  1. Im not to sure who the third party insurers were, and i can not believe the solicitors are just blatantly ignoring me, im sure this is theft. Ive info informed them i have not received anything and they have done nothing. I did contact the financial services ombudsman and they can not help but did direct me to the SRA and ministry of justice. This has REALLY got me mad!!!!
  2. Contacted them again today, and said that this was taking way to long and a week had passed since i last contacted them. I was told AGAIN that someone would ring me back.......an suprise suprise nobody did. I REALLY need some advice on this please if anyone can help??

  4. They claim that its an insurance cheque so they need to contact them and get them to send another.....me thinks that the insurance company may not be to pleased at the solicitors sending a cheque out from them via second class post.....am i correct??
  5. Apologies if in the wrong section, but i really could not see where else to post this. Long story short....last year i was hit by a car (i was a pedestrian) it went through their insurance company on a no win no fee basis. The third party insurers wanted to settle full and final payment for £5265 to which i agreed. The firm dealing with the claim said a cheque would be sent out. Ten days later i had not heard anything so rang them back. The solicitor who was dealing with it had left, but the notes had said the cheque was sent out on the 14th (last month) and to give it a few more days and if it had not arrived then to contact them again and it would be sent again signed for.....i asked how it had been sent and was told second class...........second class for a cheque with that amount i asked....yes it was standard for firms to do this i was told. When i finally got hold of someone again at the office and said this cheque needs to be stopped and another issued, the solicitor i spoke to (as the person who would now be dealing with my claim was away on leave) said it can take two weeks to cancel and order another cheque........surely this cant be right.....second class post and then in total another 5 weeks after the first cheque was allegedly originally sent. Has anyone any advice on this as i feel i am well and truly being given the run around.

  7. i used to ahve two Virgin contracts, one for me and one for my mum which i paid both for. Now after the 18 month contract had finished, i cancelled mine as i was moving to 3 as my fiance was on that network also. But i carried on the other contract for my mum. A year later i found that Virgin were still taking the money for the contract that i chose not to continue with. I contacted Virgin and they said that i should put an indemnity claim in with my bank and that they would make sure that the contract would be taken off their records. I did this and received the money from my bank. A week later i received a phone call from Virgin saying i owed them for the contract, after a lot of passing around departments, they agreed that it was a mistake on their behalf and they would make sure i stop getting calls. Everything was fine until 2 months later there was another call saying i owed the money still, now i went through it all again with them and said this had better stop as i owe nothing... ....in fact, virgin still owed me some money. Recently i received a letter from a collection agency saying i owed them the years contract money, i rang them and explained they need to contact Virgin as i do not owe it, they said they will look into it. Another call to Virgin and the guy there was helpful and said it should never have gone this far as i simply dont owe it and gave me their address for serious complaints, Now i cant contact the collections department until monday when im off as they close after i finish work. Is there any advice i can get before i contact them and send any letters regarding this? i haven't checked my credit record yet but im assuming this will be on there now. I am NOT happy at all. Also forgot to add......i never missed one payment for any of the contracts or was even late when i ahd them.
  8. Yes i can get the infor regarding the car being written off no problem. The woman i spoke to said that they would have to get the information needed from the clerks paperwork, i have no experience in this so dont know how about asking. Can i just ask? is there anything i need to fill in to ask for them?

But just because the date says 4th june (that ive been told by the courts) i need the paperwork that states exactly what/when/where so that i know if the car at that time had been written off.....as it could have been earlier than June 4th and that was when paperwork was sent. How can i ask the courts for a copy of this?
  10. The car was written off in late April, and yes, the court has said that June 4th was the date of the alleged offence. But is it possible that the incident was before June the 4th, and that was when it was entered?? this is why i need the paperwork as this is all a bit vague. There are as i say, even no details of any vehicle on the summons, yet they want me to say if im the registered keeper. I dont want to fork out £700 for a solicitor if i can do the job myself with this. I have no idea as to when they say any correspondence was sent, and it also went to my old military address as i have said. I had no redirect for the address in Blackburn as i notified everyone that i was moving in plenty of time.
