  1. anybody advise what to do in this situation of a delay by the courts?
  2. Just to follow on from this case, I didn't get the suspended order from the court until 9th January 2010! They sent from court(according to post mark on envelope) on 8th January 2010. The order was to payu £750 by end Dec and the rest by March 2010. Now got a letter from lender saying I have defaulted. I didn't get the order till January so how was I able to pay by 24th Dec? I rang the courts, they told me they were having a backlog of 6 weeks.
  3. All done, offered £750 and balance by end of March 2010. Judge agreed and the solicitor from the other side did not object. Was in the room for no more than 5 mins.

  5. hi, it is a hire purchase agreement. I rang the people acting for finance company to offer the £750 and they said they want full amount. So i have told them basically 'see you in court'.
  6. Got a hearing on 19th, car finance credit amount is £11.333.80 and I have outstanding only £1,103.74. I have filled in court forms to say I admit liability and can pay £750.00 towards settlement by 23/12/09. Finance company refused to settle this amount outside court. They want the full amount or repo the car. What are the chances that the judge will look in my favour?
  7. Just would like to update you all on this. Just had a call from Close Credit(their call centre) banging on about the same subject. Saying they want to book an appointment blah blah. Told them they I will deal with them in writing only. Bloke turns round and said that I only have 1 option available and that is to arrange a meeting with their agent at any address in the UK. Sent him packing.
  8. They are not interested in discussing payments on the phone and only want face to face. What i will do is send a letter to them recorded with proposal and see what they say. At least it will show the judge that I am showing a willingness to come to an arrangement rather than Close Credit.

  10. Here is an update, would appreciate comments. I just had a call on my mobile from a person representing Close Credit Management in reference to the £1,000 outstanding on car finance. I told him I don't want to make an appointment with him to 'look at the car' and will deal with them in writing only giving a payment proposal. He said they never deal with cases in writing and only face to face as they have 'qualified negotiators'. i asked him why do banks and credit card companies negotiate on the phone? His reply was 'it is not a secured loan with them'. i said well how am I able to have a payment plan for my mortgage arrears? He then said 'look let's deal with the matter in hand. Basically he said the best option is for the court to decide on a payment plan. This chap rang from a mobile phone as my mobile has got the caller i.d. Sounds weird?

  12. So basically nothing to worry about and just try an get agreement from this debt collector who I know to be CCM. Anyone heard of them?
  13. I had a 5 year agreement with Carlyle finance for a BMW which ended in June. I have about £1,000 outstanding on a £10,000 finance. They have passed it on to an external debt collecting company who keep calling me. They want me to agree an appointment for their agent to come round my house, look at the car, check the V5 and agree a payment plan for the outstanding amount otherwise they will have no option but to apply to the courts for Repo. i am reluctant to have this agent snooping round. I have just recently in last 6 months ran into difficulties and just making sure my mortgage and council tax are paid. What would be the legal position since 90% of the finance has been paid? Also i had another 5 year agreement with Carlyle for £13,000 for a Mercedes and I paid that off in 1 and half years just recently. i did ask them to consider that I paid that off quickly and write off the £1,000 for this particular debt but they refused. Any help appreciated.
  14. Hi All, I just want some advice as to whether there has been a breach of data protection here. On 21st November 2008 i was in hospital for a routine and planned surgery resulting in a 1 night stay. While I was in hospital that morning(waiting for afternoon surgery), my car finance provider rang at my home and disclosed to my father who answered the phone that i had arrears on my account and my car was about to be repossesed if I did not pay up now. My father text me on my mobile telling me the same and 10 mins later I had a call come on my mobile while i was waiting at the hospital and the man on the phone from the car finance company said he needed payment now on the arrears. I explained that I am in hospital awaiting surgery and i cannot do it and he will have to wait at max 2 days until I have come home etc. Fortunately, I came home next day and got it paid off. My concern is was the finance company at fault for disclosing to my father(who does not pay the finance nor drive my car) that my car was going to be taken if i didn't pay up? Any help/advice apprecited. For your info, Carlyle Finance is the car finance guys.
