  1. got a letter from drydensfairfax about this I have scanned the letters but don't know how to put them up here they have sent copy's agreement, statement ,default notice, notice of assignment (nothing about it being statue barred ) asking for payment in 14 days

  3. Daughter is expecting to receive an overpayment bill of approx. 2k for housing benefit Approx.. 12 months ago she was Made homeless L.A. (were very good with her) appointed her a homeless officer she was allocated homeless housing and her and her homeless officer filled in her housing benefit form she had to pay some rent as homeless property's come with a higher rent as they ate part furnished After 6 weeks in homeless accommodation she was allocated a house she was at work the day she was due to pick up the keys and the homeless officer took the keys to her work daughter asked her about her new claim for housing benefit for her new house homeless officer said she would deal with it as everything was the same and send her a receipt she was granted full housing and council tax benefit she didn't think this was right and phoned her homeless officer who went through it with her on there system everything was right income .tax credits ect . so it must be correct Not happy with that a few days later she phoned the benefits section and went through it with them again told everything is correct This yrs housing benefit came in and she has to pay rent she always had this little niggle in the back of her mind that something wasn't right and nothing had changed from the previous yr she phoned them they have asked her to take all her paper work to the local office so they can scan them and send them to housing benefit (and theirs a lot 100+ pages ) anyway she was going through them and one housing benefit rebate form has her working tax credit's on it but the one that was done by her housing officer hasn't (thence the 100% rebate) This is a lot of money and if she has to pay it back then that fine she will pay it however I would like her to go down the appeal root any thoughts on this

  5. cheers dx got him coming round in the morning to phone He will ask for Date of loan agreement Amount of loan (he thinks it was 5k he borrowed and he did pay it for a few yrs so cant understand why its now 11k) date /amount of last payment date of default date debt was sold and to who Is their anything else he needs to know

My stepson has received a claim form from capquest which he believes is for a loan he had with Halifax we have checked his noddle and Equifax file and nothing is showing up Issue date 31st march 2016 Name Of claimant Capquest 1) The claim is for the sum of 11k in respect of monies owing by the defendant on a credit agreement held by the defendant with Lloyds banking group under account number 1234567 upon which the defendant failed to maintain payments A default notice was served upon the defendant and has not been complied with 2)by virtue of a sale agreement between Lloyds banking group and the claimant who has a genuine commercial interest The defendant has been notified of the assignment by letter Contact Drydensfairfax solicitors What is the value of the claim? 11k Is the claim for a current account (Overdraft) or credit/loan account or mobile phone account? Bank loan When did you enter into the original agreement before or after 2007? not sure 2006/2007 Has the claim been issued by the original creditor or was the account assigned and it is the Debt purchaser who has issued the claim. debt purchaser Were you aware the account had been assigned – did you receive a Notice of Assignment? NO Did you receive a Default Notice from the original creditor? not sure Have you been receiving statutory notices headed “Notice of Default sums” – at least once a year ? no Why did you cease payments? split with wife then made redundant What was the date of your last payment? approx. July august 2009 however it could be as late as November 2009 Was there a dispute with the original creditor that remains unresolved? no Did you communicate any financial problems to the original creditor and make any attempt to enter into a debt management plan? no How do we defend this as I think it is statue barred (if that's the correct word ) Thanks
  7. thanks for the reply I know how much owed they were paid a day rate £150 day (5 days)plus £60 week holiday pay (paid weekly ) plus lodge at £40 a day (4 days) my hubby is also due 7 days lodge from august so its a fair amount of money you pay your own lodge and you get it back the following week in your wages Im a bit worried about this going to court as hubby has another job and we would lose a lot of money if it went that far because he would have to take time of work and he could anywhere in the country can we claim this back if it goes that far

Hi dogsarecool welcome to the site im so pleased you have found your way over here hang in there and you will get the help you need to sort this out as for the statutory declaration the solicitor should not be advising you to lie on it (regarding the car) it is a criminal offence to lie on a stat dec and not worth the hassle there is every chance the bailiff already knows it belongs to your son I would put all good expect vehicle reg No ABC 123 which belongs to Mr xxxx xxx and the (make)laptop which is on HP putting the name of the owner of the car on the stat dec wont make any difference because The bailiff wont take the car he doesn't want it as it has no Value
  13. every possibility its one of my old posts from MSE as I always mention this site when it comes to parking tickets a point of interest ive taken this from another site (consumer action group) it was posted by a very well known poster called tomtubby who is an expert in bailiff law If you had no knowledge of the pcn then the correct course of action would be to file an Out of Time witness statement with the Traffic Enforcement Centre. The bailiff is NOT permitted to enforce a warrant at a new address. He KNOWS this. Once an Out of Time witness statement has been filed all enforcement MUST cease. BY LAW!!!!   14. send a recorded delivery letter (or hand it in and get a receipt ) and an e-mail to the council and ask them to give you a complete breakdown of all bailiff fees

P T thanks for the reply I don't know the notice of seizure was done in December the warrant expired in January they have been late with a few payments but haven't paid this months payment that should have been paid beginning of the month as of now they haven't received anything from the enforcement company or the court
  16. if a bailiff collecting a magistrate court fine has seized your goods (old regs) and the warrant of execution has expired is the notice of seizure still valid thanks guys

  18. I personally don't use that card my hubby does for work so we can keep an eye on his expense's luckily there is an arranged overdraft on the card so the charges are only £1 but I will be asking for it back

I recently changed from aol to talk talk when I set up the account I provided my bank account details to set up a DD my first payment was made manually over the phone (it looks like when they tried to take the first payment by DD it was rejected according to my talk talk account details ) Payment Direct Debit Payment Rejected Payment Direct Debit Rejected Payment Credit Card Payment My payment was due yesterday so checked account today to make sure payment had gone through couldn't find the payment but noticed my other account was overdrawn and low and behold they had taken the payment from that account where /how would they get my account details for this account There is a slight chance this was the account I used when I was with talk talk years ago (and I do mean years ) i say slight because ive always had all DD set up to come out the same account I have sent them an e-mail asking where they got the account details but i was wondering are they allowed keep old customer account bank details
  20. He was unemployed on the 5th April so I thought the JC gave him a p60 at the end of the tax year
  21. update Letter and death certificated handed in to shop still not had a letter confirming accounts closed will give it another few days then chase it up
  22. my hubby signed of on the 7th April he received a p45 from the JC with this signing of date he has not received a p60 should he have received a P60 from the JC as always thanks guys