  11. Just a little bit of advice on this one. I recieved summons to say i have to pay a £625 fine for failing to provide details of the driver. Now, i live in Yorkshire, but used to live in Lancashire and the alleged offence was in Lancashire. So....this took me by suprise so i rang the magistrates and they advised me it was imposed on the 12th jan this year.....but the alleged offence was 4th June last year. Also the summons says absolutely nothing about whether its speeding/gatzo/fixed camera or anything really. And it also asks if i am the registered keeper of the vehicle......but yet gives no vehicle details. So i ring Blackbutn magistrates courts a ring and they say there is no more information on their screen, they would have to get them from the case papers, and didnt even seem interested in giving me any information at all. Now the registration plate of the car they mention was written off in April last year but the offence was 4th June......doesnt seem to amke sense. How can i get the paperwork the magistrates courts hold on this as this is due to be heard on the 21st this month. They arent being very helpful in this matter at all.Also, the details of this were never sent to where i registered the vehicle as also on the V logbook, it was sent to an old military address that i had not used in 5 years. What i need to know is, was the actual alleged offence on the date i have been told by the courts, or was it earlier....and i can only do this apparently by getting the paperwork from the courts.

  13. My appologies, i have spaced out the story as it is long winded. The car that hit me was actually stationary and about to set off. The company i work for know of what happened, and at the time i was agency staff, but now i have been taken on full time permanent. I did have to take days off work, but because at the time i was agency staff i had to limit this as fi i didnt work i didnt get paid, and i have a family. Like i said to the officer at the time, that could have been an elderly person or a child and the damage could have been much much worse. I will be going to the police station and see if this can be looked into further as surely this is not right?
  14. I work for a well known communications company. And a few weeks ago i was buddying with another engineer. We went to our second job of the day which was a museum in Blackbrn. I got out the van and crossed the road which had no traffic, my collegue went around the front of the parked cars and i myself went around the back of a parked car. I was on the workphone clearly wearing a flouresant jacket with the communications provider on it and a white hard hat. Then the car i was walking behind jumped back and into me knocking me over. I manged to get to the side of the road and my collegue asked the couple (who were in their 40a-50s) "what have you done you hit him with the car" and the lady got out looked for damage on her car. And said " well its his own fault, he shouldnt have been on the phone" and my collegue replied " but you obviuously didnt check your mirrors or you would have seen him. Anyway, long story short. The couple left without informing the police of an accident. My collegue took down the registration and make and model of the car. The police turned up and did trace the owners. Now, the police failed to even contact me and i had to do all the running around. When they did return the call they said that the couple said they left because they felt intimidated by my collegue (which is ridiculous given the size and appearance of him) and that they think they wouldnt get a conviction but the couple did say that something happen. Now surely to god even if the couple thought they were intimidated then why didnt they at least contact the police on their return and say this happened but we felt intimidated. Now ive had time off work lost money and tbf with the way ive been treated im now going to contact a personal claims company. Surely what the police and this couple have done is not right? and would i be right taking them to court via a personal injury company?? any advice appreciated.
  15. Well it would only be for two days maximum, and then it would all be returned. And every penny would be accounted for. So i would say they crossed over and there was a mistake. Yes i know everyone is going to advise no, but im asking is do they actually ring the company and check regarding the cheque.
  16. Hi Please bear with me with this one, i have recently been paid out as my car was written off. I asked the company if they could pay the amount into my bank rather than send a cheque. They said they would do this for me, a week later the money had not hit my so i rang them, and they said to check every day as it can take a while. The next day a cheque arrived from them, so i rang and asked why the cheque when they said it would be paid into the bank. They replied that they do not pay into the bank and always send via cheque as this is how they pay out. So a few days later they then also paid the amount into my account. So i have the cash and the cheque, now before anyone jumps the gun, no i do not want to steal the cheque and collect the cash, but i know i have some money due in one week but also need to purchase this car now or it will go. Now i could borrow some money from the cheque and then give that back in one week when i get the money i am due. So i was wondering if i go to cash the cheque at a cheque cashing facility, would they ring the company and enquire about it? as the company says all they need is the original cheque, letter with the cheque, passport, 2 utility bills. Let me please reiterate that i do not want to to collect both monies jst some until i get what im owed in one week and this would greatly help. Any information much appreciated.
  17. In June i changed vehicle and address, but the insurance company still hold my old address. Now when i spoke with them, they told me that the call was listened in to but not recorded. When before they told me all calls were recorded. I KNOW i informed them of both changes as i did them both at the same time. As for the fraud, this was due to some money being taken out in foreign countries, and because the bank knew it wasnt me they put a freeze on the account until they could contact me. So my arguement is yes there will still bea fine to pay, but that should be covered by the insurance company as they have not amended the policy as instructed. And forgive me if im wrong, but on the paperwork to recover the car it states: To recover the vehicle you will need to appear at Accrington You will need Driving license Valid insurance Proof of ownership Now i was always under the impresson that in this country you were indeed innocent until proven guilty, i am appealing the points and fine so therefore have NO endorsements, also, i have been on several insurance companies for quotes, and they all ask the same question. IE have you been convicted in the last five years.....i have not.
