  1. Morning all. I'm sorry if I'm being a bit pushy but I'm still confused. Lowells got my CCA request on Saturday 18/10. Are they in default? I've had conflicting advice about time limitations so I don't know who's correct Any confirmation gratefully accepted. fox
  2. Hi As far as I'm aware (although i could be wrong) you can get the phone number from the post office to ring up and find out if a postal order has been cashed. If they have been cashed then the companies you sent them to would have received your requests. I also believe that the only cost to find out whether they've been cashed is the cost of the phone call. Other more knowledgable people on th e forum may even have the number Also once i received a recorded delivery item just posted through my letterbox. no signature??? fox

  4. Hi all. How's this for me being ridiculous. In my last letter (not the CCA request) i threatened to stop paying if they didn't reply. Obviously they didn't so I followed through and didn't pay this month so WHY DO I FEEL UNCOMFORTABLE about it:???:. It's been two weeks since Lowells got the CCA request and nothing yet. If my maths are right and not taking into account weekends, they'll be in default by next wednesday. I know they won't phone me as they don't have my phone number:grin::grin: BUT Cabot do. Has it ever happened that one DCA contacts another to find out phone numbers? I went and bought i digital dictation machine with the money i was going to send them( I couldn't afford a proper recording device) I have speakerphone on my home phone so if they do manage to get hold of my number I'll be ready for them . Mind you, the longer they take, the more chance they haven't got my CCA. Can anyone point me in the direction of the photobucket tutorial please. I'll keep you updated. fox
  5. Another thing, If you do write to them, do not hand sign letters. just print your name. Have you any idea how old the alleged debt is? It is not for you to prove you don't owe a debt. it's for them to prove you do. Another thing. Lowells, Hamptons, Red DCS are all the same company. fox
  6. HI Hellylou, First of all Don't phone them. This may not even be your debt. These companies go on fishing exercises to find people with the same name as yours. I'm not sure where it is on the forum but someone will be along to show you how to get the "prove it letter" (someone with more experience than me anyway) try not to worry about these people. they do a lot of posturing with very little bite. They cannot make you bankrupt without taking you to court and that costs them money, something they don't like doing. I've had dealings with this company and if you read your letter it rarely says "we will". it usually says "we may" do this or that. It may even be a statue barred debt but we won't know till either thay take you to court or you contact them. one of the site team will be along to help soon but they are busy people so don't expect too much too soon. fox

  8. What's that old chestnut. "If it sounds too good to be true, it probably is" Don't pay these people a penny. They cannot guarantee anything. If you paid the upfront fee and they couldn't get any money back on your loans/credit cards, would they give you your money back? I think not. The word "bargepole" comes to mind fox

  11. :evil:Hi again. I've just been looking over some previous letters from Cabot. In one from January this year the outstanding balance was just over £600 but in the latter i got today the balance is just over £700. In Feb 2007 the balance was around £750. What the hell is going on??? are they allowed to add interest on to an agreed payment plan and I've never missed a payment since the first one in March last year, so in 21 months, Ive paid off less than £40. Something wrong somewhere. I was going to pay this months payment today as the CCA has only just been sent but they can bog off now. fox:evil: ME, ANGRY, How could you tell:evil:

  14. Morning BB If i can remember rightly, Letters headed with "without prejudice" can't be used as evidence but with it being within the text of the letter then that doesn't count. fox
  15. There's not much more to do for now. all you can do is try and put this to the back of your mind for a few days and deal with each new issue as it happens. I may not be much help to you but I'll be keeping an eye on the forum and checking in on you. Take care fox:):)
  16. Wingus, I can totally empathise with you. I've been ill for over 10 years and suffer with depression too (since 2003) I have limited mobility as well. It's only since i found this site 3 weeks ago that i already feel stronger and more able to take on the DCA's. TOGETHER WE WILL WIN :grin::grin::grin: FOX

When your complaint reaches them it's allocated to an investigator who will do the day to day running of the complaint. Once the investigator has all the information he/she will make a recommendation to the council. The council very rarely refuse but if they do then the investigator takes the case to the chief ombudsman who has the authority to force the council to implement the recommendations but as i said that's a rarity. as they say forewarned is two legged:grin::grin: fox
  18. I was having some random thoughts earlier and i remembered a previous complaint i had with my council. They wouldn't listen to me until i wrote letters of complaint to my MP, MEP and the ombudsman. As soon as my council got a letter from my MP, they settled. Another avenue to follow maybe??? fox
  19. HI' I'm reasonably new here too. did you mean £110,000 or 11,000? in 1998 you would have been defaulted but from what i've read on here the defaults disappear after 6 years. As you've been paying regularly then it won't show as a default as you haven't. As you've been paying you can't use statute barred as there has to be a clear 6 years between payments an (i think) any communication. It may be worth sending a CCA request to the DCA (and Credit card co's if they still hold your account) and for the loans. Not sure about the overdraft tho. fox

  22. Surprise. There is logic in what you are saying. The court case should be adjourned anyway and then BB may be able to get a brief so in that respect there is no rush to get the tape. I do find it unlikely that the council would lose the tape as it would form part of the prosecution. I was more worried that if there were inaccuracies in the transcript and the witness has signed it as being true then the council will get into lots of trouble and maybe the case thrown out (or is the witness signing that it was the interviewers signature only) ARRGHH! brain ache lol:grin::grin::grin: fox
