  6. Buzby, Just sent a letter as you said to 3 re court action if my account is not amended, and a copy to the DCA. I recieved a call today from 3 saying the same rubbish, that they didnt recieve the orig letter and I owe them the balance. After getting someone to break down everything, turns out I genuinely owe them approx £40 for line rental and calls up until when I sent the original cancellation letter, inclusive of my 4 week notice period. The only reason I havent paid is because they are requesting a total of £96 (£40 that I actually owe + two months line rental) but have agreed to knock it down to £65 I spoke to a team leader and said I will pay the £40 I believe I owe, or even the whole £65 to end it if they can amend my credit record, he said if I pay he can request that but cant guarantee they will, so I told him I will write to them again. Should I write a letter to their credit or legal dept, sending RD, with a cover letter, and a cheque, offering £40 (or even £65) in settlement of the account ONLY if they amend my credit record? If they refuse how do I go about legal action to get the account settled? I am assuming I should write to Experian to amend my record once I have settled with 3, including copies of all correspondance? Thanks in advance

I did not send the original cancellation RD Will the fact the phone has not been used at all, and also the copies I have of orginal letters be enough for me to win the dispute? Or do you think 3G will credit my account etc instead of defending their case due to the amount of time/costs they will incur? Many Thanks

  9. Thanks for your reply buzby The service was terminated after I requested for the 3rd time I didnt ignore the bills... I was on holiday when I recieved the first bill, soon as I realised I sent another letter, which was about the same time the second bill was recieved. I was not using the phone since before I cancelled, so I would not have known if it was still active.... as you said it hasnt been used since. Shall I send the DCAs solicitors a letter saying it is in dispute with 3 still? I have already done what you have advised in November and recieved no response form 3, and more calls from the DCA Many Thanks
  10. I have a DCA asking me for money I dont owe, I'll try and keep it short... Had a contract phone with Hutchinson 3G, and after my 12 month contract period expired, I wrote to cancel my contract in June last year. Got billed for July and August, didnt pay, sent another letter in August stating when I canceled and including a copy of the orig letter. Then got billed for September. Spoke to customer services. They said theres nothing they can do, I am responsible that they didnt get the letter (!) they dont care, I cant speak to anyone else, cant speak to a manager., So sent another letter saying I dont feel respoinsible for your mistakes etc and they ignored it. Then I got letters from a DCA, explained the situation to them, they put it on hold for ages. Snet another letter to 3 asking them to call me to resolve and they didnt. Didnt hear anything else for a while, now the DCA have passed it onto their solictors and said if I dont pay this week I will get a CCJ - they have already put a default on my record which I need to get removed, I will write to Experian after ive dealt with 3. Do I pay the £90 to stop my credit record being damaged any more then open a small claims against 3G? Will I stand a chance of winning? All I have to go by is my letters which I stupidly didnt send recorded delivery.... Many Thankks for your help
  11. oh yeah my credit file has 2 late payment marks for the last 2 months because of this! both were put on while it was in dispute
  12. Thanks v much okonski I will phone the dca then follow it up in writing I will then call/write to 3 again as on the last call they made to me at 2130 in the evening they told me someone would call back, that was at least a few weeks ago!
  13. OK i now have a letter from the debt colleciton people saying they have started legal proceedings.... do I let them take me to court and present my case? or would i be likely to lose as I did not send the first cancellation letter recorded delivery? Please Help!!
  14. HELP!! After sending the letter above, I had a phone call about 2 weeks later, basically someone that hardly speaks english again, telling me the same stuff, theres nothing they can do. I ask for someone higher up to call me back to resolve the matter. They said ok, themn I heard nothing. NOW THEY HAVE PUT ANOTHER LATE PAYMENT MARK ON MY CREDIT RECORD! How can I sort this out if there is no one to contact in this country from 3 that can understand, just the same non english speaking jippos telling me the same crap, and not getting any response when they say someone wil lcall me back??? Can I get a court order ofr them to remove my late payment marks on my credit file and cancel the bill? It would be obvious they are in the wrong as a\ i cannot contact them b/ i never get a response or call back when they say c/ cannot speak to anyone that speaks english d/ i have not used the phone since i originally cancelled it etc etc Many Thanks I am soooooo frustrated I might go to a local 3 shop and not leave until they sort it out!!

