  1. thanks human writes, so how would you suggest i continue?, time to pay up or is there more i can do to try to reduce the final payment, the amount is £1450.00 from a data card contract from 8 days of usage, it must have been hacked somehow, iv never been able to make any headway and have always felt that this isnt my debt to pay. however they have been chasing me for it for years and now my fixed rate is up on my mortgage and need to get this default off my file, I spoke to lee about this a while back and he said if i clear the account they would look into removing the default, the thing is i was a good customer to vodafone at the time, i had a mobile and data card contract with bills upto £400 per month, if they had been more sympathetic at the time they would of had a fortune out of me since.
  2. Hi, I recently sent a s,a,r to Lowell relating to a defaulted vodafone data card account, I used a template letter from this forum outlining exactly what information it should contain, they took my money and sent out copy's of our recent correspondace. I again contacted to say this was unacceptable, I wanted a true signed copy of the original contract and copy of default notice, they tell me that I have to contact vodafone for this even though they are the ones who claim to have a legal right to chase me for this outstanding balance. Can anyone confirm this? I have made them 5 different offers of payment, I offered full payment up to 75%, they have offered 15% discount, is it time to bite the bullet and payup or do I have some leverage? Thanks Graham
  3. hi lee, i got the link in the pm thanks, have sent the info with the heading... f,a,o lee vodafone from c,a,g. included is my name, lowell ref number and email address, if there is anything else you need il do my best, thanks again. graham
  4. thanks for all the replys, hi lee, what should i put in the email, just the situation that led to the defaulted account? i dont have a vadafone account number i dont think, jst a ref number for lowell. what kind of help can you offer? i have tried three times now to send an email through the link but every time i do it gives an error report and i have to start from scratch again! will try again soon thanks graham
  5. just having a look at a subject access request temp, is this applicable for a defaulted account with vodafone?, that has been bought by a dca? http://www.consumerforums.com/resources/templates-library/86-debt-collectors/576-subject-access-request-debt-a-dca
  6. what is the worst that they can do to me? they are threatning a ccj, i am at an english adress at the moment but am originaly from scotland and still have an address there, am i right in thinking you can only get a ccj in england? as we have sherrif court i believe in scotland. standing by to be corrected.... i just want this cleared up now, would love to get the default removed but dosent look like thats going to happen
  7. hello, iv had the debt collectors after me again for an old debt, lowell have bought it from vodafone, it was a disputed amount that i refused to pay and has left me with a default iv been trying to remove for 4 years, below is a reply to a recent letter i sent to lowell offering full and final payment up to 50% of the original debt on the condition that the default was removed, . thank you for your recent correspondence. we apologise for the delay in our response. your comments have been noted and please be advised that we are unable to remove details of defaults as we are required to reflect true and accurate information on how your account has been conducted please be advised that we are unable to remove the date of default. as we are legally obliged to show this information for a maximum of six years from the date of default the information will not be removed from your credit file upon receipt of your full payment and final payment all the relevant credit reference agencies were contacted to amend the outstanding default to show as satisfied with zero balance we now require you to contact one of our adviser's on the above number to discuss your options for repayment please be advised that collections activity will recommence should we not receive a response. we trust this clarifies the situation and look forward to hearing from you i emailed experian and they said it was soley up to the owner of the debt to remove or apply a default, the only thing i can think of now is maybe a subject access request, i am nearly ready to pay up and have writen out the letter but wanted to get a second opinion before i post it as i hate loosing. any help or observations welcome. thanks graham
  8. thanks for the bump andrew, thanks for your reply bankfodder, i will put together a notice of dispute for the cra,s. the hijacking problem was related to some sort of trojan dialer witch was constantly racking up mins on my sim card when i was online, the police were not involved, i did go to the citizens advice, they wernt any help jst told me to do what i had already done, ie request a list of data usage, they gave me this but could not tell me witch sites i had supposedly bin on, they offerd a 25% discount on the bill while accepting no responsibility, i declined, they havent contacted me for some time about the money, after the hassel i had before im tempted to let it lie, would the default still be removed after six years even if the dept was not settled, or would another be applied? it iwas defaulted in nov 06. il have a look for a template s.a.r to start me off, thanks g-uk
  9. hi every one, im a new member and this is my first post, i realise there are many helpfull threads already dealing with vodafone defaults, but the difference with mine is theres still an outstanding balance of £1457.00. heres a short account of my situation. i entered into an airtime agreement for a data card for my laptop, the monthly charge was £25 a month, at some stage my simcard was highjacked and this enomous bill was amounted in six days, i tried to fight the case with no luck, frustrated and stressed i let it get out of hand and it was passed on to debt collectors! i now have a default on my credit report and have no chance of decent credit, i havent heard from vodafone in sometime and am unsure how to go about resolving the matter, the account was defaulted dated 2years ago, my credit file is otherwise fine its jst this 1 black mark thats doing the damage! could anyone suggest which course of action for removal would best suit my situation! thanks, g-uk
