  1. What happened with this? Did you do another IA to have a Commissioner appointed?
  2. Note - in Scotland its 5 years not 6: the Prescriptions and Limitations Act - they either have to raise it in court or you have to acknowledge it as a debt
  3. Is the assessment on behalf of your own insurer? If it's for the other side's insurer, don't go! Speak to a personal injury solicitor - if you have legal expenses cover your insurer will put you through to one. If not, seek out one of those who will pursue it for you under some kind of fee arrangement.

Read the agreement! - it warns you that you might face penalties if you use it - not that Breitling will sue you, but that whoever tries to rescue you might (hardly surprising if they spend £5k or whatever trying to rescue you!) - it lets you know that it is expensive to reset and it will cost you a lot to have it done if you set it off when you shouldnt and here's the biggie: - if you use it properly Breitling will recommission it for free. So... it's a good agreement, not a bad one. Just because it warns you there are consequences for your actions, doesnt mean Breitling will sue you!!
  5. I have a flat which I rent out, which I bought in 2006. I've never lived in it and it has been rented since just after I bought it. Last year I got a bill for 2006-7 for £140 outstanding council tax, which I didnt think was right as it was unfurnished until it was rented out, but the agent paid it. Have just had another bill for £130 for the same period. Dont know how that can be possible! Any advice? Anytime I have spoken to the they have been less than helpful!

I think that the person who was driving the vehicle, in terms of the Road Traffic Act, is responsible for contravening signs restricting parking - same was as the driver is responsible for speeding - ie the liability for it rests on the driver and cannot rest on the company that owned the vehicle or employed the driver etc. This means that it is irrelevant that the company ceases to exist. See s.36 of RTA88. As it's not then a debt of the company, limited liability is irrelevant. It's the driver's own personal debt.
  8. Your relative should have made an appearance at the small claims hearing to say "the papers havent followed" Is this is Scotland or England?
  9. Not as simple as it sounds... In Scotland anyway - whilst title stays with the owner... if it has been modified, eg has a new engine, fancy wheels, new sound system etc - you do not automatically get them - they're not yours.
  10. They refused me a refund because I had a charge refunded a few months ago (for something that was not my fault!). Recorded delivery letter on way to Borehamwood complaints department...! Will see what happens!

  12. Am going through it step by step... Branch manager asked head office (as manager cant do it), head office said no Asked customer complaints directly. They will investigate and write back within 5 days. (I'll not hold my breath!) Then will start the ball rolling! Thx
  13. This month I had a whole bunch of unpaid DDs with RBS (and lots of charges) but I had no idea about them. Up until now the bank has always called me in advance to tell me that I was going to be short, giving me a chance to transfer money over in time. The branch manager told me they have changed this policy - but didn't tell me... As you all know, when you call direct banking, they wont tell you unless you specifically ask. I always just get the balance - within the limit = OK - but didnt know that there had been returned DDs. Never needed to ask as the bank always called me... I'm supposed to have a Relationship Manager with my account - who would have told me - I pay for a Relationship Manager on Royalties Premier. But despite me asking often, they have never found out who it is, so s/he couldnt advise me. It's almost like they're concealing the problem, or at least making it difficult to know whats going on - the very opposite of mitigating your losses! And why did I not have enough in that account? Because I had applied for a loan with RBS and they didnt get back to me to tell me the outcome. While I was waiting I didnt apply elsewhere. It took almost 3 months to get the answer, even though they decided immediately. They have apologised about that. I have since arranged finance elsewhere (without a problem) but if RBS had told me at the time that they declined me I could have arranged it months ago and avoided this whole mess! ... Anyway they say its not a bank error, its all my fault. (for not knowing they had changed their procedure without telling me?) (for concealing the problems?) (for causing the delay in getting funds)
