  5. heres a draft of an email I'm thinking of sending Dear Sir/Madam Today,11/01/2010, I received a letter regarding a debt with MBNA.I already have a repayment scheme with a company called CAS about this debt. Is CAS part of Equidebt?If so why are you asking for payment in full when I already have a repayment agreement in place? According to my bank statements I have never missed a payment so I am confused by your demand for payment in full.Especially as I have been in contact with CAS by email regarding this debt and at no time did they inform that the debt had been passed on or that any of the details I have regarding the bank account for CAS I have been paying money into are incorrect. I will continue paying CAS until I receive written confirmation from them that this is no longer the case or you provide proof that Equidebt now owns this debt. Furthermore I demand all further contact between Equidebt and myself is by letter or email only.Any telephone calls to my home or place of work will be logged and a complaint will be made to OFCOM, OFT and other relevant bodies. what do you guys think? any suggestions gratefully accepted!
  6. Hi all Just received a letter from Equidebt demanding payment in full for a debt I have been repaying to CAS. CAS have been in contact recently demanding a payment from me because they hadnt received a months repayment,rubbish, it still left my account and when i emailed them this and offered proof they said my bank had recalled it???as a gesture of good faith I sent them an extra payment(which has not been returned)again, the 'missing'payment still hasnt turned up in my account for over a month so ii think they got it!now this Equidebt letter has arrived demanding payment by 15 jan(fat chance! )anyone else face similar tactics?
  7. thanks guys,ive got a sony ericcson k850i.i've got a spare phone i can use till the contracts up.i'll just stick to a 12 month contract from now on(and bargain hard with them when it comes to renewing my contract!)
  8. Hi all,I've got a virgin mobile on a 18 month contract with 3 months left on the contract. The phone is beginning to play up(turning itself off,not always charging properly)and I called them about this and the response was "the manufacturers garuntee is only 1 year,we are not responsible"and they suggested I buy a phone to keep me going in the meantime!The phone isnt insured and I've not dropped it or anything.It has a bit of wear and tear but thats to be expected and the operator said I cant have a new phone earlier than November(1 month before my contract expires).I'm just wondering where I stand re consumer law.Surely if they are supplying phones on an 18 month contract I have the right to expect it to last 18 b?@@$y months! Any help or points of law to throw at them(or directions to the appropriate threads)will be greatly appreciated!

  10. Recieved a letter from Lowell this morning saying"...we have decided to cvlose your account as a gesture of goodwill and you will receive no further correspondence from us regarding this matter"YESSSSSS!!! thanks guys for all your help!:D:D
  11. yesterday I received a letter from Lowells saying "we've received your request for a CCA and we are requesting a copy frrom your original lender...etc" now ive received a letter from Red saying "you have failed to settle your debt or enter into a repayment plan ....blah blah....come round your house blah....start legal proceedings"unbeleivable! since Ive already sent them the letter that that 42Man kindly put on my thread I wonder where they /I stand now?

  16. hi guys,just a quick question , where it says "I am pleased to see that you confirm this as a true copy of the original agreement executed by yourselves on the XXXXX."do i put the date that i asked for my CCA or the date on the copy of the application form they sent me?sorry, having a bit of a stupid moment!

  18. thanks guys,no i applied in store,in the last few months after making a formal request for a CCa(sent rec del and including £1PO)they have sent me numerous copies of my application which seems to be about passing my details to a third party to verify stuff,a questionaiire asking how much i earn and how much i repay to debts,oh and someone elses CCA!I keep sending them emails which basically say'no,try again,and since ive already paid the correct amount for my CCA i'll not be paying agan because of your mistake!'
  19. Hi all for the last few months i've been toing and froing with these guys. Basically they are chasing a debt fom the moneyshop,I set them a cca request a while back,they send me a copy of an application form i filled in early 2006,it has my details on it but doesnt have any info regarding amount borrowed,interest i'l be charged etc.Its my understanding that this doesnt constitute a valid CCA.Are there any letter templates about to get these guys to back off?(if i'm correct about the info they keep sending not being valid then I dont think they have a CCA for me) Thanks

Hi Hamish,after reading your thread I think we both have a lot in common!I think everyones right, its time to stop being reasonable and start playing hardball,I'll be sending my CCA request next week,I've spent enough time trying to sort this out and its time MBNA accepted that the amount I'm offering is not some random figure but ALL I CAN AFFORD!you should be focusing on getting your health back to 100%, not constantly having to repeat the same things to them and dealing with harrassment over the phone!

    Thanks guys, always good to feel like we're in this together and not alone! I've emailed them the last letter i posted to the customer advocate office,I'm not going to waste money i havent got on postage when I keep repeating myself.If they sell the debt I will report them to the OFT. If they call nxt week I will call the the OFT, trading standards and the police! I think Ive done enough now by anyones estimate to sort this out with them and if they want to send it to a dca i'll cca 'em:D
