  2. As the title says, I was wondering how long people waited before getting their cheques afetr being told they would recieve a 'goodwill gesture'? Capital One have until 15th December (14 working days) to send me my cheque-which they claimed they sent on 28th Nov! Em

  4. I have recieved a letter from capital one informing me that as a gesture of goodwill and without admission of liability they are refunding the full amount of my claim!!! I also had a copy of the defense in the post!! Do I need to send a letter back or do I wait for the cheque which they say they sent on 28th Nov? Can some lovely mod change this to Won?

  7. Ok Guys, Here is the latest update, when I check MCOL I am presented with this little piece of info: Defence You are unable to take any further action online on this claim. The Defendant disputes the whole amount you have claimed. Your claim cannot proceed online and will be transferred to the appropriate court for continuation. You will receive confirmation to where the claim has been transferred to shortly. I am now very nervous incase I am the one person that is made an example off! Is anyone at a similar stage to me? I am in need of some reassurance here!! Em x x
  8. I have recieved a copy of the achknowledgment from the legal dept of capital one, My question is should I send the legal dept another copy of the schedule of charges? I sent the court a copy to be included.
  9. I didn't sign the form, I sent them a letter declining the offer for settlement but stated in the letter that I would accept as part settlement. hope that helps.
  10. I sent a letter stating that I would accept the money as part settlement and that I reserve the right to start court action to persue the rest, and I gave them two weeks to respond, they didn't so I started court proceedings.
  11. Sorry haven't updated for a while. Have recieved notification that Capital One have achknowledged on 17th November and intend to defend all the way!! Fingers crossed I should have a big fat cheque soon!!! Em x
  12. Hi guys, Here's an update. I recieved notificaction from MCOL that Capital One would be served with the court claim on 11th November and they would have till 25th to achknowledge, as yet I haven't heard anything. I have been checking MCOL and it hasn't changed since the claim was issued. :-| Does it usually take this long to hear back? I'm worried incase they decide to take me to court!!:o Anyone have any words of advice?
  13. as far as i am aware you should be recieving an offer soon, from what I have seen they will achknowlegde and then pay up. I haven't had the pleasure of capital one achknowledging my claim and they have till next sat!!
  14. if you go on moneyclaim you fill in the forms on there, otherwise it's an N1 form which you get from your local court and then take back once filled in. i done moneyclaim as I can check on the website each day, and as I was claiming just over £1300 I paid £120 which is the max. Em
  15. Hey guys, I filed a MCOL on 6th November, and recieved notice to serve 11th November which gives Capital One till 25th to Achknowledge. I have gone on mcol website and all it says it issued, and not served. Would it update or not or do I recieve all the info in the post as in when capital one achknowledge etc? If anyone can help that would be great!! Emma x
  16. Hi, When I recieved an offer i replied with this letter: Response to settlement offer. Dear Robert Udy, Thank you for your letter dated xxxx. I respectfully decline your offer of settlement and request, once again, that you return to me all charges imposed on this account, totalling £xxx. I will accept the sum of £330.80 offered only as part settlement and on the clear understanding that I will pursue recovery of the remainder, with a Court claim if necessary. Please accept this as my letter before action which indicates that you have 14 days, until xxxx to respond before Court action commences. If you do not comply fully within fourteen days then I shall begin a claim against you for the full amount, plus interest and my costs, without further notice. You are reminded that there will be no extension to this timescale. I have once again included a list of all charges you unlawfully imposed onto the account for your reading. I trust this clarifies my position. Yours sincerely I can't remeber when I got the letter from but thanks to whoever it was!! Hope that helps!! Em x
  17. quick question: I have sent a schedule of charges with every letter I sent Capital One but do I need to send a copy to the courts? I submitted my claim on MCOL yesterday, or do I wait untill I am asked?
  18. Today I had the pleasure of recieving a letter from Mr udy in response to my LBA (way delayed it seems) once again stating "fees are legal blah blah" and offering me £330.80. Now my dilemma is this, I have submitted my claim with moneyclaim Yesterday, so do i reply to his letter or leave it and let them find out for themselves that i have issue a claim? Do I be polite or not? decisions decisons....
  19. Jonni2bad, I am serious about the default removal, but I'm so nervous about the charges I didn't want to bite off more than I can chew with regards to default.

  21. Jonni2bad, I can't recall the date of the removal or the amount as I do not have my credit file with me at moment. I think I will go for the default removal as a seperate claim. Thanks for all your help so far-This is beginning to look very daunting!!:o
  22. I'm filling in the money claim and I have put in my particulars of claim and I have ticked the box that askes of I want to reserve the right to claim interest. I ticked yes and it has stated that I mustThe claimant claims interest under section 69 of the County Courts Act 1984 at the rate of 8% a year from {date when the money became owed to you} to {the date you are issuing the claim} of £ {put the amount} and also interest at the same rate up to the date of judgment or earlier payment at a daily rate of {enter the daily rate of interest}. the date i put in from when the money was owed is this that date that I first got charged? so would I put The clamaint blah blah from 20th december 2002 blah blah to Nov 2nd 2006 blah blah of £1007.96 blah blah daily rate of £0.22
  23. I have just realised that because I have a default on my credit file due to the charges, can I put the removal in with my particulars of claim? How would I word it? Thanks Micheal for you reply!!!
