  7. thanks for the reply I know how much owed they were paid a day rate £150 day (5 days)plus £60 week holiday pay (paid weekly ) plus lodge at £40 a day (4 days) my hubby is also due 7 days lodge from august so its a fair amount of money you pay your own lodge and you get it back the following week in your wages Im a bit worried about this going to court as hubby has another job and we would lose a lot of money if it went that far because he would have to take time of work and he could anywhere in the country can we claim this back if it goes that far
  8. found this template letter posted by sidewinder on another thread that I intend to use as my hubby and his son haven't been paid there lie week my hubby has been waiting 2 weeks son should have had his this week if the wages are not paid after the letter is sent what is the next stage its this bit im worried about ( I will be forced to instigate proceedings to recover the unpaid amount) Dear Sir I was previously employed by [Employer Name] from [Date] until [Date] and my Employee Number was [Number] I am concerned that having left your employment, an amount of wages remains outstanding and despite making previous requests the amount of [£Amount] remains unpaid My calculation of the above figure is as follows:- [insert details of how the amount is made up] You will be aware that a failure to pay outstanding wages represents an Unlawful Deduction contrary to Section 13 of the Employment Rights Act 1996 I require payment of the amount due within 14 days from the date of this letter, or your reasons why you believe that the amount is not owed to me, or I will be forced to instigate proceedings to recover the unpaid amount Yours faithfully [signature] [Printed Name]

  11. Thanks tomtubby and citizen B dogsarecool you will be ok now so don't worry and lose any sleep over this
  12. Hi dogsarecool welcome to the site im so pleased you have found your way over here hang in there and you will get the help you need to sort this out as for the statutory declaration the solicitor should not be advising you to lie on it (regarding the car) it is a criminal offence to lie on a stat dec and not worth the hassle there is every chance the bailiff already knows it belongs to your son I would put all good expect vehicle reg No ABC 123 which belongs to Mr xxxx xxx and the (make)laptop which is on HP putting the name of the owner of the car on the stat dec wont make any difference because The bailiff wont take the car he doesn't want it as it has no Value
  13. every possibility its one of my old posts from MSE as I always mention this site when it comes to parking tickets a point of interest ive taken this from another site (consumer action group) it was posted by a very well known poster called tomtubby who is an expert in bailiff law If you had no knowledge of the pcn then the correct course of action would be to file an Out of Time witness statement with the Traffic Enforcement Centre. The bailiff is NOT permitted to enforce a warrant at a new address. He KNOWS this. Once an Out of Time witness statement has been filed all enforcement MUST cease. BY LAW!!!! PS: The Out of Time witness statement must be sent to TEC by email and if received by 4pm today all enforcement will be possibly taken from these threads http://www.consumeractiongroup.co.uk/forum/showthread.php?357219-help-with-Bailiffs-please-unknown-traffic-offence&highlight=TEC+by+email+if+received+by+4pm+today+all+enforcement+will+be+on+hold. http://www.consumeractiongroup.co.uk/forum/showthread.php?396163-Urgent-help-equita-bailiff&highlight=TEC+by+email+if+received+by+4pm+today+all+enforcement+will+be+on+hold.
  14. send a recorded delivery letter (or hand it in and get a receipt ) and an e-mail to the council and ask them to give you a complete breakdown of all bailiff fees
  15. P T thanks for the reply I don't know the notice of seizure was done in December the warrant expired in January they have been late with a few payments but haven't paid this months payment that should have been paid beginning of the month as of now they haven't received anything from the enforcement company or the court
  16. if a bailiff collecting a magistrate court fine has seized your goods (old regs) and the warrant of execution has expired is the notice of seizure still valid thanks guys
  17. russelldash welcome and thanks for the update I sincerely hope your family get the justice they deserve

  24. as this was before the new regs you need to know if a levy fee has been charged I believe if there a levy on goods then the old rules still apply (someone will correct me if im wrong) so you need to phone and ask the council the amount of the liability order what bailiff fees charged you are asking what fees have been charged the date of each fee the amount of each fee the reason for the fee (old regs) would be some or all of these 1st visit fee 2nd visit fee hedder H fee levy fee walking possession fee attendance to remove fee If a levy fee has charged and you have not previously let a bailiff into your home (have you )ask what goods they have levied do NOT let the council fob you of with you need to speak to Rossendale's we don't have this info ect the council have all the information and are responsible for all charges added to your account if the person on the phone refuses to provide the information ask her/his name ask them to confirm they are refusing to provide you with account info ask to speak to supervisor post back with the info and someone with more knowledge will help you further
