  1. hi i am seeking some advice on my potential redundancy situation i was on holiday from 11/8 to 18/8 i went back to work on the 19/8 as normal and was told off colleagues that some people were given letters on the 12/8 for potential risk of redundancy and a follow up meeting would be held on the 19/8 they said it did not include project managers which i am so did not think anything about it on fri 20/8 i was called to the boardroom and was handed a letter by my director which started as follows further to your meeting with ........... regarding he potential redundancy situation i am writing to confirm our discussions you were informed that after a review by senior management it was found that the following the completion of the early phase of the project and a review of the completion strategy for phase 1 of the royal london hospital there is a diminishing requirement for your role. as a result of this decision i must confirm that your employment with .......... is now under threat of potential redundancy the company will commence with a consultation process on a individual basis with you which will continue for a period of at east 30 days starting 24/8 in the meeting i stated i had no previous meeting and was not scored or put in any pool the director stated that i was a special and was not put in any pool or scored i questioned that why did the letter state that i had a meeting he said it was a mistake he told me i was on garden leave and to clear my desk and only go to the consultation meetings. i have been to the 1st meeting they went through that they will try to find alternative employment etc. they said after the 30 days if no employment has been found then i will be made redundant they said how it works is they will get me to sign a form so i get my months notice in lieu so it is not taxed there is another 3 people on the same job that is looking after the trade which i do which is ventilation one is a project manager and 2 are ventilation supervisors my position is ventilation project manager i also had 2 supervisors but they were contract they also got the boot but was allowed to come to work the next week i was not i was on garden leave also they asked my 2 supervisors to do the handover to my operations manager which is taking on my work i was not scored against the 3 other workers they did not even get put up for redundancy do i have any grounds after the way they have treated me i have worked for them for 2 1/2 years have i got any grounds for unfair dismissal also could anybody run through the process of the consultation do i bring up the items that i am unhappy or keep it to myself untill the end thanks joby

  3. hi i have had problems myself i had £ 1500 in arreas i was paying £50 a month over my monthly amount they did go down the litigation route but as i am with a debt managememt company it seemed to put them off the court route i dont know if there is anything in it but i have only just paid the arrears off and it took 2 years to pay only a thought as a couple of companies took me to court but the judge offered them exactly what my debt management said . thanks joby
  4. hi thanks for your reply the broker has gone bankrupt i had a joint income of £ 38 , 000 and on tax credits i had a ltd company up to 06 but this went into liquidation then went on paye on march 07 for another company the broker told me to put that i was still self employed and put my old company name on the application form so i can self cert the broker then sent me 2 self cert forms to sign one for me for £95,000 and one for my wife for £30,000 to get the secured loan the loan itself took me 2 months over retirement age the intrest rate was 13.4 i also had some arreas on my mortgage at the time i did not have to send any bank statement either hat would be the best way forward to approach sppl know that the broker isno longer around i also had adverse credit with default notices about 6 thanks joby
  5. hi i have been in arreas with my secured loan from sppl / capstone and had high levels of charges and interest added example : arrears management fee £ 50 litigation fee : £ 100 interest charges : from £ 5 to £ 12 per month is there grounds to claim some of this money back also any help on mis selling the product ie i was on paye and the broker asked me to self cert etc any help woul be gratefull
  6. i would like some help on my sppl / capstone secured loan took out in july 07 just checking if i had a miss sold loan claim i went through a broker called essential loans.com which have now gone bust i had adverse credit at the time and was working on paye they told me they could get me the loan if i filled in a self cert as self employed but said this was standard if you needed to increase your income the loan itself took me over retirement age by a couple of months they did not ask for bank statements or wage slips the intrest rate was 13.4 i had defaults against me the loan was for £70,000 i went into arreas after a year and got all sorts of charges any help would be gratefull thanks joby

  8. hi sorry did send a chase up cpr request letter on 2/6/09 the original was sent on 14/5/09 all recorded delivery all letters have been sent this way thanks
  9. hi i sent a cpr 31 . 14 request not sure what has been allocated i think sct have not filled in the form yet the amount is for £ 9500 all the documents are on the link i sent i have asked for help on that thread but foolishgirl is on holiday she has been helping but this is a new form that has arrived today she drafted the defence and cpr thanks joby

  11. hi i have just had back off northampton court a allocation questionnaire to fill in on behalf of cl finance to give an over view i requested a cca in dec 08 no respones put the account in dispute. in april they sent a appliction form which was not a cca they sent through court proceedings from northampton i sent cpr request for documents no respones and sent defence back on these basis then i get sent this through yet still no documents sent from cl finance seems they may produce these in court any help in this would be gratfull thanks joby
  12. hi just recieved a respones from the court with a allocation questionnaire so i take it cl finance are going to court they still did not respond to my cpr request for the documents so i would think they will produce these in court any help in the way forward and strength of defence thanks joby
  13. hi just an update i recieved the letter from the court on 4th june saying they served my defence on cl finance they said they had 28 days to respond i have heard nothing could some one help with the next move or draft letter to send i would have thought cl finance would have responded by now if they were confident on what they had thanks joby
  14. hi many thanks for all the advice without all the people on this forum then the likes of my self and other people that struggle with legal stuff would not have a chance to stand up to the banks etc i will see what comes back and post it if for any reason nothing comes back inside the 28 days what would be the next move thanks
