  7. Afternoon all, My wife went into our garage this morning to find that it had sprung a leak. Unfortunately, this is where I keep all my, (relatively), expensive PA equipment, (for the record this is personal and not busiiness stuff, I have an interest in sound recording and PA and have accrued various bits and pieces over the years), and a lot of it has become somewhat sodden. I've yet to go home and assess the damage. Our house is rented but we have our own contents policy with NU whom I have contacted and they tell me that, in general, the garage is covered as an outbuilding. I know a little about insurance and i'm concerned about proximate cause. i.e. the fact that the garage roof, (apparently), leaked and caused the damage to equipment. Therefore, are the insurance company going to insist that I use my landlords' building cover rather than pay out themselves? Any help would be appreciated. Jim P.S. I've had two claims I didn't follow through in the last 8 years, firstly for a camera which failed as it wasn't insured outside the house(!) and secondly for a PC my three year old gave orange juice to. I cancelled that claim when they told me I would be without it for up to 8 weeks while they attempted to repair it, (I managed it myself with a £90 motherboard). I don't know if this is relevant.
  8. Good point. The speeding fine suggestion was mine. Although having read the terms more fully it only specifically mentions costs arising through legal misdemeanors as opposed to civil.
  9. I have some experience with both and in some cases the contract hire company will request the V5 in the company name c/o the customers details. However, this is not the case here. In actuality this is a friend of a friend. It seems he heard about my success with banks and credit card companies and thought I might be able to help him. I was just exploring the possibilities on here and it seems he might not be telling me the whole truth or at best letting me think he has a stronger case than he actually has. Regardless, if the above proves true then there is little point in me trying to help him anyway. Thank you both for not letting me make a bigger idiot of myself.
  10. The one I have here is a photocopy and I need to look at some more examples at work tommorrow. I think something fishy may be afoot. :o
  11. Bizarre. The one I have here has a different name and address in section 1 to section 5, but, you're absolutely right they do both say registered keeper. However, if you read the bottom paragraph on the link you posted there is a distinction between the registered owner and the registered keeper.
  12. Yeah, the registered owner is usually on the front page of the V5 and the keeper is listed inside. They are seperate, ironically, for situations such as leasing or company cars. It's not obvious though, I only know because I happen to be in the motor trade.
  13. The lease company are on the V5 as the registered owner whereas he is listed as the registered keeper. It seems the PPC sent the letters to the owner rather than the keeper which kind of defeats the object of having a RK in the first place.
  14. I have the V5 and he is definitely the registered keeper. He is prepared to issue proceedings if necessary. I'll be prompting him to follow the UTCCR route. Might nick your letter for the leasing co if that's ok though?
  15. Yeah, the difficulty is that they only told him AFTER he'd paid it. My original plan was to go after the PCN, is there a reason that I shouldn't? Are they not at fault for not adressing the invoices to him as the RK? In my opinion this £17 admin fee by the leasing company isn't massively unfair. PS thanks for link. Am reading now.
  16. Hi, Thanks for speedy replies. I've currently only skimmed the lease terms but it appears that it specifically only mentions breaches of law, (i.e. speeding tickets), in this case they would pay them on his behalf and then pass the cost onto him. There is no mention of civil charges in the terms as far as I have read.
  17. Hi all, A friend of mine has a car on a private lease. He's the RK but obviously the hire company is the RO. As usual he recieves an invoice monthly from them, as it's the same amount every month he tends to just open it and file it away. Recently he's noticed he' been going overdrawn for no discernible reason and decided to check through some of his paperwork. It turns out that he's bee recieving private parking fines, (£40 a pop) from a PPC. However, the fines have been going to the leasing company rather than him directly. The leasing company has in turn been paying the PCN on his behalf and then sticking a £17 'admin' charge on top for their trouble. Net result? About £750 extra expenditure in 3 months. Am I right in thinking that this process is so full of holes you could sell it as cheese? Just want other peoples opinion of the situation as I write his initial letter. Obviously it's going to be slightly more complicated as they already have his money.
  18. What have TS and the like said? They need to see a copy of this. I would also forward a copy to the Information Commissioners Office and ask for their opinion. Write back and ask them under whose authority they are supplying your data to the CRA's. Explain that you believe they are in breach of section 174 of the CCA as they have failed to show where you provided such authority.
  19. Oh right, THAT kind of update. Still would go with the authorities first, if for no other reason than to show a court you've exhausted all other avenues.
  20. Yup, reads fine. The only thing I would change is threatening them with litigation, unless you're actually gonna do it in seven days. Have you actually reported them to the relevant authorities? If not this should be your next step rather than spending £150 on a court case you probably won't need. Alternatively, check your credit report, if they have already removed it, (as they appear to be claiming), then there is nothing more to do.
  21. See my thread here from last year dealing with DLC. http://www.consumeractiongroup.co.uk/forum/general-debt/36186-ongoing-saga-2.html Suffice to say I am no longer recieving letters and the account is curiously missing from my credit file. This is despite the fact that I told them in writing that I was aware I owed some money, it was the amount they claimed I disputed. The letters you are getting are par for the course, report them to the Trading Standards and sit back and enjoy the silence. TS have recieved many, many complaints about DLC most of which, (as far as i'm aware), have been passed to the OFT for investigation. Another can't hurt.
  22. Sorry, I should clarify, the accompanying letter was the standard smile one saying how they were sorry I felt the need to complain etc... and as such here's you're money back. The cheque is for the amount originally claimed before stat. interest and fees were added on, (they paid the total amount in the original settlement). It's basically as if they never paid out the first time and think i've just been waiting for months for them to reply.
  23. Hola, About month ago I recieved payment from Smile for beloveds account, they paid out at after I issued proceedings. I heard NOTHING from them up until that point. This morning I've recieved another cheque for the same amount. Obviously I can't keep it, but i'm not sure what to do? I've spoken to customer services and they didn't really seem to understand the situation. Should I just send it back?
  24. Recieved notice of acknowledgement and 'I intend to defend all of the claim' rubbish today.
