  2. To date - rather than you having to read through the whole lot... Application form supplied in response to SAR .. Default issued 8/6/2009 - remedy date 25/6/2009 Summons received Friday 4/2/2011, states assigned to Link financial 19/6/2009 (against remedy date on DN of 19/6/2009) Link claim they served a notice of assignment - which they didn't. All I got was a 'hello' letter, not recorded delivery or similar- just by regular post. Summons states default was recorded on 30/5/2009 - which was before the DN was even issued! How do I proceed? Thanks.
  3. Well here we go again... Some 19 months on, link have issued proceedings. Mods, is it appropriate to move to legal as I'm going to need a bit of help. I'm guessing I'll acknowledge and defend on the grounds that it's never been assigned? Do I also draw attention to the application form and default as technically that's between me and the cc co, not link- but there appears to be very little merit to their application.
  4. A couple of months ago they sent me a DN (which I immediately remedied) a couple of weeks after a payment was late. My suspicion is that they're after the car as its worth quite a lot more than what I owe. I put a large deposit in to it and only used the finance as a 'top up' - and it has a private plate on it which could be considered reasonably valuable. unfortunately I can't sell said plate as it belongs to a mate who emigrated and was left with me on trust.

  6. Thanks for that. I'm in shock that they'll doorstep over a £300 payment thats only a couple of weeks late though! Surely this can't be right? I'm wondering if they have some kind of [problem] going on, as they certainly appear to be trying to bully me in to handing them the keys.
  7. Has anyone come across this with Close Brothers? I thought they were a professional operation! Wife was diagnosed with cancer a couple of months ago and I've not been able to work. I've informed them of this. Payments have been late for the last few months but I've always paid before the next one was due. I missed last months payment, which was due on the 11th, and told them I should have some money last Friday so would pay them- then the DD would go through as usual from this month. They said they'd ring me on Monday if they didn't hear from me on Friday - I told them not to ring Monday as my wife had her first chemo session at 10am. Between 9am and 10am, on Monday morning, I received five phonecalls from them They have also, on several occassions during the last few months (while we've been having problems) requested I surrender the car as I've paid over half. I've made it clear that the cashflow was temporary and would be resolved. I've just had to go to hospital with my Mum, and while I've been out we had a doorstep caller! This seems exceptionally heavy handed for a £300 late payment don't you think? Any thoughts? I'll also
  8. Sorry, only just noticed the responses. Yes, they have terminated in writing then demanded the full balance. I haven't responded or paid them anything. As it was, in effect, a fixed term loan that they'd said they would renew then didn't, I'm guessing the full amount would be repayable. Therefore, if the DN was defective, as it certainly appears to be, all they'd be entitled to recover would be the amount it arrears- which could be considered to be the full balance?

  11. That's exactly as it was sent- less personal details, of course. I suspect they have a printing format error- a very expensive printing format error. The dates appear to be ok. There are a couple of small formatting errors, but nothing I'd want to hang my hat on in court to be honest.

  14. Hi dad, brw invited me to join the party:) I have a DN from nattiest which gives the figure of "########" to rectify. Yep, actual hash signs. They're terminated on the strength of it.
  15. Guys / Girls, having 'issues' with NatWest. Personal account (advantage gold) £5k overdraft limit, allowed by business manager (who also handled my personal banking) to go up to £19k (12 of which, therefore, unauthorised). As you can imagine, the charges on the account are quite massive... so would hope to offset any claim they may / will attempt. Manager decided to put 'overdraft' on to 'loan account'. No overdraft facility from this point. Manager told me I wouldn't have to repay until times were better and I could afford it. Manager moves from job, still with the bank though. New manager appointed. New manager says the 'loan' was due for renewal. NatWest refuse renewal and demand repayment. I verbally agree repayment and ask them to confirm in writing, which they don't do Default received. I ask them to rescind as they haven't replied to my offer. No response. Another letter asking for immediate repayment within seven days. Received on the seventh day. I respond asking for time to consider as my situation has worsened considerably. Debt collection letter arrives the next day. I have attached the DN, which I'm hoping is defective as it doesn't state an amount to rectify. They have confirmed that the account has been terminated.

  17. Guys / Girls- you've all been so helpful to me, I could do with one last favour. I've posted this a couple of times in what I would consider the 'correct' place but had no response; This was received from NatWest, who have decided to try and give me another kicking... I'm hoping the DN will fail due to the amount to rectify being printed as ###### rather than an amount? Failing that, if they decide to claim can I counter-claim for charges on the account?   20. They're still sending me statements too, and Albion are sending threat letters every other day. I got two the other day, both dated the same! I've had a bit of an exchange with Power2Contact, who decided to ignore my doorstep letter- its on my thread.
  21. No, nothing new, same threatening nonsense. They're still sending me increasing statements despite their written termination lol...
  22. I'm still getting loads of letters (one every other day) from Albion. Whilst I told them I wouldn't reply to them I'm getting rather hacked off. Is there any point doing anything further?
