  1. Helllloooo Everyone!!!!!!!! Got a letter through this morning and Lloyds have agreed to pay the full £5000 in full!!! I was just at the stage where i was preparing my court bundle, the questionaire had been sent off and i was waiting for a date. I got a letter yesterday asking me to phone Lloyds as they did not want the matter to end is a dispute etc. Phoned them and there computers were down and they were going to phone me back. They didnt but got a letter this morning offering me the full amount!!! I cant believe it!!! I just want to say a massive thanks to the consumer actions group and everyone else for there advice and help!! This is a brilliant site and with out you'z i couldnt have done it!!   2. Hiya Everyone, Hope your all doing well, and winning against the banks!! I need help with the questionaire iv getting through, well not be actually as im helping my friend with it. They claim benefits though so didnt have to pay the initial cost for filing the court claim. Soooo the questionaire states that they have to pay a fee of a £100. I recomended they fill it in and then take it to the court and ask them if they have another form for them to fill to exempt them from this. Is this correct? Does anyone know if this is infact the case, or will they have to pay the £100? Please help people, want to get it all right 100%! See alot of you are doing well, so keep pushing everyone else!!!   4. Hi Everyone, Hope you all still doing well with your cases, and good look with verynoe just starting. I am currently preparing my court bundle and im stuck on which cases and statutes it is that i reply on. Iv looked in the statues library and it may just be not being very smart but i dont understand alot of what they are saying. Can someone please help to which ones it is that i need so i can study them in depth and get my head round them!! I dont want to be going to court looking like a fool!!! Please help!!!   8. Hiya Everyone! Hope your all doing well with your claims. I filed my N1 form on the 20th April, and i havent heard anything back about whats happening yet? What do i do next? Im so confused, do i leave it til 14 working days and then send a letter to the court, if so saying what, or is this normal? Please help!! Thanks All!!! x

  10. So, i had a river island store card and a house of frasier one. Can i claim both acounts on one letter (is it the same letter you send off to the banks) and is it to GE money? Does anyone have the address? Thanks All!! x

Hiya Everyone, Iv just claimed all my bank charges back from HSBC, im in the process of a claim with Lloyds and i was thinking about getting started on the store cards i use to have for River Island and House of Frasier! I never went overdrawn on these cards, not that i know if you can or not but i did have late payment charges which were just ridiculous amounts. Am i able to claim these back? I still have all my statements so i wouldnt be a problem to work it out all out, but i just need to know if i can before i start, and what letter do i send off? Is it the same as the one for the banks? Thanks again everyone!!!
  12. Hiya, Im in the middle of filling in my N1 form to send off. Now im down to the part where it asks for the value. Really confused!!! Charges (im going to put what my charges have amounted to) Overdraft interest (is this the interest that they have taken off me which they are allowed to or something else? Help) Interest under S.69 Country Courts Act 1984 (what is this and how do i do it) Court Fee (ok with this) Total (ok with this) Then it says... Plus interest pursuant to S.39 Country courts act 1984 from date of issue to date of judgement/settlement at £xx.xx per day (enter daily rate here - (charges + OD interest)x0.00022 = pence per day) or at sich rate and for such periods as the court deems just. Havent got a clue what to do there. Please please help, im so confused by all this!! Thanks everyone
  13. Hiya,Im really stuck filling in this N1 form. At the top in a box it has IN THE and then it goes on to the claimant bit etc, what do i put on the IN THE bit? Also if i dont have to pay due my partner getting family alowance etc, do i need to write that somewhere or will the court pick up on that since i wont be sending a payment??/Thanks everyone, your all so useful!!Amy

  15. Hiya Gary, I was hoping you would be able to help. Iv been reading through alot of the information and im still a bit confused. Sounds stupid i know! Im ready to file my court claim since Lloyds have fobbed me off with a standard letter saying there charges are not default charges bla blah blah. This was after my letter before action soooo..... I have just printed off a load of info from this site to read through, several times to get my head round it. Iv also printed off the N1 form. Now is this the form i now need to fill in and send off to the small claims court? If so is this just my local court or is there a specific address i need to send it to? Also am i correct i also have to send a summary of my charges with the 8% interest added which i can get off the spreadsheet template? Sorry to bother you with all this just im a bit confused and just want to make sure i do this right, as i know alot of people are having difficulties with Lloyds. I have already claimed with HSBC before and won the case after my letter before action so i never had to do all this last time! Thanks again Amy

