  3. I know! My second claim against HSBC!. Two letters sent, all interest worked out and all paperwork ready to go!
  4. Just about to do everything on line and start litigation and it seems the website is down!! Anyone else having this problem? http://www.moneyclaim.gov.uk/
  5. Just claiming back £60 worth of bank charges, have another claim in with Barclaycard for 6 years of their charges. Trouble for poor old HSBC is that I have already got back many years of charges from them already!

Ladies & Gents, Onto my second claim with HSBC for more recent charges and they seen to have changed the way they are dealing with the letters they have been getting. 2 Page letter sent today by HSBC in response to my second letter (First was the standard, second was not accepting their statment and will proceed with litigation etc) included a nice copy of a booklet from the financial Ombudsman service! Also now they state "Please be advised that the recent ruling by the Office of Fair Trading was in relation to charges incurred on credit cards only" Bless. Anyone else noticed this?
  7. I find it unlikely that the bank can force the repayment of a bank loan. I have though got another bank account setup when Is started my first claim. Just was asking as I am about to start a second against HSBC
  8. If you have completed a claim against HSBC say for the last couple of years and then they charge again, is there any technical/ legal reason why you cannot start another action against them for charges outside the period of your original claim?

    Hello all! Just to keep you all upto date on claiming £1495 back from HSBC 1) Sent my standard letter with all the charges worked out on the 6th March as I had all my bank statments. 2) Recieved a reply on 14th March saying they were looking into matters. 3) Recieved another letter on the 10th April saying they have not completed their investigations and will contact me by the 8th May. 4) Recieved another letter on the 5th of May, this was the standard 2 pager about the banks tarifs and they do not agree with my contentions. BUT they have paid £150 into my account as an act of good will and deleted £25 worth of charges for April as I am a long serving customer! FFS. Are they hoping by paying it in I will not bother! Money claim time! I thank you! Will

Just got back the standard letter today (Dated 14th March) "I am looking into the matters you have raised and will contact you with a full response as soon as I have completed my investigations. In the meantime I enclose a copy of our leaflet which explains how these matters are dealt with David L Johnson Customer Service Officer" Also got another letter reference a call I made to HSBC on the 9th March about my account. "With regard to our telephone conversation of 9th March 2006 and your request to have a tape of this conversation. I regret to inform you it is not bank policy to send these tapes in the post, if you would like to call me on 08456 022097, I will arrange an appointment at a suitable branch of HSBC where you can listen to the tape.   13. HSBC Today charged myself £30 for taking £10 out when £10 overdrawn. Called the 0845 a chat with a lady that could not help and put me onto the Duty manager (Stuart Camberly) asking for this charge to be refunded. He did not accept that under the 1977 Unfair Terms Act and the 1999 Consumer Credit Act they were unlawfull because I signed to there T&C's and that charges by HSBC of this type were acceptable. He suggested I take legal representation to take this further as he would not help me any further on this matter. What a nice chap.
  14. I am so tired of being charged by HSBC and the taking of my money by them it is really the only thing is this world that makes me very angry! I now understand that the regime of fees which you have been applying to my account in relation to direct debit refusals, exceeding overdraft limits and so forth are unlawful at Common Law, Statute and recent Consumer regulations. Your responsibilities I would draw your attention to the terms of the contract which you agreed to at the time that I opened my account. It is an implied term of that contract that you would conduct yourselves lawfully and in a manner which complies with UK law. I am frankly shocked that you have operated my account in this way as I had always reposed confidence in your integrity and expertise as my fiduciary. What I require I calculate that you have taken £1495.00 in charges, please see below for a month by month breakdown. I will give you 14 days to reply to me accepting unconditionally my request in principle and letting me know a date by which I will receive payment. If you do not respond or you do not respond positively within this time period, I shall send you a letter before action giving you a further 14 days in which to reflect. I believe that these targets are more than sufficient for a large company such as yours with dedicated staff and departments.
