  1. Ok i may need some help on this one if anyone can please. I have spoken to one of the directors yesterday and she said she would find out what has happened and get in touch with me today. I have just received a call from the same director stating that i am not not entitled to any final pay because. 1) I had 4 weeks from work as my daughter was ill, and i was paid in error the following month. So my employers were going to take the money back as i took holiday ie unpaid. 2) They stated that i verbally agreed to this to her and the hr rep (why did this same director not remember this only yesterday? because it did not happen) 3) I had to give 5 days notice so i lose the extra week i did before my contract was terminated....now in a letter i received from them it states that i do not have to work out my notice and i will be paid that. Surely they can not get away with this? i NEVER verbally agreed anything.
  2. Most will have read on my precious thread that i had my contract terminated from my last employer. Now i was due to be paid on the 28th of this month, but no monies were paid into my account. The last letter i received from my ex employer was that i would receive any monies owed into the account they held on file for me. I contacted the paymaster but he was in portugal on holiday. So i rang the company to find out where my salary was. I was told that they would need to get a breakdown from the paymaster to action myself being paid. Now for me this is no good, i was due this money two days ago. They have had a month to make sure this was all sorted due to my contract being cancelled just after my last pay day. Can they do this? and where do i stand as i have bills to pay and no money from them.
  3. Im taking the car to a tyre specialist tomorrow so i will know then. I will update when i know.
  4. Ok i made a post previously regarding a private car sale to myself. Now in the last day ive noticed that i had what i thought was a puncture, after taking the car to kwikfit i was informed that the passenger side rear alloys had been welded recently and that was why they were flat as the weld job was not very good. Also i was informed that the tyres were not the same ie there were different size tyres on the front and rear. I was told that the car would fail an MOT on this alone, and was a big no no. Now i bought the car in june and the MOT was in April, and there was only the owner i bought the car off had owned it in this time. So the guy at Kwikfit told me she must have had her brother (who was a mechanic) swap the tyres over for the MOT and then switch them back afterwards. Apparently this is very dangerous and she must have known about this. Have i any legal redress for this at all?
  5. I bought a bmw from a private seller on the autotrader. When i first went yo view it i did the usual checkes for dints scratches, obvious things like water in the oil. And took the car for a test drive. Now there was a service history up until 3 years ago, and the woman assured me that the car had a service recently (because i checked the oil and it was clean i assumed she was right) i asked if there were any problems with the car that she knew of, she replied there wasnt. I did a hpi check and this came back clear....only thing was a private palte change which i knew of. Now, after a few days of having the car, i noticed there was a slight rocking to the engine, my brother was a mechanic so i took it to him to check it out. The oil light had also come on which made me wonder seeing as though i had been told it had been serviced. He suggested taking it to a bmw specialist which i did. The car has been booked in for tomorrow as he says the car is missfiring but he needs to see exactly why. Also the car is 3745 miles overdue its service inspection II. Which obviously means the woman was lying and not in any way confused. I got her to sign a bill of sale that i got from the hpi check site. And on there it says she states there is no work needed to be done to the car. Now if she had told me these things needed doing then i would still have bought the car but insisted on a reduced fee to cover the repairs needed. Do i have any recourse for this at all? i have her address and she works in a well know high street bank so i know she wouldnt want me turning up there dissputing this. I have tried calling on the phone and texting but to no avail.
  6. Hence the reason i was going to " barter " with my former employers and call their bluff rather than proceed to the HSE. Regardless of how bad they have treat me, there are peoples livelyhoods at stake here and i would not want to jeopordise that.
  7. No i ahve not attended the course since, and yes i am still in possession of the doctored certificate.
  8. Im absolutely 150% positive, as i havent attended the course. Everyone who attends the course has to be verified with id and their course number. This goes back to a central office and this is checked religiously. If it doesnt match in anyway it is returned and investigated. Now ovbviously my cert was never sent to the records office, just given to me for when i worked on contract x (where they were not checked on site) but then i was moved to contract y (where they would be checked) EDIT Also only my cert was doctored, the reason being i was away when the course was run. So while they tried getting me on to other courses i was to use the doctored cert.
  9. Hi Honeybee. RF is radio frequecncy awareness, it is to do with HSE, and something like this i guarantee would get the company shut down. It would mean me working on telecomms sites with high-very high RF output which is dangerous if dealt with incorrectly. Now my former boss edited a RF awareness cert and changed the last number and put my name on it. When all the certs had to be updated he did make sure that one came back as i think he was a little worried with everything ahd gone on, but i had made a copy before that. What am i aiming to get from this info....just a better settlement package than one weeks notice seeing as though i have to give them four, and a good referance.
  10. Well i may just have an ace up my sleeve. I have a certificate given to me by my boss which was a forged RF awareness certificate to use until they could get me on a course. This is a BIG no no in my line of work and can get the companies contracts terminated. How would you suggest i use this information?
  11. Well i have found out from a former employee who left before. He did say that in his opinion they were looking for a reason due to the location where i lived. It was getting more difficult to get me out on on call jobs as most were in the merseyside area whereas i am in the west yorkshire area. A few things are becoming a little clear now. Very underhand in my opinion and i can do nothing about it. I do think it is very unfair having to work for a year before having any rights, if i have a permanent contract after probabtion then as far as im concerned i should have rights.
