  1. Haha, yeah that's how I saw it - why haven't they done it already. I had the same last year with a debt to tmobile. All of a sudden letters from bryan carter solicitors and fredrickson about 2 months before SB. I'm just left wondering where the £2500 (original balance) i had on a natwest student overdraft (literally) disappeared too. From 2004 as well, but no sign on any CRA files and no contact since 2004! EDIT: Today on the phone they were trying to trick me into acknowledging - saying is it your sig on the app form, do you recognise any of these places ....... on the statement lol. Slimy weasels

  4. Thanks, and to you ashmk Basically, I could really then just ignore them until its statute barred, or worst case they take me to court (would have to be before it goes SB in august wouldn't it?) they don't have a proper agreement?
  5. Hi, Thanks for your reply. Would this still be the letter I would send even though I didnt make a formal cca request. They called, I merely said I don't acknowledge the debt, send me a credit agreement, and then an app form and statement came through the post. Is it not a case of sending a letter saying, blah blah I recieved the docs, but the 'agreement' does not contain any prescribed terms so is unenforceable? I'll get a pic up within 15 mins
  6. Hi, Long time lurker here! To cut a long story short - had a barclaycard in 2004, never paid anything - stupid I know - and then moved to another part of the country. Went through a bit of a bad time and completely forgot about it. Over the past few months they have been sending letters and calling the house phone of the people who own the house, despite me telling them to remove it as it's not mine. Basically I've said I don't acknowledge the debt to get some time while I sort my money out, and that I wanted a copy of everything they had. Through the post they've sent me an Application form, with a small box to the lower left saying 'This is a credit agreement' which is signed by me along with a statement of account. However, there are no prescribed terms - interest rates, credit limit, repayment schedule, how to discharge the debt etc. Is this unenforceable? My main disagreement is that the original limit was £750, but barclaycard allowed a recurring card payment take it to £1300 with charges and then cabot, who bought it in 2005 by all accounts, have put it upto £2100. It is statute barred in august this year and default will come off credit file april 2011. I can upload a copy of the 'agreement' if needed. Hoping for replies quick as apparently it's gone to the pre-litigation dept and they have sent a letter a couple days back and called the phone (after being told not to) today. Thanks

  8. I have access to a postal address which is not my home address. All perfectly legal and above board! What I want to know is: 1. If I request a copy of my credit file from each CRA and get them posted to the postal (non home) address, will the ****** DCA's go sniffing around my postal address and leave my home address alone? 2.Also, the last time I got a copy (4 or 5 years ago) I was showing as linked to an address I stayed at for 2 months with an ex girlfriend and being financially linked to her (she got me a 2nd card on her Credit card account). Any way of getting CRA to disassociate myself from her and the address?

If the money is student loans some are defered to a later date which if after this later date u dont pay or acknowledge the debt for 6 years then yes they will disapear off your credit file as they cant collect after 6 years but they will still exist. Thanks - they are student accounts, credit cards, mobile bills, sky bill, etc 4. Thanks 5 thanks Would it be beneficial to pay them off and not have to worry? And would I get a better rate if I paid in a lump or should I just be a git and pay monthly?
  10. Hi everyone! I just stumbled across this site and after reading, you all seem pretty knowledgable! Wonder if I could ask a couple of questions! 1. I have a lot of debt from when I was at Uni - it is all aged between 4 and 5 years. I am based in the UK. I have moved address a few times and haven't been on the electoral roll for years. As a result I get very few letters from DCA's. How do they find out my address? 2. I used to have an account with woolwich and a student account with barclays. £1050 overdraft - now 1800 with charges. Woolwich account turned into a barclays account after a merger - can they just take money from my account? 3. I haven't acknowledged any debts at all for years. Will they ever go away or could I effectively get letters forever? And would my credit rating ever get better? Will the debt always exist or will it disappear? 4. Could I have CCJ's I don't know about? If so what can I do about them? finally 5. I've just got a well paid new job. it would be nice to pay everything off. Trouble is, I don't have a clue how much I owe, or to who! How can I find this out and how would I go about contacting them. Would they accept lower payments to settle in one go? Then, say I pay them all off, can I clear their marks from my credit file? I know that it's a lot of questions, but I'd like to get them all out of the way in one go! Thanks in advance!
