  1. ha ha ha, sorry but what you read in the papers and what happens in real life are two separate things. Her Union said there's nothing they can do so obviously there are no real "rights" in this situation. Best advice for future people: If you have mental health issues keep your mouth shut and try to blag it through.

Sorry I couldn't reply earlier but my PC died and I had to wait to get a new one and set up an new (lost) password for the forum. @sgtbush Jobs are not easy to come by; she has applied for many in order to get out of the dump but no luck so far. @Sangie595 Thanks for the advice. It just goes to show that all the stuff they say on TV about understanding mental illness and how you should explain yours to your employer is utter crap. Those who DO tell their employer about mental illness (or suffer with one) are kicked out. Perhaps someone should tell Prince Harry that before he wastes more time.
  3. My Mrs works for a large Cleaning company. She's worked there for 11 years. She did 9 years in a different section and was transferred to the section she's in after her old Supervisor seemed to have it in for her. Whenever she is ill or has holiday leave she goes back to find they've checked her work, found something and put her on an action plan to rectify it within two weeks. She breaks her back doing the work but still gets a 'PIP' warning, 3 of them and she's out the door. They never check her work when she's there; it seems like blackmail to not be ill or have agreed, planned holiday leave. They do it to all of their staff. Last year she went through a hard time and ended up having 4 months off with depression. Her boss and her Supervisor visited us 3 weeks into it and asked questions. When she went back she was told to sign a new contract (same job) and had to fill in a medical form in which she told them she had depression and epilepsy (she hasn't had a fit for years nor does she take medication for epilepsy). 10 months after that brings us to the present day. Last week she had a cold; knowing they were desperate for staff (I wonder why), she went in anyway and was allowed to go home after a couple of hours. The third and fourth day she felt worse and rang in ill. Lo and behold they checked her work and found something wrong (dust on something she was never told to clean). They put her on an action plan in view of giving her a PIP-1. They'll review her work next week. But in the meantime they gave her a 'Medical Consent Form' which basically grants them permission to see her medical record. It seems that they are trying to get her out for mental health reasons. With so much hype around mental health and how we should all talk to people and let our employer know, I find this a bit of a low way to push someone out of the door. She joined a Union but they've not been any good, giving basic, obvious, advice like "ask them why they want to see your medical record" and agreeing they do seem to be trying to sack her via a PIP-3 or medical grounds but saying the Union can do nothing about it as it's all above board. If she loses her job we lose the house. The company has a long list of people they've pushed out the door for PIP-3 / health reasons. Apparently the Supervisor has had 26 grievances against her and none have amounted to anything. Any advice received with thanks.

  6. A friend has chosen a business name which someone else claims copyright on: Name Of Business© How can I check if they have the copyright or have just added the © symbol? I Googled it and found a Gov site but that only lets you check TM's.
  7. A polite note would do no more than I've already done. They are clearly selfish people. They had parties Friday night and Saturday night; this weekend is bank holiday so I expect all three weekend nights this time. I wouldn't say I am intimidating, I'm 5'11", 14 stone so I'm average. When I did knock and complain I never saw the daughter, just the guy. I talked to him about the noise, I may have seemed a little ****ed off but I was not threatening, indeed, after I'd talked about the noise I asked him about the kitten he had in his arms. I could invite my friends around for a party in our back garden, some of them are very intimidating. But I just want a peaceful life, bit of quiet, I don't pay rent to live next door to a night club. As for "do you want someone to intervene", I don't know what you mean?

