I have just received a cheque from RBS for £1560 in payment of the charges made against me over 4 years which is great news, plus the usual crap ' if we had gone to court we would have won but----. I was thinking great I can get a few necessary repairs done on my property , give a donation to CAG, pay a lump sum to my debt management plan, a debt caused in no small way by the unlawful charges placed against me during a difficult period ( £480 in 5 weeks!)   2. Thanks for your help.It is confusing. I have been picking it up and looking at repeatedly for the last 2 days. I am of the opinion that the RBoS solicitors do not have the right to demand this kind of information, only the small claims court does. I think its purpose is mainly to intimidate hence the overuse of legal jargon which goes against the ethos of the Small Claims court which is accessability and simplicity. Hi All Its a while since I posted but I have taken on RBS to get the unfair and unlawful charges against me refunded.I am at the court stage and the solicitors acting on behalf of RBS have just submitted a defence, they have sent me a copy. Along with this they have sent a 'request for further information and clarification' in which they ask for information for each individual charge made over a period of six years. They ask me to identify a) the date when the charge was made. b) the amount of the same. c)The reasons given for charging the same. I am absolutely sure I sent this

  5. No I did'n't ,I did,n't realise I had to and it was'n't asked for . I filled in a questionnaire and the defendant( Barclaycard has entered a defence). The only correspondence I have had With Barclaycard are the prelim letter and 2 letters from them deferring a decision and an offer of part payment. I was kind of thinking it would not reach the court, everything I have read seems to indicate they cave in at the final hurdle. Hi All I have been given a date for a preliminary hearing in a 'Notice of Allocation to the Small Claims Track' on the 24th of October as part of my attempt to have charges refunded from Barclaycard. I have been preparing myself in case Barclaycard go all the way. Unfortunately I seem to have mislaid the statements I used to collate the information in my initial approaches to Barclaycard before going down the court route.   7. I have claimed a charges back from Barclaycard if successful do I receive this money directly to do with as I please or is it just subtracted from my existing balance? Both figures are roughly the same , that is, the amount I'm claiming and my outstanding balance.
  8. Thanks thats cheered me up. Apart from the obvious financial misery, one of the worst aspects is the feeling of powerlessness against these huge corporations. I feel more empowered. Something I have often pondered on over the last 8 or so months is, if these institutions can have an affect on people like us in this forum in a so called sophisticated society in the UK . How much worse is it for people in underdeveloped or developing countries were the same institutions presumably apply the same ethics or lack of them? Its no wonder we live in a troubled world. Just a thought.

  10. Hi Everyone I have been registered for a while but never summed up the courage to post . Over a period of 3 or 4 years I have been charged what amounts to around £3000 due to being made redundant from a reasonably well paid job up to that time I had never had any problems with payments on a couple of loans, direct debits , 2 credit cards, the usual. I was a good customer!. I had to take a much lower paid job, I struggled but still managed to keep my head above water.