Thanks, yes I can definately prove there has been no use whatsoever, so do I send them another letter, RD, sating if I dont hear from them by 7 days or whatever I will assume the matter closed, sending a copy to the DCA? As I want the late payment mark on my credit record removed as well cheers
  16. To cut a long story short, I cancelled my 3 contract (outside my 12 months) in June by sending a letter on 7 June, stupidly not by recorded delivery. The phone has not been used since May. After I recieved further bills. I sent another letter dated 30 Aug explaining I cancelled, and enclosed a copy of my original letter. They wrote back saying tough I still owe them as they "did not recieve the first request" then sent a further bill in September for 3 months line rental. They passed it onto a debt collection agency, and marked my credit record with a late payment. I cannot get contact with anyone apart from these one eyed mongolian jipsys that dont understand a word of english and talk so fast you cant understand a word, and refuse to put you through to someone else. I sent this letter to Glasgow last Friday, recorded delivery, and have not heard a response, and the debt collection people have put an extension on for me for a few days Account Number: xxxxx 3 phone number: xxxxx Dear Sirs, I am writing in relation to my 3 account in which had written to your customer services with a request to cancel my account on 07/06/2006. You can see from the activity on my account that the phone has not been used at all since I sent my original request. I had received bills for July and August after sending my cancellation request, and after querying this I was informed that you had not received my cancellation request. I sent a further letter dated 30/08/2006 requesting for the matter to be resolved. Since then I have not had a satisfactory response and received a further bill dated September, requesting £98.48. I have spoken to your customer service call centre and I have found your staff extremely unhelpful, refusing my repeated requests to speak to a team leader or manager to try and resolve the issue, and telling me there is nothing they can do and no one else I can speak to. They eventually offered to take £30 off the total amount which I allegedly owe you. Despite my efforts to resolve the matter I then discovered a late payment mark on my credit record and also received a letter from your debt collecting agency, both of which are totally unacceptable actions for you to take while the matter is in dispute. I do not believe I should be responsible for your staffs inability to process a simple contract cancellation request. I look forward to hearing from you soon with a satisfactory response.   18. Its been nearly 2 months since I ahve succesfully reclaimed 6 years fo charges. I made a purchase and went 40p over my limit and have been charged with 2 charrges of £30 and £39 for going over my limit. I phoned customer services and they said they cant refund as I have had good will gestures before. Do I write a letter startign the whole thing over again? I want to do it even though its not alot because its my money Do you thnk they will get nasty and close my account, demanding back my overdraft if I claim again? Many Thanks
  19. After I cancelled my 3 contract some months ago, they sent me 2 more monthly bills. I wrote and explained that I cancelled it, enclosing a copy of the original letter i sent, and they wrote back saying as they did not recieve the first one I am still liable for the extra 2 months. They then put a late payment mark on my credit file How do I go about getting this removed and also telling them to go screw themselves over the 2 months bills, since I am not paying for it due to their incompentece Many thanks
  20. I WON! I WON! I WON! I WON! They have not yet paid the daily rate but refunded in full all charges, interst + costs in 2 payments about 10 mins ago! SO EXCITED! YAY! THANKYOU EVERYONE SO MUCH DONATION ON ITS WAY!

Got a letter from the Halifax a day after opening my moneyclaim, saying the same crap, they are sorry I refused their final offer of 1/3 of what they owe me, how i should manage my account etc, and they cant offer me any more, and for some reason, they spent 2 PARAGRAPHS explaining how KIND they are for supplying my list of charges FOR FREE!!! (they never cashed my £10 cheque for my DPA request!) they are such a bunch of jokers!!!! I swear they must have some people there that genuinely think its funny to write these sort of letters! been 7 days since date of service..... any day now!! :grin:
  24. Dont worry they say they are going to defend in nearly all cases and then.... ching ching! I think they do it for one or more of the following reasons: 1/ a feeble attempt to scare you off at the last minute (although i cant see why that would work as u have already paid the court fees so nothing to lose!) 2/ To make more money on interest, the longer they have all our money in one big pot the more they make on interest every day 3/ They are overwhelmed with all the requests they just need to put them off as long as they can to deal with all the new requests coming in 4/ Just to mess you around and be a total bunch of "c u next tuesdays" Anyway, hope that puts your mind at a bit more ease, they will pay up soon im sure!!
  25. don'tcha worry bout a thing little miss milly, I filed my moneyclaim Fri 14th July and on Tues 18th I rec'd a letter saying they will defend, from A Obrien too. But do not worry, they will pay up soon! Its only a blag, i think their idea is if they tell that to everyone and scare off even only 10% of the people then thats saved them alot of money! I know your game O'Brien........i'm on to you!
