  1. Hi, yes safe loans took me to court over £100! Ended up costing me £275 with costs/interest judge ordered them to take £25 per month till its cleared. I had all similar arguments with them that you are having and they just wouldn't listen.

As a self-employed person you will be Entitled to the full amount of maternity allowance which is currently around £128 per week, with regards WtC and CTC you will remain entitled to both as long as you are returning to work after maternity. I can't comment on housing and CT benefit as I have never claimed. Hope that hepls
  3. Just a quick update to say Brighthouse folded as soon as they caught sight of court paperwork! What a shame I had to go to those lengths
  4. Brighthouse will get there court paperwork early next week (I don't think they believed my threat of court), does anyone think they will defend it and happily go to trial? Below are my particulars of claim copied from my claim form The claimant wishes to claim a full refund of monies paid under credit agreement ref: 7xxxxxxxxxx as I believe the defendant is in major breach of contract under the 'supply of goods (implied terms) act 1973'. The subject of the credit agreement is an 'all in one desktop computer' which has been subject to 3 repairs and then replaced twice due to various faults. The item is yet again faulty so the claimant wishes to enter rescission (thereby ending the contract without penalty) and claim back all monies paid under it. The defendant again and for the 6th time in 6 months wants to inspect the item with a view to repairing it yet again depriving us of our much needed family computer for several weeks. We consider this Unreasonable and believe that the product has never been fit for purpose. Your feedback would be appreciated
  5. just had HO on saying they wanted to inspect the computer! yeah like i would ever see it again, they would just say no fault and keep it as by then i would be in arrears. what can i do to stop them coming to try and repo it? I have set up a court claim but they said they will continue there collections activity anyway.
  6. I didn't take any of there covers, didn't think they where worth the paper they where written on. Just spoken to a regional manager who spoke the biggest load of rubbish I have ever heard! Said he was very friendly with trading standards and that he would check with them that i was telling the truth! also he wouldn't refund me as all 6 faults must be user error and that he would check this with acer! I said your contract is with acer and mine is with you! What a goon he was! Hung up in the end cos I had had enough. Think I am just going to keep computer till they take me to court for repo order and get my point across then???

I bought a £1100 computer from brighthouse in july and in the 1st 2 months it had to be repaired 3 times, I got a month use out of it and then in November it packed in again I demanded a replacement which was granted. This lasted 6 weeks and at the end of jan went faulty it was 2 weeks ago replaced with the shop floor display model which when I got it home had a fault!!! We have now demanded a refund of the £401 that we have paid to date as the goods have never been fit for purpose. We spoke to store manager who wasted 2 days of my life telling me he would look into it, he then passed it to regional manager as he was unable to authorise refund he has now passed us onto head office who I will be ringing today. I have been told by both trading standards and oft that I am elligable for a refund as I have accepted 3 repairs and 2 replacements so have complied. My questions are Do brighthouse 100% need a court order to reposess goods even if you have not paid 1/3? Do I still have the rights under the sales of goods act to demand a refund even on a HP agreement? Many thanks in advance
  8. I have recently noticed that HFC added a collection charge of 16% (£700) on a £4000 loan. I wrote to Restons requesting that they repay this amount, got the usual reply 'its fair' 'its lawfull' etc they also sent a copy of the court paperwork showing that we agreed to the amount claimed (they got a charging order in 2006) That paperwork did not mention the £700 'collection charge' that had been added. I am now wanting to set up a court claim to request the 'collection charge' back but am struggling with what wording to put in my claim particulars. I have also noticed that the credit agreement (which HFC got my wife to sign 2 years after the loan was taken out by saying we would like to reduce your credit card and loan balance and pool them into 1 loan as you have been a long term customer!!! this was obviously because they didn't have the original agreements) is not dated anywhere on the agreement or where the bank have signed is this a perscribed term? Any help with either aspect of this would be a great help. Ian
  9. Is a BOS vailid if signed in my own home? Also if it only witnessed by the company rep? not a 3rd party. I have sold my car on to a dealer (at a reduced price) who agreed to clear the finance but never did, he has now sold it on but I dont want to leave the new buyer high and dry!! I want to clear the finance with the company involved to avoid them taking the car from the new owner but am looking for some ways to reduce the settlement amount i.e if they have made mistakes in setting the loan up etc. The loan company do not know the car has a new owner yet but I am sure if I refuse to pay they can locate it! Hope this makes sense.

Can you all check what you get from the details below and post your result it will really help me 1, Amount of credit £1460.00 2, Total Payable (1+5) £2466.00 Term of agreement 6 months APR 317.9% 1st installment £230.40 followed by 4 of £230.40 with a final of £1314.00 3, Interest £876.00 4, Doc fee £130.00 5, Total charge for credit (3+4) £1006.00 As mentioned your calculations would be very helpfull

Hi, I am hoping to go to my local county court 1st thing tomorrow and take out an injunction against mobile money taking our car, I want to stop them as I am disputing the loan, the way it was sold and the unregistered bill of sale. Reading the stories on here it seems like they still take cars whilst the debt is in dispute!! If anyone can help me that would be great- Things like What to put on the n16 claim form? Will they do it the same day? How likley is it to be agreed? Please help me stick one up this poor excuse for a lender as they have been shockingly awfull to me and my family.

Hi thanks apple and gees for your advice, what has happend is - my husband has a severe mental health condition meaning he would not have capacity to take out any type of loan in 1st place so they have prayed on this!! When i called and asked for time to pay as a result of this they actually laughed down the phone! even the chief exec. This is why I now want to get them at any cost!! He 1st signed for £500 on May 20th he made 2 monthly payments then was offered £1500 which was £500 to settle the 1st loan and £1000 cash advance. He was made to sign a new bill of sale and charged £130 to do so, this 1st bill of sale was reg with RCJ on 27th May so within the 7 days but the 2nd has never been registered. Our solicitor seems to think that when the 1st loan was satisfied the 1st bill of sale was cleared so now void??? is this correct or will it still stand for the 2nd loan? Please help as my whole case hangs on this, they have been so horrible almost like criminals, as well as my dissabled husband I have 2 babies and am pregnant so am not looking forward to dealing with bailiffs.
  18. can i take out an injunction to stop bailiffs coming to my home as the bill of sale was never registered (i know this makes my mm loan an unsecured debt but i've heard that might not stop em sending bailiffs...clare and ian

Hi there, really hope someone else knows something about this... my husband had taken out a loan with Mobile Money for £500 secured on his car and the bill of sale was registered within the 7day time period. however he has subsequently taken out another loan for £1500 and used £500 to pay off the original loan. although MM took the £70 registration fee from him for registering a 2nd bill of sale, they never did so what we need to know is-can the first bill of sale be transferred to cover subsequent loans? does anyone hav any experience of this?any advice greatly appreciated, clare and ian
  20. Hi, not logged on her for a while so sorry it's taken a while for response. They can make you an offer at any time even the day b4 a court case! just bear in mind that they will make u a low offer to start to see how serious you are, dont take any less than 60-70% imo. Hope this helps
  21. Claim the full amount of the holiday, use the words 'no fit for purpose' and 'miss-sold' and just state your case. They wont go to court and should make you an offer of around 50 to 90% to settle out of court.
