  2. *Bump* Well if anyone is interested, received a letter from Bryan Carter today stating "We refer to recent communication in this matter. Please note that we have been instructed to take no further action against you and have therefore closed our file" So what happens now? Back to egg?
  3. Hello All, I am being pursued by Bryan Carter/Fredrickson International for an Egg debt I defaulted on (defaulted nearly a year ago). Initially, around 6 months ago I was contacted by capquest who said they were acting on behalf of egg etc etc etc. I sent them a CCA request and around 4/5 weeks later they replied (Sending back my £1 cheque) to say they couldnt get the requested information and have returned the account to egg. So around 4 months back I started receiving letters from Bryan Carter/Fredrickson International......foolishly I ignored them all until on the 19th Aug I
  4. I wrote to you requesting a copy of the credit agreement you allegedly hold in my name, under the Consumer Credit Act 1974 (Sections 77-79). A copy of the credit agreement should have then been supplied to me within 12 working days. To date you have failed to respond to my request. . As you will know, under the Consumer Credit Act 1974, a judge is not permitted to make any enforcement order unless the creditor can provide a true signed copy of the original credit agreement. This means that unless you can produce such an agreement, this alleged debt is not enforceable in law. I
  5. I'm having to deal with Bryan Carter/Fredickson International with regard to an old Egg Debt. They have been chasing me with letters for over 3 months and me being me have been ignoring the issue. Anyhow on the 19th August I sent both of them a CCA request. Both £1 cheques were cashed within a few days and Bryan Carter wrote back to say account on hold whilst we refer with our client. What should I do now since I havent heard from them? I don't know whether this has any relevance but this Egg debt was first being dealt with by Capquest and after I issued them with a CCA req
  6. And I won! Offer of full refund received from T McLean on Saturday 10th. Mailed it back special delivery which got there on the 12th so just awaiting them putting the money back into the account now (does anyway know if they are pretty quick at this?). So it only took about 15 days in total. Thanks to all at CAG. Will be making a donation once the funds hit my account.

  8. Well today was my deadline (gave them 10 working days) and thus far nothing from rbs. I emailed sandy watt a few days ago who said, "because of the volume, we do not ackowledge letters however I can confirm we have reveived your and expect a response in the near future".....Going to fire off LBA before 5pm today - can I also email the LBA?
  9. Was this before or after your LBA? If this offer is simply in reply to your prelim letter then I'd fire off your LBA....wouldnt suprise me if they reply offering you the full sum then!
  10. Quickest way to get the statements is to ring your branch and request them. They'll ask for the dates you want them for and £5 will be taken from your account. I did this with two RBS accounts recently and received statements for both accounts within the week. They asked me why I wanted them so I said 'for my records' as I'd misplaced some old statements. (didnt have the balls to say 'I want to reclaim my charges' over the phone- lol).
  11. No harm in asking the bank for 6 years of charges however if/when you file against them in court then obv just clkaim for 5 years.

  13. Hi, In the past I've used my Credit card to purchase foreign currency (this incurred a 'cash advance fee'). Can I claim for this as well as the late payment fees etc? Anyone have experience of this? Thanks in advance!
  14. Thanks for your replies....I guess this is a risk I'll just have to take. Received second set of statements today and total charges come to £1100ish (wont put the exact amount here in case RBS are watching - lol). Going to mail my initial letter in an hour or so to Cust Relations at South Gyle. Will keep y'all updated as and when I hear anything!!
