  1. My hubby is adamant that he hasn't recd it - I agree very odd, as I say we have no probs with post .... in fact I thought it was a fake to begin with, because its the first correspondence from the court or indeed the claimant my hubby has recd Abs.

  4. Hey andy, Nope, been here the last 11 yrs ..... The only experience I have of the court process is my own claim for the infamous M&S store card to credit card - it was only a parital claim, defended and now stayed (I must go about having this struck out at some point ! ) .. anyhoo, the reason why I say that is the furtherst I've gone down the process, is the AOS & defence on MCOL .... so having things set aside etc is all new to me ! (thankfully !!) Abs xx
  5. Thanks, I've downloaded the N244 ... so will have a go at this. If not SBd we do need a more robust defence, but not knowing the particulars of claim (other than you haven't paid the £2500 we want as noted in the judgement) is obviously an issue , but the first thing we can say is that we don't acknowledge any debt with MD., due to this being a NWide ccard, with no notice of assignment recd. I'm going to have a hunt for example N244s where there have been no POC recd and no notice of assignment to get me started - unless anyone can help here ?   6. Hi BB x Yep, its on hubbys file, I'm going to dig this out to see where we are regarding it being SB'd - which I think is imminent TBH - and may be the reason why they've initiated this claim. Absolutely hopping that hubby recd no POCs pre judgment ... as we don't have any issue with our post. Up to the attic to dig out his NWide dispute details, and will report back ! Thanks as always for the help (I can't find the legal forum for some reason, so if this needs to be moved by the Mods thats fine) Abs x
  7. Hubby recd notice of judgement today from Northampton CC for MKDP clakim, asking for £2500 in full in £75 court fees. No idea whom MKDP are, and certainly don't own them anything. Phoned the court, confirm its a genuine claim, the court advise that the claim is in respect of an old Nwide CCard, which we now presume was assigned to MKDP - although we have recd no notification of this, and this is the first time we've ever heard of the firm. This old nwide cc, was put into dispute yrs ago (will check if we've reached SB) - and has been dormant since. No POC recd, so no idea what their particulars of claim are, so that we can defend accordingly. Court advise they will send us the relevant forms (presume N244) , and on receipt will tsf to a local court - there'll be no fee apparantly. I'll dig out the old complaint file we had with Nwide, and come back accordingly if thats ok.. Abs x
  8. Hi Maurenn1 has an issue with a M&S claim for full payment from ARROW (this is the store card changed to credit card), I've got her to AOS, but she needs some help with her defence .... and I can't find the Legal Forum to direct her to .. has it moved ?
  9. Hi, yep as I've just said in PM - submit the AOS, you intend to defend the entire claim. You now NEED to submit a defence ... so thats the next stage and there's plenty of help here - but to acknowledge was urgently needed.

  11. Yep, as with my own, this was originally a store card, upgraded to a credit card without a new CCA ..... Maureen the letter is just bluster and bluff.
  12. Well hello stranger !! Hope you're well. Yep post it up, and we'll guide .... just as an update of my own, I have heard not a peep from Sigma, I have phoned the court whom have advised that the claim is now stayed (due to 30 days passing and Sigma not continuing), which means that to get it re-instigated their claim for re-starting the process and why, has to go before a Judge. The court clerk advised contacting them to see what their position is, but as I know it won't be reinstigated from the reason for dispute I've advised them, I'm leaving it to lie until the default has expired. Anyhoo, enough about me .... post it up treacle and we'll have a look at it for you. Abs x
  13. Hi all, Have rang the courts re Sigma falling off the face of the earth when they recd my defence. The clerk advised that the claim is stayed, and that Sigma would need to make representation to the judge if they wanted it re-instigated - fee payable She advised that if I wanted to close it off, I should contact them to request for them to discoutinue the claim OR I could apporach the court and request a strike out - fee payable. Any comments or tips ? Anyone one else had their claim discontinued or sucessfully had it stuck out ? All help and advice welcome amigos !! Abs x
  14. Hi, thanks for tha .... But surely paying the part claim, even if it reaches CCJ stage, acknowledges the debt, as the claim is in relation to interest on the defaulted debt ?
  15. Hi, Thanks for that .... I am in England, and the claim was a part claim by Sigma for interest since their ownership (of which there were a load isued last yr, and which there were various threads in which we all defended - matter ws M&S card tsfd from store card to credit card with no new CCA). Anyhoo, after the defence in August, there has be nothing from the claimant. What would be your suggestion with this - aim for a strike out (I think I remember reading someone was going for a SO on abuse of court process). If so, how would I go about that, from memory I think there are costs associated with a SO application too ? (or maybe I'm mis-remembering !!) Any help gladly received. Abs
  16. Why is the SB clock suspended if the claim is stayed and there is no judgement or acknowledgement of debt ? ........................ Also, to repeat the q what does stayed actually mean with regards the claim and the process ?
  17. Hi all, I had last July (like lots of peeps) a court claim for part costs, re an old M&S credit card (unlawfully transferred from store to credit). Anyhoo, submitted my defence within the 14 day period, which was acknowledged by the court, awaiting response of the petitioner. They never responded, have never written regarding this, and its all gone quiet. I was advised that as they didn't petition for possession within 3 mths, that the claim is stayed. I'm not sure what this actually means .... is the SB clock still ticking down ? Can this be reinstigated at any point ? Whats the likely hood (from peeps experience of stayed claims) of they trying to breathe life into this again ? Sorry if they are simple qs for those in the know, but from someone who has no experience of court procedures any help is welcomed !!! Thanks guys Abs xxxx

Hi guys, Well title says it all, NWide odraft and CCard debt - both in dispute since 2010 - Nwide have refused to acknowledge or address the terms of dispute, and after several DCAs have been seen off, sold the debts to Aktiv Kapital, which to be fair they do by any old rubbish. Sale advised by NWide header notice of assignment and accompanying AK letter saying pay us. So just a heads up that a load of unenforceable debts have been sold by Nwide - and really shall I just send the THIS IS IN DISPUTE SO UNLAWFULLY SOLD response, or are there are other correspondence suggestions re stating there is no debt with AK .... etc ... etc...   19. Yes, marlin have also turned up re a Marks & Spencer preference account - have sent them the in dispute letter - don't expect to hear from them again, but we'll see !