  18. Our letting agent is great places, and for a while the boiler has been playing up. So the guy came out to repair it two days ago. Now there was meant to be someone comming today to repair it as they needed a circuit board, no one turned up and they said they would be here between 12-5pm. So we rang them to ask why and they said no one was meant to be out today and that it would be monday, (we have just checked the voicemail and they did say they would be out between the times stated) also they said someone would ring between 5:30 and 6:30 tonight and no one has called. Now they left 2 small fan heaters which eat the electric ( we are on an electric metre) and we have two children aged 4 and 7 (one with severe asthma) and th heaters can not be left on overnight as it is a fire hazard. Surely they can not leave it the whole weekend with no proper heating. We are private tennants and both work so we would have to take another day off work if they want to arrange next week. Plus they have said they only do emergencies on the weekend....forgive me if im wrong this is an emergency.
  19. Ok, i was pulled over yesterday by traffic police and they said that my car ws uninsured. I beleived it was and had all my docuementation in the car, but as it turned out, the insurance had been cancelled by Halifax due to payment issues. Now i know i should always keep a check on my account but generally its the same in and same out. But what i hadnt realised is there was some fraud in my account in August and because of the freeze i had on my account at the time this stopped two payments. And the insurance company wrote to me at my old address so i was none the wiser. Im not going to complain to much as i should have had my affairs in order, but i am going to contest the fine and points as A) ive never had so much as a parking ticket in 18 years of driving, and B) If the insurance company had written to the correct address than this may have benn avoided. So, i rang a different insurance company and have insured the car correctly as requested, and i went to the police station to show the docuements and then i could go to the recovery and pay the £190 release fee. But i had a real jobsworth of a policewoman who asked if i had informed the new insurance company that i had been stopped with no insurance. I replied yes even though i hadnt (stupidly i know) as i thought well im contesting this and im innocent until proven guilty. Anyway this was dragging on whilst i was waiting and the i told the police woman that i needed to get back to work. So she said that the insurance company had not back to the insurance bureau so i should come back tomorrow as they closed at 1700 hours. I need my car for my job as i travel and i have done everything asked of me so whya re they being like this.
  20. Ok where to start, my gf has received an eviction order for tuesday 26th. Now she did fall behind with her rent as there has been a lot that has happened to her with her ex leaving her with nothing and emtying her house leaving her and her two children nothing. Now my gf works part time as a dental nurse as her youngest is still at nursery. The housing association had recently changed names, now my gf knew she owed money but with everything that has gone on she was unsure how much. She has continued to pay and the odd payment has been missed but she has never made this a bad habbit. On the 17th sept she recieved the possesion order which was in fact the original one from 2009 when her ex left her in a mess, the amount owed on this order shows £967 and they have in red birow written underneath the old housing association with the new name (not even printed a new form out) and right at the bottom in very small red writing it says ammended 17.9.10. My gf rang up to say why have you sent me this for and they said she owes £900, my gf informs them she has paid the £967 and they say no you owe a further £900,but yet the letter was never ammended with what they say is the correct amount. Now they are taking her to court saying they will not extend it or cancel the order even though she has said she will pay another £300 this week and then 2 seperate amounts of £300. Im no expert but surely they can not do this. How would she even know what was owed when they didnt even ammend the letter even if it is to be very unprofessional and writing it in red biro. Even a bailif who knows the predicament she was left in with her ex has offered to hold off her payments for 4 weeks so she can deal with this as he knows she offered to pay the required amount on time every week to get it paid early (5 weeks left) this is not on with a single working mother of 2 young children.
  21. My gf is a part time dental nurse and her boss has just given her a new contract to sign. He states that shes entitled to 7 days that she can pick, 3 days he can pick and bank holidays shes entitled to. Now as far as i was aware, your boss was not allowed to tell you when you can take days in that way. Is this true??
  22. I was aware they paid me the full month and they said they shouldnt have. But nothing was agreed in paying the money back, i thought i was going to use my annual leave plus some unpaid leave.
  23. Thats just it, i never agreed to that at all. They have messed me around completely.
