  1. My umbrella company received an Order to deduct salary by the CSA in December last year. Unfortunately the order set my protected earnings too high and a new one was issued in April after several calls by myself to to sort it out. After my first payment came out of my salary I called my umbrella company to enquire as to why it was so much and was advised that they had to take deductions based on the April order and there were some arrears from December so my arrears took me up to the Protected earnings limit of £92 and there really wasn't anything I could do. It was Law. As I'd moved recently, I didn't get a copy of the order as my address hadn't been updated on the CSA system. My employer assured me this was above board and correct and after several calls over the following weeks and months of taking home £92 plus any travel costs I could claim, threw light on the subject - they were paying deductions issued on the April order and making up the difference with "huge" arrears on the December one issued. I called the CSA who didn't have the correct order on their system and therefore didn't look any further into it as they were under the impression I was paying £37/week. In fact I was paying between £100 - 250/week and my umbrella company were adamant this was right giving me a complete breakdown of what they were taking. My partner came out of work in september and he hasn't been able to supplement my train fares to see the children (as he has been til now as we thought that was it) and I haven't seen them for 3 months. I called the CSA in desperation last month to ask if we could come to some arrangement with the arrears and she picked up on the error, sent me copies of the orders issued (the April one clearly stating that it superseded any previous order issued), called my employer who have assured me they will refund this months deductions over what I should be paid. The umbrella company are refusing to accept they have made a mistake, will not escalate my complaint, I'm not sure what my rights are, and am angry that I've been so patronised and fobbed off over the last few months. They have also received £28/week for the priviledge of mismanaging my pay. I don't want to claim back (overpaid? More than I should have paid at the time?) arrears from my ex husband. I had a breakdown last year and didn't tell the CSA and the debt was incurred. Fact. Do I have a leg to stand on? I can't get past the benign Customer Service Manager who clearly doesn't understand what the issue is.