  12. So even though i had successfully seen out my probation and then some, i still have no legal rights whatsoever? not shooting the messenger, it jsut seems ridiculous that i have to be there a year before i have any rights.

Hi thanks for the reply, well its pretty much to do with the previous thread http://www.consumeractiongroup.co.uk/forum/employment-problems/260457-suspended-work.html But surely they must go through the proper procedures of a verbal warning first? i was told that if there were any problems then HR would and should be there. This never happened here and i felt intimidated having to head project engineers on a one way send conversation with me. I felt it was not dealt with correctly and had it been then we would not be in the situation we are now.
  14. Hi and thanks for the reply, yes this follows on from the previos thread. And yes i still have the letter stating that my probation was fine and that i was now a permanent member of staff.
  15. Further to my query regarding a problem with my employer. I today received a letter from the company stating that my contract was terminated and i have been given one weeks notice which i do not need to work. However, there was no reason given as to why my contract has been terminated, i have been with the company 8 months and my probabtion was at 6 months. I was notified at my 6 month point that i had fullfilled my probationary period and was now classed as a full time employee. Surely they can not do this can they?

This meeting today was kind of related to the suspension, as they mentioned the leaving site ealy incident (which carried no warning in anyway) and after the suspension i was told there was nothing to follow up, and that i could return to work immediately which i did. I had been with the company 7 months.
  17. Ok so after the meeting with my bosses and HR it would seem that it was something and nothing and there was no reason for me to have my contract terminated. However, lately i have had some personal problems and not been in a good place, so my work standard may have dropped a little (understanable if you knew the reason) now, on friday all the other engineers had been thinned out and gone home, i had completed every job given to me and assumed that everyone had been thinned out. So today i am called into a meeting with the two project engineers and asked why i had left early, i gave them the reason i already outlined and then it felt as though i was being bombarded by both of them unfairly i felt. Eventually they found my breaking point due to the personal problems and i told them so, i left the building to try and compose myself and ten minutes later i went back into the office (boardroom where we were before i walked out) and they were gone. So i rang my boss rather than go up to the office as i was still a little upset, no one answered, so i stayed a further 20 minutes and also rang the HR supervisor (as she had stated if there were any further issues then i was to ring her immediately) she herself did not answer so i left the office to go home. I felt this was completely unfair to have no representation after everything i had gone through (personal issues) what i aim to do now is wait for the HR rep to ring me back, if this has not happened by close of play today then i shall ring my bosses and explain that i feel the situation was dealt with unfairly and a HR rep was not made available as i was told earlier. I am however scared that i could be dissmised from my job immediately, or does this carry a written warning?? any help appreciated. Thank you EDIT The project enginee ang me to say there had been a meeting and the result my contract would be terminated. I have to wait and see what it says in the letter, but suely i should have received a written warning and not terminating my contract like that?
  18. I had no idea whatsoever not even a clue. Im on full pay while this is investigated. Its the not knowing what im meant to have done, going a whole weekend not knowing is not good.
  19. I was called into the office this morning and told i was being suspended from work pending an investigation. They would not tell me why i was being suspended though. Can they do this or do they have to at least tell me what im meant to be accused of?
  20. Im asking on behalf of my girlfriend. Now she has teo children aged 6 and 7. And she was called in for an interview today, from what my gf tells me the system is going to change as new laws are brought in. She said that she was told she must have either a full time college course or emplyment in 6 months, and that she will no longer receive income support after 6 months and that she will receive jsa. Also she was told that if she wished to go the college route then this would only be funded by them if she enrolled before the 6 months is up. And if she didt then they would not fund any further education and that she would be on ehr own. Now, sometimes my gf does not take in everything that is said to her which is why i am here. I work full time and do not know the system at all, but she is due to move and i said i would provide the bond and 2 months rent etc. But does this mean she will receive no income and that her rent will also not be paid via benefits? this has me worried as i help her as much as i can but if this is the case then i dont know where i would find the extra income to help ehr and the kids. Any info would be greatly appreciated.
  21. My appologies if this is in the wrong section, as i could not see where else to put this. Ok, so in may i wired £631 via western union to China for some electrical equipment, not long afterwards the supplier informed that the name was wrong and could it be changed. So i went into western union and informed them of this and they said the name would be changed. It was not, so a furhter five times i asked for this to be done and it never was. I then cancelled the order as i was going to work abroad, i returned and went into western union (managed by finit) to request my money back minus the charge. After a lenghty run around, the western union agent said the money had been picked up on October 16th. Now, the name was wrong on the slip so one of two things have happened (according to the agent) 1) The supplier had seen the MTCN was still active after so many months and a "friendly" agent had let them take the money. 2) Someon has used either no or fake docuements to collect it. Either way Finnit in my opinion are liable as they have not checked any docuements used to collect the money or they would have been refused. Now if this was a small company in China i would assume i could kiss my money goodbye, however this is a large company which somewhere along the lines must have someone to answer my questions and refund me my money due to their lack of checks. Do i have a case here and if so how would i go about it? I still have all the original paperwork and signed statements from the original western union agent from my loacl corner shop to verify what i have said.
