Group but merely renders the credit agreement unenforceable until such time the agreement can be produced. As aforementioned, Cabot does not have a duty to provide this information and therefore section 78 of the Consumer Credit Act does not apply to us. As a gesture of goodwill, Cabot has and shall cease any collection activity until such time the credit agreement is supplied to you. I trust I have se tout our position clearly, However, if you remain dissatisfied with our final response, you may bring the complaint to the attention of the Financial Ombudsman Service, within 6 months of this letter, who may investigate the same. Please find enclosed a leaflet from the FO. If you have any further queries please contact on....... Right guys, i've never admitted any debt as mentioned before, the agreement if its what I think it is, is well over 6yrs so can anyone advise what I do next. Do I just ignore this and write it off and complain, any ideas? Thanks Lana ;-)
