Hello, I think you should check you contract since I believe there is standard wording in most leases which states that viewings for the purpose of re letting or sale can only be carried out during the last 2 months of a tenancy. I know this because we are both tenant and landlord at the moment. We are looking to sell the house we own but have been told that we would need to serve notice on our tenants before we could conduct viewings. Sounds like your landlord wants his cake and eat it - you paying the rent and the house on the market! Hope this helps
  2. Thanks. I have checked the lease, we do have a clause for Assignment. Sorry if this sounds like a stupid question, but does this mean that we must find a new tenant ourselves, and would they have to sign up for the length of the remainder of our lease?
  3. Hello, this is my first time posting, people seem very knowledgeable here so I am really hoping you'll be able to help me. We are currently renting a house through a lettings agent, we have been here for 14 months. We moved to a new area last year, and as so little was on the rental market at that time we very stupidly decided to ask for and sign up to a 3 year Assured Shorthold tenancy (this being the total time that my husbands job contract lasted). My problem is that we are unhappy and have the following issues: 1) We are unable to use the gas fire in the lounge as it has been issued with an unsafe to use notice after a Gas Safety check in August - this follows us first reporting a problem with it last December 2) The utility room has a radiator which has not worked the entire time we have been here - when we complained last winter they sent someone out to look at it but no repair has ever happened - there is a strong smell of damp and some peeling paint in the room. 3) During high winds cement is falling from the edge of the ridge tiles on the roof and it is only a question of time before it hits our cars - this was reported to the agent in Jan, they have never sent anyone around. 4) We have found out that we are not living in the school catchment area we want, and our daughter starts secondary school next Sept. 5) Rents locally have dropped and we are now paying too much (our fault I know!). Is there any way to get ourselves out of this lease before the end of the 3 year term? When we checked our lease it states in bold type on the last page "not to be used for agreements of three years or more which must be signed as a deed". Does this help us in any way? Do the items that are in disrepair give us leverage to get out? Thanks for any thoughts on this!
