  1. lol thanks for the reply yes I have already sent them a letter saying as much but where would i stand legally? I really dont know if the law will support me or not and of course that is what I need to know in order to proceed! anyone able to help?
  2. Hello all I am hoping someone could help give me some advice. Right my car (Volks Golf GTI) had a slight problem, it stalled occasionally when in 2nd gear coming to a stop at junctions etc....nothing major just now and again, so decided to take it into the garage. Other than the fault the car worked fine Upon taking the car in, Volkswagen informed me that the throttle body requried cleaning, and it may or may not fix the fault, but that the car would probably be in slightly better order worst case sceanrio. So i said thats cool, clean the throttle Which they did. They told me the car was ready to collect. So i went and asked them if the fault was fixed. They said yes the car had been roadtested and pointed to the confirmation on my reciept which confirmed "road tested", and charged me £77 and told me to monitor the performance and i may need to replace the throttle body entirely in 6 to 12 months time. I paid up and went outside to collect my car. Upon starting the car the car wouldnt start! I tried a few more times and it wouldnt engage! So went inside to tell them this. They wouldnt believe me, and came outside and confirmed the car wouldnt work!! It would fire up so to speak as long as you kept your foot down on the accelerator, but as soion as you took it off the engine would cut out. But they tried to send me home in the car saying that maybe the engine was cold!!!! So i tried AND NEARLY HAD A COUPLE OF ACCIDENTS AS OBVIOUSLY THE CAR WASNT WORKING!!!! i had to be pushed back to the garage by some nice bystanders!! They then told me that unfortunately it seems like after cleaning the throttle everything has settled and now it wasnt working! And to get the car functioning again they needed another 400 to replace the throttle body! I argued that theyd told me the car was fixed and working, and had been roadtested, as indicated on the reciept..... But they argued that the cleaning must have settled in the time it was parked after the repair and my arrival and there is nothing they can do!! SO i need tyo give them 400 to get my car working again I argued that they should refund my £77 and return the car to me in the same condition as which i brought the car to them in (full working order save a minor fault), but they are saying no. So where do I stand? The car was working fine before i took it in. They gave me a reciept which clearly confirms that the car had been roadtested after the repair and was working? But now they want another 400! I have tried to negotiate various ways, for them to KEEP the 77 and put it towards the new repair and me nothing extra? they said no. I tried to get them to refund my 77 and have the car returned to the same condition as to which I had brought it to them ie working and they have also declined that. They simply want the 400! Surely this is illegal?? Surely they have a duty to return the car to me in at the very least the same condition that i brought it to them in? Also, did they break the law sending me out in a car that wasnt roadworthy????? I really dont know what to do. I wrote to both the dealership and the main complaints department but to no avail Could someone give me some advice please??? Am i in the wrong?? I feel so pressured, i lost my father over christmas, and now this, and my car is my lively hood, but it has been parked at the volkswagen dealership since december 23rd due to the dispute. I have no idea how to pursue this, as my car was in excellent condition save for that minor fault? Is there any legal recourse i could take to force them to fix my car or at least return it into working condition as it was before i took it in? All help appreciated, really at the end of my patience, its a really hard time for me and really dont know where to turn!

  4. Thankyou for the welcome! Correct the loan was done over the phone as they wanted the credit card balance consolidated into a loan so they cancelled my card and turned the outstanding balance into a loan. Just had look and it was taken out on the 6th December 2005. They have sent the agreement and seems to have info about the terms, but of course not too sure what im looking for to be honest! Thanks for both the replies, so would u say i dont have a leg to stand on? What i dont understand is surely anyone can put a tick in a box?
  5. I requested and then recieved a copy of my Egg loan agreement, which they have sent back. But there is no signature at all on the agreement, just a check box which says "please tick here as proof of signature"......surely anyone could have entered a tick in here, would this agreement be enforceable? Sorry I did search teh forum and there seem to be alot of people asking the same q but havnt found a definative answer yet? So does is the tick enforceable? thanks in advance