  9. We had some new neighbours move in about 3 months ago. At least 3 times per week they're banging, drilling, etc with power tools. They are fair to start and stop within working hours except once (so far) when the neighbour's Dad was making a fence in the back garden on a Sunday. I asked them to keep the noise down, they looked at me like a wan?@r and said "It's finished now anyway". They have parties once a fortnight where they have friends around for a drink and loud talking in the back garden until 11pm when they go indoors. To be fair it's not like I hear much when I'm in my lounge but when I go into the kitchen the noise is disturbing. I am often awoken around 1am after these parties by them slamming doors. I've complained to them a total of three times, that one time to the neighbour's Dad on a Sunday, and twice to the neighbour. Each time I've felt like I'm the bad guy, I guess after all they are working on their house and the parties could be a lot worse. Yesterday the neighbour's Dad came round and told me they'll be having a party that night and tonight (Friday night and Saturday night) and that it would end at 11pm. I thought fair enough until he said he'd told me this because he "Wont have my daughter intimidated". Intimidated? "By you going around complaining about the noise". I said "There are laws about noise". Funny enough, the 2 times I've knocked and complained it's been the neighbour's chap come to the door, not her. I think I have been fair, it's not like I went around there shouting about it, the times I've complained I've kept it pretty laid back so I don't see any intimidation, on my part at least. So now I'm thinking maybe the Dad thinks he's the hard man and he's basically telling me not to complain about the noise. Who's the d?ck here? Me for being a Victor Meldrew??
  10. Just to update, my partner went back to work last week. They've moved her to another area and she seems happier. She still has the same Supervisor and feels that the recriminations will start soon but, touch wood, all is ok so far.

They came a few days ago and were overjoyed that we presented them with a few options - one of which was for my Mrs to start at 6am thereby making it easier (and avoiding the Supervisors monaing) to get her job done before staff come in and wont let her clean their offices. At the moment she's got the Dr experimenting with pills that will help her depression and let her sleep. She's on 45mg right now and if they don't knock her out.
  12. She wants to be moved to a different part of the building. She was happy when she worked in the gym but they moved her because she couldn't start at 6am (no bus). I told her she should tell them about the bullying and inconsideration that goes on with her supervisor but she's adamant if she spoke up they'd drive her out.
  13. Thanks Sanjie. Ok, the manager came, talked to my partner and took some notes, then OH called a few days later and my partner talked with them. OH sent a letter to her manager (and a copy to her) saying she is depressed and can't work, and that they'd phone her back in a month (which will be this Tuesday coming). Her manager has also made an appointment to see her (in our home again).
  14. Before you all get into a bun-fight, I would like to say I appreciate the advice I've received. I have no problem with any of the views that have been expressed so please don't fall out on my behalf. I completely understand the employer could sack on the grounds of incapability, but what we are trying to do now is ask them to move her to a different job within her place of work. I understand this is not ideal but tbh the job has given her pretty bad depression, she's now on 45mg ant-depressants (was 15mg). She has broke her ass trying to get another job and just doesn't even seem to get a reply; in about 40 jobs she's gone for she's had one interview but the job wasn't for 30 hours as advertised, it was 18. As far as losing the house is concerned, housing benefit would never cover our rent, the maximum they pay for a couple is £96 a week and ours is more like £165 a week. I would never leave her, that was anger, sorry! I appreciate all of your honesty and hold no malice against anyone on what is a fantastic forum. To update anyone who might be following this - we've had a meeting with her employer who came to our house, talked to OH and are now on the second round of that. OH is calling on Monday and my partner will then explain her tablets have been upped and, given the one month the Dr reckons will take for the higher does to take effect, she'd be happy to go back to work if she can be moved. (Obviously that last part could cause contention).

Thanks Sangie, appreciate the to-the-point tips and advice: - My Mrs seems to believe she can't be sacked while she's on the sick and that can be up to 23 weeks sick. which ends on 4th October 2017 and that if she's sacked while sick that's unfair dismissal. - It would not make us better off financially if I worked as that would mean losing the PIP and Housing Benefit etc that goes with it. The only solution is for her to talk it out with OH and perhaps ask to be moved elsewhere (or to find another job). ? Appreciate any advice from anyone
  17. Hopefully someone is still reading this. I am worried. She got a letter today saying that OH will phone her 2nd June to chat and write their report. It's a "Mr" phoning her, not a "Dr" so I have the suspicion it will be more a case of them looking to get rid of her. If so, we lose our house; we're just about managing now she's on the sick and if she gets sacked we're fkd.
  18. Yeah, I'm just wondering if she should tell her Dr to send the notes rather than leave it to the company's OH who will no doubt be biased?
  19. I'm guessing they requested all her records in hope of finding some way to get rid of her which they have a record of doing to their staff when they go sick. My partner is looking for another job now but, despite what the government tell us, can only find a 15 hour job, anything less than 30 hours and we lose our Tax Credits = lose our home.
  20. Ok, just to update you all, her supervisor and one other came to our house and talked a bit. They then got my partner to sign a form consenting the company to contact her Dr for her records. She saw her Dr yesterday who said he has refused to show them her records. I think this is a bad idea as the company will now have their own Dr examine her, my suspicions are that their own Dr will be biased.

