I thought that if the Defendant does not reply by 14th Nov then judgement can be claimed, ie; Notice of issue states, Deemed served 31st Oct , The defendant has until 14th Nov to reply,(or 14 working days) "No reply at all" You may ask the court to enter a judgement using the request below. The bank will get 28 days from service only if they reply, that was my understanding at least, i may be wrong no doubt some one will tell me otherwise
  2. Yes it really is that easy, Filled mine in and received Notice of Issue back deemed served 11th Nov, so just waiting now. Remember to do 3 copies of N1 and charges sheet, one for Court, one the Court will send to the Bank and one for yourself. You have still got 7 days or so yet so they MAY pay you out sooner:rolleyes:

  10. You can book an MOT up to 28 days in advance of its due date. In fact it is not widely known that the expiry date on your new MOT is 12 months from the expiry of your old one. This means you could have an MOT that last 13 months. you also need to take you old MOT with you at the same time

Your daily rate of interest only applies to the charges as Thailand pointed out hence 70p, ie; £3165 x 0.00022 = 70p So claim would be "£3165 + 8% interest of £781.24 plus a daily rate of interest of 70p" I believe you will need an N244 which is in the templates library and the fee is £35 to amend your claim.

  13. Hi, If you still need to file your N1 then the sooner the better, like tomorrow, The value is basically to recover your costs while allowing you to keep out of "part 8". Remember it is the data that you require most so you can proceed to next stage, the money is secondary hence i only added a true cost of £10. You can of course start your bank charges claim using the statements you already have, and estimate the remainder, It is up to you, or wait until all the info is with you. The template is in the library for filling in the N1 and the N1 is available to fill in too, just remember when filling in N1 to print off 3 copies before you finish as all details will be erased Read through the template before you begin,then modify it to suit especially the parts in red, then just cut & paste to N1

  16. hi, Not to sure if you can file for this on MCOL because it is primarily the Data that you are after. You will need to give a monetary value of the claim otherwise it will cost you more in fees. Use the template http://www.consumeractiongroup.co.uk/forum/bank-templates-library/6971-data-protection-act-non.html to fill in the N1 form I put costs of 2 x Registered letters plus stationery at £10 to the "Value" on the form so it only cost me £30 court fee which of course you get back, the only thing is you will need to take it to your local County Court.   18. Thats the theory but but we all know the banks are doing this as their last parting snipe at us, it is up to us to take it further and complain about their abuse of the Banking Code, hence the FOS website

If your 7 days has passed with the LBA for Data Protection Act non compliance then you need to issue them with an N1, they are useless with the statement issue, you could try and email mailto:[email protected] first and explain that if you dont get a response you will immediately file in County Court. Hi Thomper and Phil That sounds good;) could we make a story of those names lol Try reading this link issue 48 - banking: when a firm decides to close a customer's account for more info, whilst it is obviously a retaliatory response to reclaiming what is rightfully yours ie charges, i would hope that you complain loudly to the FOS if it does happen to you. Sorry peeps been hectic with work which has made me neglect my claims a bit so just to update, Just finished preparing ANOTHER N1 for the Halifax with interest etc so that will go off on Friday, way over time i know, but... And to throw another spanner in the works the barstewards have sent me a default notice for my credit card, so looks like another fight coming on8-) I cant believe there is only mine (fame at last lol) with county court for Data Protection Act but stranger things have happened, like the banks paying up with the first letter:lol: The Information Commissioners Office has also sent me not 1 but 2 letters about my complaint, not that the banks give a t**s about them, but still nice of them to remember me. You can complain, just dont expect any miracles and file for County Court instead. Or email the now infamous mailto:[email protected] However if you need any advice as to what i put in your welcome
