  1. Thank you for your prompt reply no.....my dmp is not fee paying......thanks to all the lovely people and their wonderful advice on here! Yes I sent CCAs where applicable thank you if I dont reply are they able to set a judgement against me ? I am in fear of my lovely clean credit rating being ruined!! Xxx
  2. hi there I am getting letters from the above 2 so far - saying they are attempting to contact the above named (me) at this address etc etc etc In the subject matter it says Not Known/ Gone away which I know is normally on a creditors note on a credit file if the address hasn't been up dated so Im guessing theyre after me for something I just don't know what - My credit rating says excellent - although there are defaults on there but these are being paid through a DMP Do I answer the letter - the LAST thing I want is a CCJ now that IVe managed to clear up my rating I wont phone them but there is an email address - I don't want to ignore and then have something blow up in my face!!! Any advice please?
  3. hi there Long story short Husbands company failed due to fraudulent partner - he was a director so ended up being massively in debt we have slowly worked our way through trying to clear up the mess - we still owe money but both credit files were looking much healthier - until yesterday when I checked his to see a CCJ for £399 from last month - issued by capquest regarding an old company mobile from orange We received no paperwork regarding this - and in August this year I had written to capquest to ask for a full and final hoping to clear it fully They replied that they had no record of it so I contacted Experian to have a notice of correction put against the entry on hubbys credit file which they did and lo and behold now we have a ccj! Typically I cant find the letter they sent me to say they have no record - only the emails to and from Experian asking for a NOC I phoned the court but as it is 6 wks old it cannot be removed although the clerk did say to try to have it removed as it wasn't sent to the correct address I phoned capquest and spoke to a mini hitler who refused to be of any help atall until I paid some of the amount outstanding so where does all that leave us............ Is it worth applying to court to try and get ccj removed? It will be paid in a couple of months so then should read satisfied but that wont be of any help to us when we try to find a mortgage will it? Have I a leg to stand on as they it sent to wrong address ? sorry if this is all a bit muddled but Im in shock - all the hard work done to clear up our credit files seems to have been for nothing!!
  4. Im a bit confused so apologies if this all come across as vague!! My husband has two DCAs chasing him at the mo - Mackenzie Hall and Capquest for 2 different debts - totalling about £500 They have both put defaults on his credit file we intend to get a mortgage next yr and would of course prefer these not to be on there Should I pay them if I firstly get confirmation that the defaults will be removed should I leave them as - according to other threads - they are crooks and should be ignored? Capquest couldnt give me a copy of the account as they said it was a service account (for a phone) and therefore not covered under the CCA - I dont know how to follow this up? Mackenzie Hall have offered a reduced settlement which would be acceptable i thought if it removed the default? confused and dont know what to do for the best so if anyone has any advice I would really appreciate it Thanks x
  5. apologies - I meant a default - not a charge! can I get this removed? what can I now say to Capquest to get them to send me proof of this supposed debt they have bought?

Hi Hubby received a demand for £399.99 from Capquest saying they had bought the debt from Orange! he did have a debt with orange - for £500 - but this has been cleared with Lowell Portfolio I sent off a request to see the original contract along with the £1 fee but this morning a letter came back saying that the account was not a credit agreement but a service agreement (?) and therefore not covered by the CCA They are making the usual nasty threats but on checking hubbys credit file they have put a charge on there - so now Im really cross and need to know what to do next - I want that charge off his file! Is there a template of another letter to send or is someone able to point me in the direction of what to do next? As always - all help very much appreciated!

  8. thanks for your reply they are not yet in arrears with this loan as they have managed the payments through extra work - this work is no longer available so unfortunately arrears are the next thing I will certainly update once we get a reply - meanwhile does anyone think there is something else I could be doing? feel so sorry for them!!!

  10. Just to update this thread - after long and protracted communication with both the Head of Finance and of Recoveries for RBS - I am delighted to say the case is closed!!! They have decided my husband is truly a victim in all of this so we are delighted - thanks once again to all that offered advice and help - much appreciated!! :-D

Forgive me if this is in the wrong place - feel free to move it if so Three years ago my sister and her husband - in the depths of debt despair - took out a secured loan of £120,000 over 20 yrs with Paragon. They have been paying back a crippling sum of £998 per month and have found it impossible to meet other basic needs such as electricity/food for their four children etc and have suffered severe stress- they are both on medication from the GP. This is how I found out about it as my brother in law has ended up in hospital. Now - putting aside the madness of taking on a secured loan for this much on one wage with four children to clothe and feed - I need to help her. They have been phoning and harassing her asking for higher payments - I have told her to ignore their threats but make a written record of when they do call She has no paperwork relating to this loan - she applied online - they sent something out which she signed and returned without taking a copy, she has received no statements and doesnt know the rate of interest she is paying She phoned to ask how much the loan was as of yesterday and was told it was 124,300 - when she queried this odd amount she was told it was 'the broker fee' when she said she didnt have a broker she was told it was PPI - she never asked for PPI as I have drilled this much into her!!! I have sent a SAR request by recorded delivery for her today and await that with interest but meanwhile is there anything else I can do? Her next payment will be the end of June but it is crippling them so would she be within her rights to pay a lesser amount? it is not a direct debit payment but she phones up and pays by card. They really are at breaking point and while I understand they have responsibility to repay what they owe this is going to send my brother in law to an early grave if I dont help them - with the help of you good people and this fantastic site!! Any help/advice or suggestion where to turn next are very gratefully received as always!! xx
  13. Hi and thank you all for replying - very much appreciated Firstly let me apologise - I have limited access to the internet and therefore this site and am far from a prolific poster. I didnt realise that if I had posted on another thread - albeit about the same issues - that they had to be linked. I did act on the advice given to my post in the thread Formal Solutions - I sought legal advice and was told that the demand could not be set aside I then took it upon myself to deal with RBS themselves as I explained in my original post on this thread. To answer your questions It was a limited company My husband says he cannot remember signing a personal guarantee but cannot be sure - this was 5 yrs ago It was invoices for factoring that were raised - my husband said no signature was needed as it was all done via computer software and RBS paid out automatically. The total was for about £100,000 and seemed to be going on for only a matter of months - as soon as my husband noticed he started to voluntarily wind the company down to prevent further theft The directors roles were different - my husband dealt with the customers and was out on the road - his partner dealt with the finances and the company account We do not have a copy of the agreement - I am in touch with the Group Head of Customer Relations and the Head of Recovery for RBS - can I request it from them or is there someone else I should be speaking to? The matter was not reported to the police as we had engaged a solicitor initially who was collating the information - and then nothing was heard from RBS for 3 years so we were advised to let sleeping dogs lie! I am fully aware that the debt exists and if any of it were my husbands we would happily work with RBS to bring an end to the situation - but it is not my husbands debt - he was naive and gullible perhaps by not checking every piece of paperwork and keeping a closer eye on the figures - but he is not a thief. They have stayed the bankruptcy order for 28 days to await further information - can they just make us bankrupt like that? surely we have some rights where this is concerned? Also, am I expected to give them my income and expenditure as if we were accepting the debt is my husbands? Does the fact that they had us fall off the radar for 3 years hold any sway ? rebel11 and debbbbsy thank you for the information - I will be in touch with both of those people you have suggested to everyone else who took the time to reply - your help is very much appreciated Any further help or advice any one can give is always welcome I will keep you posted as to changes in the situation Thank s again x
