  2. Monty, well done. Fiddled gave some good advise by advising to put the account in dispute. If I can be so bold, what was the letter you sent that provided you with the success?? So far all I have sent them is the CCA request and a bit of a loss what to do next? As a complete aside I have other cards I am waiting on satisfactory responses to the CCA's (without any success).   5. PGH...I am in a flap and seem to be all over the place!!!! Sorry if I am causing problems but I am so worrid and confussed about things. I started threads before but did not seem to get anywhere??
  6. Sorry the paragraph was; We regard this as meeting our obgigation under section 78 of the Act 1974 to provide you with a true copy of the executed agreeent. On their propoer construction, that section and Regulation 3 of the Consumer Credit (Cancelation Notices and Copies of Documents) Regulations 1983 (1983 S.I. No. 1553) do not require us to provide you with a copy of the executed ctedit agreement between us in the form of a photocopy of that document"
  7. The request for the CCA went out on 23/9 and their reply was dated 20/10. The 1st paragraph (sorry my scanner not working) advises "in satisfaction for your request made under section 78 of the Consumer Credit Act 1974 for a copy of the credit agreement. I encloe a copy of the application form which would have been completed by you along with a copy of the terms and conditions referred to in it" The next paragaraph is as per quoted in my original posting. It then goes on to discuss the present arrears position and looking for payments. Hope this helps and makes sense to you. I made requests to other companies for CCA's but I have not had one single copy, so not sure whatthe next step will be. Thanks in advance.

I am in the same position as Jesteruk was, so far I have received either leaflets with t&c's on, a letter from Vanquis advising they only need to send a blank application with t&c's or nothing from others (who subsequently pass to debt collectors). I am worried sick as I have 10 cards (between my wife and I). HELP PLEASE
  9. Sorry to jump on the thread but I have had Vanquis quoting this section as to te reason why they do not need to supply a CCA. For those with experience is this the case or not? (I posted earlier on another thread looking for Vanqus info, but found this one on website reasearch looking for the particular regulation).

    CCA Help

    Thanks RMW, what confusses me is we have fellow members who seem to have challenged these lenders and recovered funds, how can this happen? I actually stumpbed across the websire when doing some research on the validity of Cartel Review advertising that they could get my money back. I think the common though is they are a [problem], however, more and more of these companies are showing up......is there something in it???
  12. Sorry to re-post this but no rsponse to earlier thread. I wrote to Capital Bank advising an HP doc was signed off trade premises and in return they sent a termination notice and a request for the car to be returned (as default notice arrears had not been paid). HELP!!!!!!!!!!!!!!!!!!!

    CCA Help

    I have sent 10 requests all nearing the 12 working day limit, so far Capital One are the only one to reply and they only sent me a leaflet of their standard terms and conditions and to advise me I am in arrars and not paid!! I have read through the other threads and there are some templates I have stumbled across (not sure of the codes). Can somebody please provide me with the definate template we are using. Also it seems that some of the letters are basicaly saying I will not pay any more, while others are advising I am entitled to my money back (if unenforceable). What is the procedure I am a bit confussed.
  14. Sorry to add a second point here, but do you know if I can claim money back from a lender, if an agreement is complete, but was unenforceable in the first instance?
  15. I have signed my last 3 HP loans at office premises outwith those who actually organised the deals. The broker I used was a sub agent of the "master broker" - not connected - and therefore the credit licence the lender would base their lend on agreement on is technically out of the loop. My understanding of the consumer credit practise is the customer must sign the regulated HP docs on either the premises of 1. The finance company or 2. Their agent (either the broker or the garage). The broker I arranged the loan through does have a CCL but as they are not part of the chain, it is my belief that the documents may be unenforceable as the broker I used with the CCL does not have any contractual obligation to either the master broker or the finance company. Does anybody have thoughts or agree/disagree with my opinion?

    APR's

    Thanks djc, but not exactly what I am looking for, there must be a simple scenario somewhere that the advance can be put in to cater for HP or loan deals where we have additional fees have to be taken into account. I spoke to Cartel review (who I am not going with) to find out how they can establish if the APR is wrong therefore unenforceable and it was vague ranging from they have a calculation formula to they confirm it with the OFT. HELP NEEDED :???:

    I have today started the process to establish if 10 credit cards I have (between my wife and I) are unenforceable. The query I have is there an "official" APR checking system? I had a quick browse on the OFT site, but only found a complicated formula. I realise the issue is whether an APR is actually shown, but have it on very, very good authority that one of the computer systems a major finance company used (it recently got rectified) had a flaw on the system and all the APR's are incorrect (at this stage it would be wrong to publish the name). Any feedback on th following credit card companies would be helpful. Barclaycard (2 cards issued circa 1999) Capital One (4 cards - Visa and M/C) issued circa 2000 Natwest (issued 2002) Vanquis (issued 2003) Citicard (issued 2002) Monument (issued 2002)

I am not 100% if there is any difference in the law between Scotland and England, but either way I would suggest contact with them to resolve if it is left knowing them they will try whatever means that will get them money! It is still fairly rare for a possession order to be enforced. Even a visit to local CAB and get them to write on your behalf may work.
  19. They will have a summary warrant which enables them various powers, one of which is a poinding of your effects, but this is not the most common way of recovering their money. The other powers are bank/wage arrestment which are more likely (if they have the information). I would sugest you confront the issue and speak to them, they will be horrible, butif you can come to some "mutual" agreement and stick with it, they should not hastle you therafter. Hope this helps.

  21. Unfortunately since my business closed I have been claiming Jobseekers (circa £40 pw each) for my wife and I, and as we have a 12 year old daughter we also get £50 pw child tax credits. My wife has now picked up a part time job (20 hours per week at £5.62 ph) and I know I need to tell the tax credit people, but I am concerned that we may get working tax credit but will this be at the detriment to the child tax credit and we will be worse off. I will call the tax credit people but could do with a bit of advise before I call the. Thanks in advance
  22. Hello, I stumbled across this thread when doing some research on Cartel Review (I did not want to part with £495 when I can do it myself). I posted on a different thread earlier (I did register tonight), and coulddo with some help on the "procedure" to follow, and the template letters to use. I checked out the templates earlier and the site is huge!!! Apologies if I seem a bit of a dummy. Between my wife and I we have 10 cards, and struggling a bit financially so any help would be greatly, greatly appreciated. Thanks in advance!
  23. I hope I do not sound too dodgy here, but if you are trying to avoid linking the addresses you will need to be very careful to whom you provide the information too. Any of your lenders (and possible utility suppliers) who have your old address and then your new address will link the information and this in turn will be available to all who view your credit files etc..
  24. Firstly hello to everybody, first post and what I have read so far is really interesting. I browsed the net looking for information on Cartel Review, and stumbled across some information on the site. I heard about this company from a mutual friend and the unenforceable agreements seemed too good to be true. I am actually from a finance background (and presently struggling a bit financially since my business went under due to the credit crunch) and was interested to read all about re-claiming the funds. Can somebody please pass me in the direction of the templates as if I can do i myself then why get involved with a company where I have to pay £495...................summary 1. Where are the templates 2. Does it work 3. Has anybody dealt with Cartel Review. Once again, hello all
