  1. Hi, Well they have ignored my complaint. Sent a letter saying it would be answered by March, then another saying April, then another saying May. Nothing from them in May, but I then started getting phone calls from Apex Credit Management Ltd. Yep, you guest it, BC have passed my details on to them. Sent the usual "in dispute" letter to Apex and another letter to BC saying that they've ignored my complaint, yet again passed my details on while the account is in dispute and failed to produce my actual executed agreement. I told them to either produce the signed executed agreement now or take me to court immediately - in which case they will have to produce it anyway. Got a letter back with a photocopy of blank T&Cs as usual stating here is a copy of your executed agreement (yes, they used the words "executed agreement" for a blank set of T&Cs!) and the debt is now "in the recovery system" - meaning more debt collectors will be harrassing me soon:mad:. Not sure what to do now. Just trying to decide if I should forward my complaint to the useless FOS. ANYWAY - that's the creditcard. With the Barclays Bank Loan my attempt to reclaim the missold PPI has resulted in them saying "we're investigating your claims and we will contact you by March" then another letter saying April, then another saying May. The last letter I got in May said they are still investigating, but they are happy for me to forward the complaint to the FOS (probably because they know nothing will happen because the FOS are a waste of time). Just haven't got around to it yet ... very busy with our photography. Oh, what to do ......
  2. Hi slick, Yeah, sorry. It's all getting a bit messy on here because I'm doing stuff for Barclays account, Barclayloan and Barclaycard and I'm getting cross over with problems and advice. It did START as my Barclays Account thread, but has slowly degenerated into a general free-for-all:D I thought your #38 message about missing statements was to do with my Barclays account, 'cos I got bits missing from them too:rolleyes: That's easy to estimate though, 'cos the amounts are steady each month. With my Barclaycard it's a bigger problem because I paid a different amount of PPI each month depending on the balance left on the card. (i'm sure the was a big period in 2002 where the balance was cleared, so no PPI would have been paid). But I assume I can make up any figures and Barclaycard will put me straight. More concerned with getting my executed agreement - can a court order for non-compliance of SARs get that for me?
  3. Sorry to ask a stupid question but ... Is this the same Peter Townsend that is the manager for Barclays Privacy & Data Protection at Radbroke Hall? Is he also responsible for the Barclaycard data? If so, that is very interesting. I have had contact with him re my Barclays Account statements and when I mentioned Barclaycard he seemed to indicate it was a completely different company and nothing to do with him!

  5. Sorry none of this is very clear - never done anything like this before:confused: It's asking for the name, etc of my solicitor's firm. I don't have a solicitor, so I assume this should be left blank? Same with the claim number. I assume this will be provided later? Obviously Claimant is me. I put my name, but do I add my address? It asks for it on the other side of the form, but do I put it here as well? Defendant is obviously Barclaycard, but same question again? Do I include the address here or just at the bottom where it says "defendant's name and address? Do I put the Customer Services address or Head Office, or what? Should I include details about contacting the ICO to discover that Barclaycard totally lied about their microfilm status as a relevant filing system and their subsequent ignoring of this fact when I wrote to them with the ICO's response? Can I get them to provide my executed agreement via this as well? So far they haven't produced it, only copies of unsigned standard agreements (the usual rubbish). For damages I assume I just put in the cost of the postage for the two follow up letters, plus the time it took to write and research the content of those letters? letters sent, research time of relevant laws 5hrs per letter at £30 per hr, preparation time 1 hour per letter @ £30 per hour submitting this claim to court, research time of relevant laws and how to complete form 5hrs @ £30 per hr, preparation & writing/compiling time 1 hours @ £30 per hour Should I claim for "emotional distress" due to the worry and concern over loss of monies I may be owed? How do you actually prove "emotional distress" anyway? Anything else anyone can suggest? Has anyone done one of these?

While Barclays appear to be playing ball (although I've discovered a few gaps in the 10 years statements they sent me), I'm still getting the same response from Barclaycard - "pre 2004 on microfilm so we don't have to supply, blah, blah, blah - 6 years statements as gesture of good will". I took out my card in 2000 and have been paying a missold PPI ever since! I want those extra statements! So ... Which form do I use? N1, N244, EX343A ... ??? Also, as I'm unemployed, do I fill in form EX160 and send it with the above form? The first question is asking for a case number - but I don't have that yet!? Would really appreciate some advice on this one. Cheers.
  8. maybe not for you, but since I didn't know wtf I was doing it took quite a bit longer:) Eventually it clicked into place and I came up with the same result 1.00635 (or 0.635%) REALLY appreciate your help. Lets just hope I get a positive result from the bank. Cheers

Really appreciate your help slick. ------------------- thekat1979, no, no proper statements for my loan, only computer prints from my SARs. So no details of monthly rate - which is why I've been trying to work it out - so I can put it in the PPI calc.

