  1. so the amount sounds about right, I am wondering if there has actually been a CCJ regsitered or whether Bryan Carter has 'doctored' this form to try and get me to pay up, if it is a judgenent enetred against me then what do I do? what are my options considering I am only on jobseekers allowance and have no disposable income at all? Thanks
  2. Yes it says on the ccj how much its for plus £180 costs, and yes I have moved address since the original credit card application was taken out in 2005, I have moved about 4 times

  4. Hi, no I replied to the akcnowledgment of service online, you know the original papers that they send you? Well I acknowledged them online and said that I intended to defend, then I didnt receive any other papers, just a letter from bryan Carter saying "Please contact us immediately, meanwhile the asccount has been put on hold for 10 days" but I didnt contact them, then I received the CCJ at £50 a month!
  5. Hi, I have just received a CCJ from Bryan Carter Solicitors, it says 'in default'. Basically what happened is they sent me court papers in january, to which I replied that I wanted to defend the case on the basis that the debt is not mine, I CCA'd them and they sent me 89 pages of statements but as far as I know - no signed agreement, they know I replied to the court claims forms because I spoke to them on the telephone the other day, they want £50 a month!!! I am only on Jobseekers Allowance! I rang them and explained that I dont have £50 a month and they said to send them a financial statement of my current situation...... where do I go from here? Can I get the CCJ set aside? The reason why I didnt defend to be honest is because I was pregnant with my 1st child and then I had a miscarriage so my head was everywhere, I have lost out now, oh I am just so stressed!
  6. Hi, I am sorry I haven't been on for a week - I have been totally snowed under!! I haven't managed to prepare a draft for the court either, this morning, I received papers from Bryan Carter, they are just statements of the egg account, and after each statement and notice that a payment is due - there is a terms and conditions sheet, I hope this makes sense!! So there is a statement, then a "you've exceeded your credit limit" notice, and then a single sheet of A4 with a summary box - detailing late fees and over credit limit fees etc, do I still need the CCA and DN from them? Am I now too late for applying to the court? Thanks
  7. Hi, the date of issue of the court claim (on the court papers) is 6th Jan 2010, am I sending a draft order application as the next step? And in it - putting all the particulars such as the defendant supplying the DN and NOA, and CCA etc? Thanks
  8. Hi, I think I will just wait until you advise me on my next course of action - so at least I know I will get it right!! I will keep checking back, I've still heard nothing from BC since those letters, Thanks

  10. Can anybody help me please? I have been looking around the other threads but I have been overwhelmed by the information (this is my first time in dealing with court papers), I think Carter's time is up tomorrow and I just don't know what to do or where to start

  12. Hey ho... here's the update.... I sent the cpr request off to carter, they signed for it on 19/01/10.... I then received a letter from carter (which is dated 20/01/10) which says.............. Dear ??? As you will be aware we have recently issude court proceedings in respect of this outstanding debt. It may be that you do not yet have any Judgements registered against your name and we wonder whether you are aware of the serious impact that a registered Judgement could have on your ability to obtain credit in the future. It is still not too late for you to avoid this happening. Please telephone us on 08453133128 immediately on receipt of this letter in order that we can discuss what options are open to you. This is a serious matter and you may wish to obtain independent legal advice. Then I received another letter from them today (dated 22/01/10) which says.......... Dear ??? We thank you for your communication regarding this account. we have referred the matter to our client and will revert to you as soon as we are in receipt of instructions. In the meantime, we confirm that we have placed the account on hold. So....... what do I do next - if anything? Do you think it's looking good so far? Thanks everyone

  15. Hi GH,no I haven't sent the CPR letter yet, I have been really busy all week so I am going to get all the docs etc sent for this weekend, what is the change you are talking about? I am going to reply to my court docs online - just to make sure I meet the deadline
  16. Sorry all, I have been reading the other threads but can't seem to find the answer - do I complete the defence form or the aknowledgement of service form? The ack of service is : if you need 28 days (rather than 14) from the date of service to prepare your defence, or wish to contest the court's jurisdiction The defence form is : If you dispute the whole claim or wish to make a claim against the claimant Which one do I complete? I am thinking it is the Aknowledgment of service, Do I want to contest the court's jurisdiction? (I am not quite sure what this means but I am thinking - no I do not, is this correct?)   18. Thank you all - for your help, I was just wondering though - in the poc, where it says "The claimant agrred to pay monthly instalments etc etc"........ they don't mean the £1 a month do they? That I was paying up until 4 years ago? Oh I am so confused but I am sure I'll get through it Also, I need to put my defence on the back of the court form, what is my defence exactly? Something like,....... I defend this claim on the basis of not believing a signed agreement exists? Or do I defend it on the basis of not remembering applying for it and therefore ...... I am not sure! Thanks
  19. Could somebody please post me a link to a template for CPR request? I did find one but it is from 2008 and I want to make sure I have an up to date one (just in case some of the laws/rules have changed!! Thank you, I don't feel so alone in this now

Hi, yes I have still got the default and termination of account letters, I don't have an agreement because the card was applied for online, I don't think they ever sent out an agreement to be signed. Would you please keep an eye on my thread and helpme? Thank you, I am going to send the form back to say I intend to defend and request the docs, I will post back as soon as I have any more news, Thank you everyone for all your help
  21. I am still not sure why I am putting in a defence/counterclaim? Shall I just send the form back first of all and then deal with the rest in due course? If I counterclaim and lose - will I have to pay costs? Thanks