In reply to Sangie595's post (thanks), I feel that if she were moved to another part of the workplace her depression would improve; if they refuse to move her then I honestly can't see any favourable outcome. They'll probably just find an excuse to sack her anyway as that seems to be the way they work. It's shocking how little rights employess have, and how companies like this seem to always have the most rights; for instance take a look at this article where the employee swore once and got sacked, yet you say her boss can get away with it! Interesting, but these solicitors say it could be a case for constructive dismissal. Still, I guess it only works when the big mouth is the employee not the boss. I'll post again once they've been.
  22. Thank you for your time and advice. We're looking for some general advice on this issue regarding my partner who is off work with depression caused by her workplace. The employer has told us they will visit this Thursday to "discuss her absence". Here's a bit of the back story: Mt partner is a Cleaner. She is off work due to depression, this was caused by her undergoing treatment for recurring miscarriages and her Manager moving her from a job she was happy in to another part of the company where it is very quiet, no interaction and a totally different world than where she had been. My partner asked to be moved back but was told it is not possible. She thinks she was only moved because her Manager had to cover 6am to 7am as she couldn't get into work for 6am. Funnily enough, the person who took my partner's old position starts at 6am (!) Events and Mismanagement that has led to my partner's Depression: 1. She was late for work twice when the buses here were effected by a huge amount of roadworks (which was front page news). Her bus simply didn't turn up two days in a row and she had to wait for an alternative bus (the following days she caught a taxi rather than lose her job). Both times she rang the Manager and let her know. All seemed okay until over 2 weeks later when her Manager issued her with a stage 2 warning for absence (not even a 'late'!). Luckily I was able to speak directly with the city bus manager who kindly emailed a letter explaining the missing buses and her Manager took the warning off her record. It was like a letter from Mummy for not having a PE Kit! 2. A few days later (revenge?). My partner received a printed warning document detailing things that would need to be improved in her cleaning duties. These included a set of stairs that experience 24-hour high traffic from hundreds of staff which she was warned were dusty and dirty. She was told another inspection of her work would take place on 4th April and if it wasn't satisfactory a PIP Procedure (warnings that can lead to dismissal) would be put in place..skipping the written warnings stages completely! Two weeks later she had the Thursday 23rd and Friday 24th March 2017 off as holiday. My partner went back on Monday 27th March 2017 and was called her into her Manager's office and told that the showers had body-fat in them, even though she had worked hard to make everything A1 before her days off. Her Manager then said "Just because you signed that warning, doesn't mean you can F?cKing slack off anywhere else!" (Bullying?). 3. Two days later (29th March 2017), My partner had a small operation to investigate the fibroids the hospital believe have caused her recurring miscarriages. She was not allowed this as unpaid leave and had to work before going to the hospital. She had to go work the day after the operation too. On the day after the operation she was taken home by the people she cleaned for in FOST and they phoned my partner's Manager to complain; which no doubt will be mentioned in the absence meeting and my partner blamed for it! Anyway, that date was 30th March which was the last day she worked and has been off with depression since. 4. On 24th April we received the letter saying they'll be coming to our home on 4th May 2017 to discuss her "illness, current health status, long term diagnosis, current abilities and when you might be fit to return to work. And also to gain authorisation to contact your GP for a medical report." - We appreciate any advice you can give and for reading this long post. If you can advise on what we should do at the 'Meeting to Discuss Absence' and whether we should print off this post and discuss it or if that would probably mean them finding an excuse to get rid of my partner? She has had depression all the time she's worked there (10 years) and never had long-term sick so could they sack her for depression knowing she has it anyway (last year she had a miscarriage and went sick with depression) Would she have the right to be asked to be moved and, if so, would they have to move her to a post that has the same hours/amount of hours? Staff who have complained in the past have always ended up sacked Finally, their letter says she can have a member of staff/Union Rep (unfortunately not in a union) at the meeting but I intend to be their. It is our home so can they say I can't be there? We will also be recording the meeting, as it is our home do we legally have to tell them so?
  23. So even though they eventually agreed it Statute Barred, it's still okay for it to appear on her Experian credit thing?