  11. Thanks slick. makes sense if you know the monthly rate. But how do I work it back? for my Barclayloan I only know 7.9% APR and then under other financial information it says 7.765% p.a. So how do I work back to get the monthly rate for the spread sheet?
  12. yes, but it doesn't make much sense to me I'll try again, but the one thing I can't see on there is how to calculate the monthly rate.
  13. The problem with those No10 petitions is that - unless anyone knows about it, no one will go looking for it! We can always start our own one and make sure that every single member on this site (plus any others you're memebers of) goes to sign it. THAT should have a bit more impact (in theory:))
  14. ALSO, just working on my barclayloan. Using the "PPI Calculator - Single Premium Polices" spreadsheet from this site. BUT... how do I calculate the MONTHLY interest %? on my barclayloan agreement it only says 7.9% APR and then under other financial information it says 7.765% p.a. (confused as to why they are different of course)
  15. thats what I thought. So:- 1 + 2.05 = 3.05 3.05 * 12 = 36.6 36.6 - 1 = 35.6 35.6% ???? That doesn't sound right to me!? or is it:- 1 + 2.05 = 3.05 12 - 1 = 11 3.05 * 11 = 33.55 33.55% ???? Still doesn't sound right

I contacted the ICO and they confirmed this is a lie! I sent a letter to Barclaycard with the ICO response and they returned the identical letter and the same 6 years statements - totally ignoring my letter and the statement from ICO:- see my posts here

  18. well the monthly rate on my overdraft is 2.05% so are you saying it is 36.6%? Sorry what was the ^ sybol meant to mean?
  19. Well, I finally have bank statements going back to 24th Dec 1997 - so basically 10 years (still another 10 years of banking history with Barclays missing), which will do for now. Started filling in the "complex-bank-charges-calc.xls" spreadsheet and have a question:- If they take out PPI on 1st March, the interest amount, date and account balance I need to use is from the following month, correct (i.e. 1st April)?
  20. It's probably been covered in here somewhere, but a search for "digital signatures" or "online signatures" is throwing up thousands of pages. Basically, I applied for my loan online. There is no actual credit agreement with my signature, just a "Barclayloan Agreement" across several pages. The last page has a box that says **signed** and a note stating:- To sign the agreement please select "signed" from the drop down box. By selecting signed and submitting the agreement you will be legally bound by its terms. Question is how valid is this?
  21. Yes, for both my Barclayoan and my credit card. Nothing back except 6 years statements and a note saying "please find enclosed your statements as requested (?)".   22. Can any of the above filing be done online? It's just that our "local" county court is a 2hr round trip! (not forgetting all the actual running around at the courts, waiting, etc, and parking - which is always fun!).
  23. Not sure what use it was. I just sent a letter to Barclaycard including the above info and ref no. asking for ALL my statements. They have sent back the exact same letter stating "doesn't form part of a ... blah, blah" and 6 years statements with "statements before May 2004 sent as a good will gesture". They are unbelievable!

I had an over draft for the last 20 years for which I was paying £14.40 a month Overdraft Protection Insurance (basically PPI) which was added automatically and was a condition of having the overdraft. As I understand it - that's illegal. I was hoping to get copies of all the paper work relating to the overdraft and statements going beyond 6 years as requested. Also, I have a barclayloan. I requested copies of all paperwork relating to that loan. PPI cover, copy of credit agreement, etc. PPI for loan was also missold. I was self-employed when I took it out. Plus all the usual :- · Full copies of all contracts which you believe exist or have existed between myself and your organization, including true copies of any documents you hold in support of the same (e.g. signed, enforceable, credit agreements). · A complete list of all transactions or statements relating to ALL of my Accounts, Loans and or credit card with your organization (not simply the last six years). · Copies of all documents which include any of my personal information including copies of any contacts or invoices, emails or computer records containing my personal information, or any records which pertain to this information (this includes copies of letters I have written to you). · Full copies or transcripts of any correspondence in postal, email or any other format which you have entered into with any individual, organization or third party which contains my personal or financial information, or which pertains to me. · Where any previous information or records held have been deleted or disposed of, the methods used to do so, including dates, certificates or references confirming details of destruction. Where you are unable to provide such certificates, please provide a declaration, signed by an authorised officer of your company, confirming the dates and methods of destruction of this data. · Full hard copy print outs of my personal or financial information, held in a digital, magnetic or any other format which is held in any archives, backups or other storage devices / locations. I have just received a response to my second LBA sent on 15/01/09. Once again they sent copies of the last 6 years bank statements - that's it, nothing else.
