  6. All results from a messy divorce. in all honesty, I couldn't say one way or another what the crack is as it's been 10 years, nothing is shown on my credit history for any of my debts. I think I may have been paying £1 a month to the account until a year ago when I changed banks and it appears it may have gone amiss. Somehow, I get the feeling that they won't be able to provide any docs as there's nothing listed on my credit file? I may be wrong of course,

  11. Hi all I've tried my best to have a read of the postings but am finding it all a bit daunting as nothing really seems to tally up completely with what I have received... I believe I'm doing the right thing in posting the below...but will also upload the letter if possible with personal details omitted of course. Name of the Claimant -------HFUKHIL (ex barclaycard) Date of issue – 08/08/2019 Date of issue 08th + 19 days =26th august + 14 days to submit defence = 9th september (33 days in total) - Particulars of Claim What is the claim for – the reason they have issued the claim? this debt originates from a written agreement dated 29/01/2010 between the original creditor detailed above and you. the agreement was subsequently terminated when its terms were not complied with. our client later purchased this account and it was legally assigned on 5/9/18. the notice of assignment has previously been provided to you. there have been no interest or administrative fees/charges applied to the account since we acquired it. you should note that this letter is being sent in accordance with the pre-action protocol for debt claims of the civil procedures rules. the court rules confirm the actions either party must take before a matter goes to court, we should point out that paragraph 7 sets out its expectations for you and our client in how to comply with the protocol. the full protocaol is available from the court service at https://www.justice.gov.uk/courts.procedure-rules/civil/protocol despite our client or its agents, robinson way limited, attempts to engage with you to agree a suitable payment plan, the above amount remains unpaid. What is the total value of the claim? £3950 Have you received prior notice of a claim being issued pursuant to paragraph 3 of the PAPDC ( Pre Action Protocol) ? Not sure what this means? Have you changed your address since the time at which the debt referred to in the claim was allegedly incurred? last change of address in 2014 Did you inform the claimant of your change of address? no Is the claim for - a Bank Account (Overdraft) or credit card or loan or catalogue or mobile phone account? credit card account (based on the account num provided When did you enter into the original agreement before or after April 2007 ?after Do you recall how you entered into the agreement...On line /In branch/By post ? I dont but likely online Is the debt showing on your credit reference files (Experian/ Equifax /Etc...) ? not a single trace anymore have checked all credit refs Has the claim been issued by the original creditor or was the account assigned and it is the Debt purchaser who has issued the claim. ----assigned to robinson way it seems Were you aware the account had been assigned – did you receive a Notice of Assignment? I likely would have but have been a head buried in the sand kind of guy Did you receive a Default Notice from the original creditor? again unsure due to time frame etc Have you been receiving statutory notices headed “Notice of Default sums” – at least once a year ? I have been receiving correspondance but again, head buried in sand numpty. I believe i was paying £1 per month to them up to a point but changed bank account and never updated which was around may 2018 Why did you cease payments? i would say around may 2018 purely due to an oversight as i was/am paying £1 per month to a few debtors resulting from a financially messy divorce What was the date of your last payment? may 2018 i belive Was there a dispute with the original creditor that remains unresolved? not to my knowledge Did you communicate any financial problems to the original creditor and make any attempt to enter into a debt management plan? was paying £1 per month to the debt until recently and didn't realise this is one that had got lost when moving accounts.

  15. Good evening, As below I have received this Parking charge notice from Parking eye. hopefully you can help. The notice was initially sent to my employer, they informed the company of my details and I have since received the letter today the event was on the 11/12/16 as per the below details and image. Essentially, I drove onto the car park, looked for a space for 20 minutes unsuccessfully so jumped out whilst my wife drove round looking for a space. I managed to get what I wanted before she found a space so got back in the car and we left. Do I have to pay this? am I bang to rights? image is attached... All help is greatly appreciated. 1 Date of the infringement 11/12/2016 2 Date on the NTK [this must have been received within 14 days from the 'offence' date] 30/12/2016 (was sent to employer first as car is registered to them) 3 Date received 04/01/2017 4 Does the NTK mention schedule 4 of The Protections of Freedoms Act 2012? yes 5 Is there any photographic evidence of the event? yes (well, leaving and entering car park) 6 Have you appealed? nothing yet Have you had a response? 7 Who is the parking company? parking eye 8. Where exactly [carpark name and town] walsall Crown Wharf shopping centre For either option, does it say which appeals body they operate under. There are two official bodies, the BPA and the IAS.   16. It is a new subscription hence the install issues. Therefore cant cancel. But thanks for the dismissive tone!

So this one is a big mess, and im gonna try and break it down as basically as possible. 28th jan: sky tv installed 9th feb: chAngeover of broadband from previous supplier to sky to happen 10th feb: contacted sky. BB not working, told would get engineer, 5 days time. 14th feb: TV also stops working 16th feb: 7 days since initial install date, no engineer. No BB. 17th feb, told another 3 days 18th feb, TV gets sorted by me doing update they suggested 18th feb: car stolen from house. My CCTV which runs through BB obviously unable to catch person due to BB failures. LIVID!!! 18th feb: openreach turn up. BB working. (too late) phone not taking incoming calls. Openreach guy leaves and tells me not to worry, will work in an hour.... 19th feb: still no incoming calls. So basically, I calculate my losses as follows... Line rental 10 days to date £6.06 BB 9 days £2.41 Sky tv 5 days £5 Xtra 2gb data for mine and my partners phone due to using more £30 Travel back and forth to mothers to use broadband each day (40p per mile) only 8 days due to car being stolen £25.60 Loss of use of Nowtv service didue to no BB 9 days £5.96 Xtra charges due to having to use royal mail for some of my ebay posting £2.55 Then we have the fact that I have no evidence of the theft of my car due to my cctv system running through my broadband. I have lost a car I owe £10,000 on, I assume the car will be valued below that. Causing a loss to me of around £2000 My excess at £150 The ridiculous amount of calls and messages and resulting time on lhone to and from sky to get the basic services sorted. So essentially what im asking is, what would you do in my situation. Obviously they're not going to pay for my car, they didn't steal it, but they were part of the struggle to retrieve the car or find the perpetrators. My car has not been found. Any help and advice here would be great. Thanks in advance