Hiya everyone, I have just received a letter for Lloyds after sending my letter before action claiming their apologies, and how they are open about there charges and i could contact them if i was having problems etc, and the following passage - ''The office of fair tradings has publisjed new guidelines on credit card default charges. We're stil talking it through with them, but the inportant point is that the guidlines are about default charges that people pay when they break an agreement with us. This desnt apply to your charges as these were for dealing with your request to go over your agreed overdraft limit. They are not default charges because you havent broken your agreement. They are our prices for the service we provide in these situation'' This cant be right, they must be trying to fob be off. Im getting these charges for exceeding my overdraft limit which they should never have let me do in the first place etc, which is what this is all about. So iv got to start my court claim and im really scared and unsure about what to do with all this. Can someone help and give me some advice of what i had to do first, and back me up with the fact that they are fobbing me off? Thanks again everyone!! Amy:wink:
  18. Hello again everyone! Im going to send off my LBA, and im thinking about setting up another bank account incase they cancel my acount or something. Should i change my bank details with work so from now on my pay goes in my new account? This would mean that i am leaving my account with no money in meaning that i would be constantly over drawn. Is this the way i should do this, or should i just keep the spare acount there until i can clear my ovedraft with the money i shall hopefully claim? Thanks Amy
  19. Hi Barty, Thanks for all this. Ok the 8% interest i dont add on until i have to file a claim. Do i have to add on any other interest when doing my summary of charges? I didnt when i sent the first letter? Will this matter, have i totally messed this up. The way i thought of it was i requested the money and then when i had to file for the coursts blah blah i had to add the interest 8%! Is this correct? Thanks

  21. Hiya, Me again, also can some advise me the LBA when i send this letter do i send a second summary which adds up all the interest? I have this spreadsheet to calculate this just dont know whether it is now i send it? Thanks again everyone!!!
  22. Hiya Everyone, Im in the process of claming £4000 from Lloyds, and iv got a feeling this is going to be a real stuggle as they seem to be on of the banks that fight all the way! Iv sent my first letter and got a reply yesterday stating that they were investigating the matter which could take between 4 - 8 weeks. Their obviously trying to fob me and off and hope i get sick so stuff that for a laugh. Im going to send of my 2nd letter (LBA) unless any of uz advise me to wait??? Also, iv heard a few claims that they have been putting £750 in to people's banks without them agreeing to this and stating that this is their final offer! I would not be best pleased with this and wouldnt want this to happen. Do you think i should add on to my LBA that i do not wish this to happen because i will not except this offer??? Anyone got any advise if this has happend to them?? Thanks alot everyone!! Amy
  23. Hi everyone, Desperatly need someones help. I filed a claim for charges asking for £1946.00. I then recieved a letter daying they were looking into it, i was getting ready to send me LBA when they sent me another letter offering me £1626.00. I was quite happy and couldnt believe they offered me that much straight away, but thought no no, im not going to settle. So i send them another letter thanking them for the offer and i would accept it if they wiped my overdraft completly off without me paying for it. That would take me to round about the amount i was asking for!! They have until Monday to reply and then there time is up! So what shoudl i do next? Should i send them a letter before action then and add all my interest on, which by the way i really need help on how to do. Does anyone know wherre i can get the spreadsheet to calculate this!!!! Hiya, Regarding the letter befor action, there is a section where it says the following "I calculate that you have taken £XXXXX plus £XXXX which you have charged me in overdraft interest for the sum which you have taken total £XXXXX" I am very confused and dont understand how to work out the interest for this stage of the claim? Can anyone help??? Am i suppose to be claming interest here, or do i just wait and add the 8% when i put my courts claim in??? Someone please help!!! Thanks x
