  3. I had the same communication back in 2003. I had 1 business account and 200 quid left on a 3 grand business loan. I just looked through my agreement with that and theres nothing there about closure of account but lots there about them claiming back early the money you owe if there has been any defaults. They normally have to give you notice of their intentions to close your account and details of your rights. Usually by this stage there has been meetings with the business banking manager,letters,withdrawel of your overdraft facilities and requests for return of cheque books. In my case they cancelled all my direct debits,withdrew the overdraft and chequebook. I was carrying out business by using cash for all purchases and payments. But as anyone knows this is very difficult. We had a credit/debit card terminal but this was stopped once our direct debit facility was taken away and a lot of our business was card reliant so it badly affected me. I continued to pay off the loan and I think in the end they just wanted me off their system and sent me the account closure letter. Despite all my protests there was little I could do. They quote their terms and conds that they are entitled to close your account at any time by statutary notice,and demand any payments outstanding this without any reasons. I did look into an offshore account as I know lots of business that are doing that after problems with the big 4 I am now just starting the initial claim over mine so will maybe be interesting !!
  4. I am in the process of preparing to send the dpa first letter to Barclays. I am a little worried tho about the number of letters Barclays are sending out questioning their responsibilities to supply man intervened info I also noted the statements they sent to one of the claimants which were unreadable and Barclays stated they had no legal responsibility to supply them in any particular file type, I am wondering whether their legal guys are trying to address an upsurge in claims now by being erratic in their responses. Some claimants have had differing reponses one has had to file the 4o days again !! I am asking if there is a need to add additional info to the dpa request letter in order to address these hindering methods they are using in replies ??

Well if its the case that they ARENT allowed to climb in through windows then its clearly trespass (If not Burglary ) Under the limitations rules I am sure 3 years is not out of time but it would probably be argued as to why you left it so long to complain Its the damn laws that are so easy to manipulate because of their wording can be used to advantage for some. I used to work in a bar that had topless bar maids. The licensee displayed the posters "if easily offended then dont come inside " Our local council does not like this sort of activity in our town and for 2 years an under cover police operation was mounted. The officers visited every week enjoying the whole thing. After 2 years they mounted a big raid after the bar closed. They told the licensee they were going to prosecute him under the obsenity laws. Some people have complained at what they have seen has offended them they said (these were punters who they threatened to tell their partners they had bee caught in there..........uinless they agreed to make statements ) The licensee said the laws were a fine line and it was easy to use them for the Police to manipulate...........what someone may consider offensive.........may not be to someone else !!! Anyway the licensee was forced to leave the pub and they dropped the case. I was DJ at this bar and asked one copper why it had taken 2 years to stop it. "personally I did not want it stopped he said.......we were getting paid for watching and it was a night out for us too...........but the div commander said we were over budget on the enquiry so had to move for a result " !!
  6. The business was never liquidated I just closed the shop and continued to operate from home. Was not limited but a partnership. The other partner left before this and nothing was ever signed in the first place so there ws nothing to sign then. The account was in my name Trading as / They continued to hound me for a small amount (about 200) which was made up of charges and interest just before they closed the account. This debt I think now sold to a col agency and has risen to about 650. If therefore I am still being asked to pay this back then is it not the case that I too can ask them for mine back ? Correspondence was and still comes to my home address.
  7. Yes the late 60s and early 70s were good. Like a lot of cars the metal was thicker the paintwork better and the engines were good. They were quite competitive then too. The rover 2000 was a classic and the same engines fitted in the Triumphs. Of course cars then had lots of character (not all looking the same as today) Todays cars are all designed on computer and thats why they all look similar as computers will inevitably come up with the same shapes when considering efficiency economy drag factors etc. Its nice to see some of the old rovers on the road British engineering at its best.
  8. Very true The sheer mention of that name balif frightens a lot of people to death. Anyone who has had that experience of being afraid to open a window,and not opening the door to anyone will know the feelings. I had a long period of only using my back door and the neigbours didnt see me for weeks. Its like you shut yourself away. I scoured all the sites on the internet but as much as I found positive info......theres plenty of negative stuff too I think watching the programmes on tv (the balif series) probably spurred lots of people on to get their debts sorted. When you hear them saying Iam only doing my job they expect you to be more understanding. I think it takes a certain type of person to become a balif,one who delights in seeing misery and hardship. I am not talking about scenarios where they are visiting mansions to impound luxury cars..........rather terraced houses where they will even take the kids playstation !!!

