Hi all, Thank you for all your help so far I came back from holiday to a letter from the court dated 24th November confirming what I had filed on MCOL and advising the debt collector/solicitor had 28 days to respond and if they did not the claim would be stayed. I then received another letter from the solicitors dated 4th December advising they still wished to continue with their claim and would be moving it to my local court. Just to highlight I have still not received a copy of the CCA or CPR so both are now well overdue. To date I've heard nothing

  3. Just logged into MCOL and all it states is A claim was issued against you on 20/10/2014 Your acknowledgment of service was submitted on 07/11/2014 at 17:59:57 Your acknowledgment of service was received on 10/11/2014 at 01:00:39
  4. Ok so just gone over some threads. Can I check I have my dates correct: Date of issue 20.10.2014 + 19 days ( 5 day for service + 14 days to acknowledge) = 08.11.2014 + 14 days to submit defence = 22.11.2014 (33 days in total). The 22nd is Saturday so can I file the defence then or should it be tomorrow as I filed my acknowledgement at around 5pm on the 7th.   5. Hi, I have received the attached from a different company regarding the CCA request. I've had no reponse from the solicitors regarding the CPR request and the 7 days was up yesterday. I also need to file my defence on Friday and have little to defend with right now...

  9. That CPR states "Although your claim is for a sum which is not morethan £10,000.00 and will in all likelihood be allocated to the smallclaims" the claim is for over £13k

  11. Oh no I forgot to send AK a CCA requistion and the solicitors a CPR, sorry not sure what the CPR is. If I do it tomorrow and they receive Tuesday will I be ok? I'm just thinking the CCA request gives them 28 days to reply. I need to file defence by 22.11.2014. Is there any possibility of asking for extensions to this? The solicitors is Judge & Priestley. I'm also going on holiday on 25th November

  16. Hi all, I hope you can help I wasn't working for a period of time back in 2009 contacted MBNA to ask if I could reduce payments, as expected their response was no. I had no money to pay so stopped paying. Over the next five years I had a few threat letters from different collection companies but they would stop and then sell to someone else.   17. Sorry for not coming back sooner I didn't get the update notification. Thank you very much for this information So having read this it seems CAI have presented enough evidence to the court in order to obtain the petition. The thing is we know this to be false because my friend hasn't been living there and has therefore received nothing Can anyone advise on next steps? Should he contact CAI?
  18. Thank you for your reply No he's received nothing because he hasn't lived in the property for around two months and the postbox on the house was also nailed shut. I'm not really sure where we go from here. I'm assuming if he doesn't turn up in court they will declare him bankrupt by default?
  19. Hi all, My friend has recently had his home repossesed and the sale went through two weeks ago. Another friend saw an ad in the paper that CAI Finance have now applied to make my friend bankrupt and citing the address of the property that was repossesed. The only debt other than Inland Revenue is for a Halifax credit card he stopped paying around a year ago. He believes there is around £3k on this Can he be made involuntarily bankrupt for an unsecured debt and for such a small amount? This all seems very coincidental given that he will soon be receiving some money from the

  21. He's also going to CAB tomorrow evening as there are solicitors there who offer free legal advice, I'm going too so I can make sure everything is covered. I'm guessing they may suggest what he should say
