  1. DLA corresponded directly with my hubbies consultant, occ therapist and Physio, we didn't have to do anything other than filling in the form? Can I ask, have you seen an Occ therapist?
  2. Regardless of whether they have taken a payment or not, (check online banking if you have it), Cancel that card. Get him to ring customer services right now if he is there and report his card as lost if he has given them his card details.

Don't talk like that, it can be resolved, I just can't see how you can do it without your OH finding out unless you can either convince your council to call off the hounds or pay it all and get it over with. The council are obliged to take it back if you are classed as vulnerable - they just pretend they can't in the hope you go away. At a push (and ONLY if you are strong enough to handle it) you can talk to the bailiff and try to negotiate a payment plan you can afford. If you decide to do this, which nobody on here would recommend (but other than telling your hubby I can't see any other way around it), DO NOT tell the bailiff your hubby is not aware of this because they will use that fact to put more pressure on you. Do you or your hubby have a car? If you do, you need it parked away from your home (how do you tell hubby he can't park his car at home?) because of the bailiffs see a car which they suspect to belong to either you or your hubby they can and probably will seize it.
  4. Have you contacted the council? Get an appointment with them ASAP an try to get them to take the debt back from the Bailiff. Is the whole bill £500? and which firm of Bailiffs is it?
  5. I dare say there will be no come backs after 10 months, but it might be interesting to contact the garage that did the last MOT to see if they still have a copy of any advisories that were supplied with the MOT. Also, as Brazillian says, it might be worth your while to get a "2nd opinion".
  6. When my hubby filled his forms in recently there was a page for somebody other than him to describe his needs. I am his carer so I filled that page and used it as "a day in the life of" and listed his needs and what he needed me to help with from getting out of bed to getting back into it at night. They accepted my statement ok and his claim was accepted.
  7. They can not come into your property unless you have already let them in once. If they have not been in then DO NOT let them in. Can I suggest that you talk to your husband about this. I know it is probably going to be hard and may cause some arguments, but probably not as many as it will if the first he knows is if the bailiffs are knocking on your door. Another reason to tell him is because of your car if you have one. The bailiff can levy on your car and anything in your garden. Have you discussed this with the council? Are you entitled to any CTB if you are not working. 2 months seems a pretty short time for the council to release the dogs, did you already have outstanding council tax issues? Can you let us know a bit more about this please. Which bailiffs are your council using?
  8. Firstly you you should have had a letter from Cap One telling you they were going to pass the account over. Secondly, you need to claim those charges back, with interest. You may find out that once you have reclaimed the charges you owe them next to nothing at all. Do you have all your statements for the account? If not, you will need to send Cap One an SAR this will cost you £10 and they have 40 days to respond. You say your limit is £200, did you have to pay them a £200 deposit before they gave you the card? if you did, have you had your £200 back from them yet? DO NOT ring FTC, and if they call you, refuse to answer their security questions and tell them you will only correspond with them in writing.

  10. DOUBLE CHECK THE DATES!!!!!!! I was in a similar situation, where as, I left my ex and moved into a rented property in a different town. I was a single parent and claimed HB and CTB. To cut a long story short, met a new man, move to the other side of the country, and got a shock when the Bailiffs where chasing me for unpaid council tax. My ex had not bothered paying it and had not claimed benefit. They could not find him as he had moved away and tried to get me for it all. I had to prove that I had left the property when I said I did (luckily, the council where I had claimed as a single parent forwarded evidence to me), and they adjusted the bill. When it was all sorted (thanks to the guys on here) the council advised me that it is a good idea to tell them if you move to another area because theses circumstances often happen.
  11. Just ring 151 (I think it is), all lines lead to the same place anyway (and if you end up in the wrong place they will transfer you).
  12. Certainly BEFORE, if you leave it until after the work is done you will be stuck with it. Out of curiosity, why BT? I don't know if it is just for fed up Sky customers (same old rubbish on daily repeat), but we have our Line Rental, Telephone and Broadband with Sky with no tv package. Our latest bill including calls is £31 and that is for their Max broadband.
  13. If the line has been disconnected at the exchange or taken over by another supplier ie Sky, you will probably need an engineer to get up the pole and then check it at the junction box. IMO there is probably no way you can avoid this fee. They may be able to help you out by spreading it out over a few bills for you.
  14. Asking for your CCA does NOT mean that you are trying to get out of paying your debt. If they cannot provide a valid CCA (easier for pre 2007 accounts), then they can not legally enforce the debt and have to stop piling the charges on, giving you the breathing space to pay of whatever you can whenever you can without the worry and stress of DCA's chasing at your heels. Also, if you were to claim back any charges they have added to your account, you might find that it will go a long way towards helping you settle this account.
  15. For what it is worth, IMO you broke the law, you pay the price. Why did you not pay the fine?
  16. Oh Cap One yet again!!! Firstly, have you reclaimed any charges on the account? If you don't already have them, you will need to get all of your statements for the account by way of an SAR. This costs £10 and they have to send you your data within 40 days. As for Capquest, personally, I would write to them and explain that if anything, you are now financially worse off than you were when you set up the agreement because you are no longer in receipt of ESA. Tell them you will continue to pay your £1 a month. How old is this credit card? Have you ever asked them to supply a copy of your consumer credit agreement? (CCA) If they can not supply it or supply an unacceptable copy then you can put the account in dispute, carry on paying your £1 a month and there is nothing they can do or say about it because in effect the account is unenforceable until they do produce your agreement. (Depending on when you took the card out). If Capquest ask you for an Income/Expenditure you are not legally obliged to give them it. Your finances are your business and should stay that way.
  17. I don't think that this is in relation to a benefit overpayment. I get the impression that the poster set up a £1 arrangement with Capquest when she became unfit to work.
  18. I think if it were me, I would be sending them back as not known at this address. Also, check the electoral register to make sure he is not on there at your address. I can't really see there being any financial implications for you if you are not connected to them in any way. If there is a branch near you, it might be worthwhile popping in with the letters and explaining to the manager. I find it is easier to get results from my bank face to face.
  19. On the very rare occasions that they do things properly Blueboy, have you sent an SAR yet? They will have to supply all your statements etc. Then you can go about reclaiming those charges.
  20. They sent Huggy what they claim to be his CCA and about 10 pages of T&C's. Account in dispute letter was quickly dispatched and they have been quiet since then (you watch, I will be tempting fate here!!!!!).
  21. Yes, I vaguely remember them sending one back to my OH saying it was not their policy to charge for CCA requests. I think that was late last year or early this year.
  22. In our area, in order to claim housing benefit the landlord or letting agent has to complete a form that has to be submitted to the HB department before any benefit is awarded.