I am not in possession of ALL statements so do I send the usual letter asking for these ? as I obviously dont have a figure for the letter asking for refunds Of course with adjustments to the temp letter effecting it as a business ? The account was in my name as a partner so presumably thats ok for Data protection request.

  11. Despite one or two references to it being a different process to personel accounts I cant seem to find much out about the process of claiming back. I has a Barclays business account between 2000 and 2002 and the charges eventually led to the business being ruined. Any links to the info needed to pursue this ?? Ive been looking on here all day !!! Thanks

  13. Think you could get it in writing off them that they would not record a short payment. Dont forget to add the other things up too........ all the coffe/Tea/Lucazade/etc consumed under duress writing the letters petrol and wear and tear of tyres going to the sorting office for the concert tickets The sleepless nights you are gonna have thinking what to do with 4k (has to be worth a few boxes of Nytol) Extra use of Electricity as you sit up watching the TV instead of sleeping ?? All adds up really..........rather like their penalties !!!

My missus DOES drink wine but as its me who will be sorting out all this mess then if their CEO does offer any gestures it will have to be a couple of cans of John Smiths...............though she CAN have the flowers !!! My wife is Russian and very thrifty (as most of em are brought up) She never could understand why the gas fire was on so much,and frequently turned it down. Ive natuarally had to explain all this to her now and she was a little bit upset that it would be taking money from our savings for our next trip to Russia in September.......................   16. About 3 and half years ago I contacted British gas to have the account changed from my ex wifes to my own. She had always dealt with paying this and I was suprised when a bill came for 150.00. I contacted them asking if they could install a prepayment metre and they agreed. Some time later a guy called but after looking at our existing one said he needed additional fittings so could not do it he said he would be back. 6 months later after hearing nothing a meter reader came after looking at our meter he said it was not the 1 he had logged on his sheet.........you are down here as having a card meter he said. We asked him if he could sort it out and heard nothing until the next one came.........this carried on for 3 and half years !!! I made a phone call to British gas in February this year.....when I asked why we had not had any bills for over 3 years she promised to look into it, Heard nothing until this week. A solicitors letter on behalf of British gas asking me to confirm my identity and that I am living here within 14 days. Also is a demand for 1500.00 (dont know where these figures come from ) I have logged a complaint with energywatch explaining that its not my fault that they cant manage their accounts efficiently. On at least 15 times they have been told that this needs sorting but done nothing. I have discovered recently that utility companies will only be allowed to bill for up to 2 prev years this comes into effect from this July. From next year they will only be able to bill for arrears of 1 year. Interesting to see that especially since they just started to recover mine !!! Not heard of anyone yet but have e mailed BG to ask them to suspend further recovery action until they are contacted by energywatch. Anyone any experience of a similar situation ? I do recall seeing something about this happening before and it going in favour of the customer,but I am unsure as to the scource.
  17. Mine charge 39.00 for this..............then on top of that another 28.00 for having an unauthorised overdraft !!!

Do you know tho that the Balfs have to give you information about the sale of your goods where the auction is to take place/date/etc etc. I know a guy who actually went and got most of his gear back quite cheaply. Problem is quite often theres still big money owing after they sell the stuff because more charges are added (storeage/removal etyc etc) The level of charges is also extortionate up to 90.00 a throw to send a van round to your house. In my local papers classifieds I see a van and driver advertising his services for 25 quid an hour..............obviously he is either selling himself short.........or has no desire to make another 65 quid at the expense of piling misery on some poor guy who cant afford his council tax....................
