    That's what confused me as well from my credit card company. They essentially said that as long as the product was as described they cannot assist. They're not lawyers so don't get involved in patented disputes and it's up to me to prove that i was mis-sold.

    Some of the details of the text lead me to think that it was just a scare tactic, i cannot prove this either way. The wording of the message is just too coincidental to be random, and that i've never received anything similar previously.

  2. Thanks for all the responses, let me clarify a few things.

     

    I'm not being chased by the patent holder, they've just stopped me reselling the item i purchased by reporting the advert listing. Backed the report up with the various patent numbers and detailed description of the patents that have been breached. I've had my advert taken down from eBay and Gumtree.

     

    The company i purchased from Gymzo, are the ones who mentioned getting their 'criminal investigation team' (laughable) involved if i done credit card chargeback. They're unwilling to assist in providing original product description or images and just state i'm outside their 30 day return period.

     

    My credit card company won't assist without original page screenshot, citizens advice saying i don't really have options and the original seller not assisting, i feel like small claims is the only option but unsure if i'd be successful.

     

    The product i purchased was branded differently which is why i feel it is a knockoff rather than a counterfeit.

Bit reluctant to give the company name at the moment as i've already received a text message from someone asking for my email address so they can serve me documents regarding legal proceedings from their client. Text didn't include client name, product or anything else so blocked the number thinking it's phishing.

     

    Item was adjustable weights for £439. I received notice from the patent holder regarding everything that was patented. Checked the patent numbers, saw pictures and everything looks virtually similar, plus the company didn't dispute my initial queries which is why i think they are a knockoff.

     

    The issue i've had from Citizens advice and my credit card is that this can't be classed as fake (counterfeit) because they are branded differently and not trying to be sold as the patented product. There are loads of information online regarding counterfeit, but very little on knockoff products.

  4. Earlier this year i purchased something, which after a few months i no longer required. Tried selling them in various places online but they got taken down claiming to be imported knockoffs of another patented product.

     

    I reached out to the UK company i purchased from but they refused to acknowledge any patent issues, refused a refund and any assistance.

     

    I then stated i'd escalate via my credit card and the company threatened legal action if the payment dispute was to be successful.

     

    I've done my research and the product seems to be a knockoff and protected under patents, which means they cannot be resold. Been getting mixed responses from various people, some saying go via small claims court and others saying not much can be done.

     

    Should i just accept the loss or would i likely win in small claims if i can prove using the patent numbers that the purchased item was a knockoff?

  5. This was the Harrow on the Hill store (not Debenhams one).

     

    Regarding the brand, i already considered going direct to them, but quickly realised after browsing the website that is was awfully similar to the SportsDirect website. Didn't take long to realise Gelert are owned by SportsDirect.

     

    Almost gave up caring as they are so cheap, but considering i need them next week, going to stick to my rights.!

  6. I purchased 2x hiking sticks from Sports Direct 2 months ago. Whilst using them i realised one was longer than the other. Upon further investigation i realised one of mine was missing a piece to make it complete.

     

    Few days ago took it back instore asking for a replacement of the same product but was told that SportsDirect only offer 1 month warranty on all their products, even if they are faulty. They basically refused all service on the matter and was told something identical at a different store.

     

    Are they correct in only offering 1 month? As i thought warranties were supposed to be 6 months

  7. I deposited some money to an online trading account who have an operations in the UK.

     

    This was about 7 days ago and i have come to have some reservations about the company. I am trying to withdraw my funds but according to their system they charge a £25 fee for withdrawals.

     

    Do i still have a penalty free option for 14 days using such a service or am i liable for the fee.?

     

    Not sure if this is in the right part of the forum but any advice would be useful.

    It is such a small amount, and the only reason why i now want the full amount back is because they tried it on with the £15 admin fee, which i said was quite ridiculous. I was willing to accept the £10 up until that point.

     

    Just a quick update, they have acknowledged the £15 fee was incorrect and staff member was misinformed but the £29.95 charge will stand because that is what the original agreement was, and they cannot alter the agreement down to £19.95 because i haven't agreed to it, and all existing members will have to pay the higher amount for an extra month. Could this not be classed as discriminatory against existing members or am i clutching at straws? £10...is still £10 :)

  9. So on 01/08/14 my local gyms price went down to £19.95, yet I was still charged my original price of £29.95 on the same day. I have been told by customer services that they will not refund this.

     

    On top of this, when I asked about the membership pricing update, I have been told that all members have to pay a £15 processing fee to get the price updated to the cheaper amount.

     

    Just doesn't seem right to me, am I right in complaining about the £25?

  10. What is far more likely to stop your claim is a lack of evidence. What's to say you didn't cause the injury at home by eg video gaming or a rubbish chair? No ergonomic assessment, no doctor's report while at work, no request for reasonable adjustments = no opportunity for the company to act. Unless you have something saying the employers action or inaction caused the problem?

     

    almost no chance of a claim succeeding I'd say, but try a no-win no-fee for a second opinion.

     

    Yeah alot of people have said need evidence, but there was also no training from my employers what so ever regarding computer use, breakage etc. Plus i advised my doctor that the pain initiated from work and progressed to other areas after months.

  11. Right i have been suffering from RSI from work, standard mouse and keyboard stuff and work were aware of the situation.

     

    Upon leaving recently i did not make my employers aware that i was going to potentially seek legal action, only going to proceed if im entitled.

     

    Anyway upon leaving i was given a signed letter by my director (not signed by me), nor explained to me which stated the following:

     

    "Please note that on acceptance of your final wage you agree that you do not hold any outstanding dues against (company name)"

     

    Is this legal and can it protect them from any workplace injury claim? Was really peed when i finally read the letter. :-x

  12. Around 14-15 months ago my brother started having serious upper back pains. After going to doctors they noticed a vitamin D deficiancy and put him on tablets. This still didn't sort his problems and after numerous checks and x-rays they just put him on pain killers for all that time, and as a result he was in pain everyday.

     

    About 3 weeks ago he had an MRI scan, admitted into hospital the same day and pretty much into quarantine the day after as it turned out he had spinal TB. As a result of the damage caused by the infection he had to be operated on and a titanium bracket was placed into his neck.

     

    Alot of people have told him to seek compensation, however he seems abit reserved about the whole thing. Would i be right in saying that if he was to proceed he would be successful in pressing charges as going such a long time with a serious disease undiagnosed is unacceptable. :mad2:

  13. Hello all.

     

    yesterday i went into Tesco and bought 2 ready meals with 2 jacket potatoes each. I took them home, ate one happily and a 10 year old ate the other one.

     

    It wasn't until today that i was informed that the use by date on the outer package of the ready meals was 22 Oct 2007. My first thought was that this is a printing error, however it might not be and a year is a seriously long time. I have checked both packages and they say the same thing.

     

    What can i do about this matter?
